HomeMy WebLinkAboutCC RES 78-134 5 6 8 l0 15 ,. 16 18 19 ~0 ~5 £6 ~8 29 5O RESOLUTION NO. 78-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CONSENTING TO A WAIVER OF NOTICE AND HEAR- ING FOR UNINHABITED CONSENT ANNEXATIONS The City Council of the City of Tustin does hereby resolve · as follows: 1. The City Council finds and determines as follows: a) Section 35151 of the Municipal Organization Act of 1977 requires the Local Agency Formation Commission to send notice to the City of Tustin upon the filing of any petition or resolution of application for an uninhabited annexation for which all property owners have given their written consent and to delay annexation proceedings for 10 days following the mailing of written notice. . b) By written consent of the City Council, the require- ment.'.for a mailed notice and Local Agency Formation Commission determinations may be made without not ice and hearing. · '2. The City Council hereby consents to a waiver of the re- quirement for a mailed notice of the filing of a resolution or petition pursuant to Section 35151 of the Municipal Organization Act of 1977 and consents to the Local Agency Formation Commission making deter- minations without notice and hearing when annexation applications are submitted with the unanimous consent of the property owners within the affected territory. 3. The City Council further requests the Local Agency Forma- tion Commission, pursuant to Section 35151 of the Municipal Organization Act of 1977,. to authorize annexa- tion proceedings to be conducted without notice and hearing and without an election when property owners within the affected uninhabited territory have given their w~itten consent to the annexation.
