RESOLUTION NO. 78-31
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ESTABLISHING CERTAIN FEES AND SERVICE CHARGES.
The City Council of the City of Tustin, California, does hereby
resolve as follows'
Section 1' The following fees and service charges are hereby
es tablished and supersede any existing fees, and shall be applied
uniformly except where, in the discretion of the City Administrator,
reduced fees are justified by special circumstances.

BUILDING REGULATION AND PERMIT FEES '
Investigation Fe~
A special investigation fee shall be charged by the Building
Official for any investigation of a building, structure, work
reports, certification, or any other related work requested by
an owner or his authorized agent. Said fees shall be assessed
in an amount sufficient to reimburse the City for costs incurred
but in no case shall be less than twenty-five dollars ($25'.00).

Refunds
The Building Official shall make ho refunds on fees collected
amounting to five dollars ($5.00) or less or on any plan checking
fee; re funds may be made to the permittee in an amount equal to
85% of the permit fee paid unless the fee paid for the issuance of
the permit has been made for an area outside of this jurisdiction
or that duplication of permits has been made and two fees have
-been collected for the same job, in which case one hundred percent
(100%) of erroneously collected permit fees or duplicated plan
checking and permit fees may be refunded; provided that no refund
of any fee or portion thereof sh.all be made in either of the
following cases.'
(1) After. one year has elapsed from the date of the issuance
of the permit.
(2) If the work designated in the permit has been commenced.
Miscellaneous Fees
(1) Work Started Without Permit
Where work for which a permit |s required is started or proceeded
with prior to obtaining said permit, the fees specified shall be
doubled, but the payment of such double fee shall not relieve any
persons from fully complying with the requirements of the Code
in the execution of the work nor from any other penalties pre-
scribed therein.
(2) Reinspection Fee
When the work is not ready for a called inspection or, when the
inspector must reinspect more than twice, because of deficiencies
a reinspection fee must be paid for each subsequent reinspection
in the amount of $10.00 each.
B.~i;lding Fees
(I) Plan Check Fees
Application processing and plan checking fee shal! be paid to the
Building Official at the time of submitting plans and specifica-
tions for checking. Said fee shall be equal to one half of the
Building Permit Fee for Group "R-3" "M-l" "H-3"
, , and occupan-
cies, and 65% of the Building Permit Fees for all other occupan-
cies.
In addition, buildings and structures requiring compliance with
the State of California Energy Conservation, Noise Isolation
and Insulation and other State-required acts shall pay a plan
check fee equal to 50% of the Building Permit Fee.

The Building Official shall charge the appellant for any
field investigation per "Investigation Fee" page 4 of this
Resolution, plus the direct and overhead labor and material
costs required to prepare for the appeal, conduct the appeal
and complete the appeal procedure. This shall be estimated
initially and the appellant refunded (or charge additional,
if required) upon completion of the appeal. Any uncollected
costs shall be processed through the City Clerk and upon approval
by the City Council added to the tax invoice for the appe!lant's
property.
Section 2' The City Administrator is hereby authorized to establish
charges on other services provided by the City, but shall give notice
to the City Council of charges so established. .'
Section ~' The fees set forth hereinabove in this Resolution shall
be imposed on the first day of March, 1978, provided these fees
not be in conflict with any federal statutes, State law and/or exe-
cutive orders issued pursuant thereto, prohibiting such increase of
fees. '
