RESOLUTION NO. 78-32
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, MODIFYING AND AMENDING
CONDITIONS OF SALE OF CITY PROPERTY WITH
FRONTAGE PARTIALLY ON "C" STREET, SECOND
STREET, EL CAMINO REAL AND THIRD STREET.
WHEREAS, Resolution No. 77-35 was regularly adopted by
the City Council on April 1, 1977; and
WHEREAS, pursuant thereto an agreement was entered into
for tile sale of the property owned by City, making an irregular
site having approximately 60,750 square feet with frontage
partially on "C" Street, Second Street, El Camino Real, anti
Third Street, in the City of Tustin; and
WHEREAS, present circumstances permit City to relinquisl~
possession of the subject property as hereinafter set forth and
Buyer is willing to commence and complete construction at earlier
times than previously contemplated and agreed; and
WHEREAS, City and Buyer wish to provide and agree for
the earlier relinquishment of possession of the subject prop-
ety and for the earlier commencement and completion on of construc-

tion thereon.
NOW, THEREFORE, THE CIITY COUNCIL OF THE CITY OF TUSTIN
HEREBY RESOLVES:
1. City will not lease and rt.,t.,'.~[n ttte use of Parcel "B"
or any other portion of the subject property, except as provided
herein.

The provisions of lc. (1.), 1. c. (2) and I.e. of
Resolution No. 77-35 as conditions of sale are hereby modified
as provided herein.

The City may use and occupy the subject property until
April 1, 1978, and shall vacate and relin'quish possession
by such date, provided, however, (l.) Tt~at in the event of
inclement weather or other impediments, City may have until
May 1, 1978, to vacate and relinquish possession, and (2) City
may in any event occupy and use the parking .lot located on the
northerl.y one-half of the subject property for storage purposes
until September 1, 1978.
Buyer shall commence construction within thirty (30)
days after City vacates and relinquishes possession of all the
subject property other than the parking lot .located on the
northerly one-half of the subject property and, provided City
vacates and relinquisl~es possess~o~ ~,f ~]! the subject property
as provided in this resolution, Buyer shall complete construc-
tion by December 31, 1978, ali. subject to the other provisions
of the Disposition and Development Agreement between CJ. ty and
Buyer dated on or about August ].9, 1977.

Except as expressly otherwise provided herein, the
provisions of the aforedescribed Disposition and Development
Agreement and Resolution No. 77-35 shall remain in full force
and effect as conditions of sale and a copy of this Resolution
shall be recorded concurrently with the Grant Deed to the
subject property.

In consideration of the foregoing, City authorizes
the execution and delivery of a (grant Deed to the subject
property.

The City Clerk is authorized and directed to prepare
and deliver a certified copy of this Resolution together with
the aforesaid deed to be recorded concurrently therewith.
PASSED AND ADOPTED at a regular meeting of the City Council
of 'the City of Tustin held on February 21, 1978.
