RESOLUTION NO. 78-30
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, ESTABLISIIING
FIRST STREET UNDERGROUND UTILITY DISTRICT
NO. 4
THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DOES .......
HEREBY P~ESOLVE AS FOLLOWS-
WHEREAS, a public hearing was called for February 21, 1978
at the hour of 7-30 P.M. in the Council Chambers of the City of
Tustin, California, to ascertain whether the public necessity,
health, safety, or welfare requires the removal of poles, over-
head wires and associated structures and the underground in-
stallation of wires and facilities for supplying electrical,
communication, or similar or associated service, within that
certain area. of the City of Tustin more particularly described
in Exhibit "A'° attached hereto and as shown on a map marked
Exhibit "B" attached hereto.
WHEREAS, notice of such hearing has been given to all
affected property owners as such are shown on the last
eoualized assessment roll and to all utilities concerned
in the manner and time required by law; and
WHEREAS, such hearing has been duly and ~egularly held
and all persons interested have been given an opportunity to be
heard.
NOW, THEREFORE, BE IT RESOLVED that the Council of %he
City of Tustin hereby finds and determines that the public
necessity, health, safety and welfare require the removal of
poles, overhead wires and associated structures, 1) to eliminate
unusually heavy concentrations of overhead distribution
facilities, 2) to clear streets used extensively by the general
public, which carry a heavy volume of vehicular traffic, and 3)
to clear streets which pass through a civic area, and the under-
ground installation of wires and facilities for supplying
electric, communication or similar or associated service in the
Underground District described in Exhibit "A" attached hereto
and made a part hereof by this reference, and pursuant to the
provisions of Ordinance No. 411 of the City of Tustin, such area
is hereby established as First Street Underground Utility
District No. 4.
RESOLVED, FURTHER, that the Council does hereby fix
December 1, 1978, as the date on which affected property owners
must be ready to receive underground service, and does hereby
order the removal of all poles, overhead wires and associated
overhead structures and the underground installation of wires
and facilities for supplying electric, communication or similar
or associated service within First Street Underground Utility
District No. 4 on or before Decen~er 1, 1978.
RESOLVED, FURTHER, that the City Clerk is hereby instru¢
to notify all affected utilities and all persons owning real
property within First Street Underground Utilit'y District No. 4
of the adoption of this resolution within ten (10) days after
the date of such adoption. Said City Clerk shall further notify
sa~,~ ~--'~perty owners of the necessity that, if they or any perso
occupying such property desire to continue to receive electric,
communication or other similar or associated service, they or
such occupant shall, by the date fixed in this resolution, pro-

vide all necessary facility changes on their premises so as to
receive such service from the lines of the supplying utility
or utilities at a new location, subject to applicable rules,
regulations and tariffs of the respective utility or utilities
on file with the .Public Utilities Commission of the State of
California. Such notification shall be made by mailing a copy
of this resolution together with a copy of said Ordinance No.
411, to all affected property owners as such are shown on the
last equalized assessment roll and to all utilities affected by
this resolution.
PASSED AND ADOPTED at a regular meeting of the City
Council held on the 21st day of Feburary, 1978.

LEGAL DESCRIPTION OF FIRST STREET
UNDERGROUND UTILITY DISTRICT NO. 4
IN THE CITY OF TUSTIN, CALIFORNIA
That portion of a. part of Tustin City as per Map recorded in
Book 4, Page 219 of Miscellaneous Records of Los Angeles
County, California, described as follows:
Beginning at the point of intersection of the easterly
right of way line of Centennial Way (66' wide) and the
northerly right of way line of Main Street (80' wide);
Thence, northerly, along said easterly right of way line
of Centennial Way, a distance of 608 feet;
Thence, westerly, at right angles to said easterly right
of way line, a distance of 66 feet to the point of inter-
section with the westerly right of way line of said
Centennial Way;
Thence, northerly along said westerly, right of way line
a distance of 618 feet more or less to the point of
intersection with the southerly right of way line of
First Street (100' wide);
Thence, easterly, along said southerly right of way line,
a distance of 1,062 feet more or less, to the beginning
of a tangent curve, concave southerly and having a radius
of 225 feet;
Thenc'e, along the arc of said curve, through a central
angle of 40° 01' 40"
· , an arc distance of 157.19 feet to
the point of intersection with the northwesterly right of
way line of Newport Landing Road as said right of way line
is shown on said Map of a part of Tustin City;
Thence, southwesterly, along said northwesterly right of
way line, a distance of 1,538 feet more or less, to the
point of intersection with the said northerly right of
way line of Main Street;
Thence, westerly, along said northerly right of way line
a distance of 160 feet more or less to the point of beginning.

FIRST STREET UNDERGROUND UTILITY DISTRICT NO. 4
At its meeting of February 6, 1978, the Ci.ty Council of the City of Tustin,
California, adopted a minute order calling for a public hearing' at. 7-30 P.M.
on February 21, 1978, to consider the merits of establishing an underground
utility district within t~e area bounded by Centennial Way, First Street,
Newport Avenue and Main Street, more particularly as shown on Exhibit "B"
attached.
Meetings have been held with the' Edison Company and Pacific Telephone Company
to determine costs involved. Funding will be by utilization of Community
Redevelopment Agency Tax Incren;ent Funds. There will be no property owner
conversion expense as all existing private utility service lines are presently
underground ready to accept u~derground service. Estimated cost of the
underground work is as follows:

Initial indications by the Edison Company are that their work can be completed
