RESOLUTION NO. 77-124 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFI- CATIONS FOR MODIFICATIONS TO THE EXISTING POLICE DEPARTMENT FACILITY. WHEREAS,. it is the intention of the City Council of the City of Tustin, Cali£ornia, to make modifications to the existing Police Department facility; and ' WHEREAS, the c0n{munity Development Director has pre- sented pl.ans and specifications for the construction of said work at th is'location; NOW, THEREFORE, BE IT RESOLVED that the plans and specifications presented by the Community Development Director be and.are hereby approved as the plans and specifications for the modification to the existing Police Department facility.' 11 BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law for 12 the receipt of sealed bids or proposals for the doing of the work specified in the aforesaid plans and specifications which 13 said advertisement shall be substantially in the following words and figures, to wit' 14 "NOTICE TO CONTRACTORS" 15 · SEALED PROPOSALS will be received at the office 'of 16 the City Clerk, Tustin City Hall, Centennial Way at Main Street, Tustin, California, until 10-00 o'clock a.m. on the 13th day of 17 December, 1977, at which time they will be publicly opened and read, for performing work as follows' 18 Modification to the existing Police Department 19 facility. · 20 Bids are required for the entire work described herein' 21 Schedule of Work Items , 22 23 24 26 27 28 29 31 32 ~I.tem No ._ ~Quan t i ty I 1,640 sq. ft. 2 10 ea. 3 4 ea. 4 7 lin. ft. 5 4,460 sq. ft. 6 ?:,670 sq. ft. 7 9,912 sq. ft. 8 9 sq. ft. 9 248 ft. lb. 10 1,087 sq. ft.- 11 17 lin. ft. 12 3 doors 1 doorframe 13 10 .1.in. ft. Plans, specifications and proposal forms to be used for bidding on this project can only be obtained by prospective bid.. ders at the office of the City Clerk, Tustin City Hall, Centen;.~-- nial at' Main Street, Tustin, California, 92680, upon payment o $5.00 per set which which amount shall be non-refundable. Plans and specifications will only be mailed out upon payment of $7.00 per set which amount shall be non-refundable. 8 In conformance with Section 37931 o£ the Government Code, all bids shall be presented under sealed cover on the 9 proposal form provided and accompanied by one of the following forms of bidder's security' lO a. Cash. 11 b. Cashier's check made payabl, e to the City of Tustin. c. Certified check made payable to the City of Tustin. 12 d.. Bidder's bond executed by an accredited surety insurer, made payable to the City of Tustin. The security shall be in an amount equal to at least 14 ten percent (10%) of the amount of the bid. A bid shall not be considered unless one of the forms of bidder's security is 15 enclosed therewith. 16 A Sureiy Bond for payment of labor and' materials will be required in the amount of fifty percent (50%) of the estimated 17 total contract price an'd a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total ~18 contract price in the form attached to the contract documents. Said bonds shall be issued by a company having a rating of 19 A+AA or better. 20 The Ciiy. of Tustin reserves the right to reject any or all bids, and/or waive any informality on a bid. No bidder may 21 withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. 22 23 bidder. The contract will be awarded to the lowest qualified 24 Provisions of the State Contract Act are not applicable, and prospective bidders will not be required to be prequalified. All work to be done under the direct supervision of the 26 Con~nunity Development Director, City of Tustin. 27 Ail work to be paid for at the unit prices bid from appropriated monies. 28 Said City of Tustin, pursuant to the Labor Code of th~. 29 State of California, has ascertained and determined that the general prevailing rate of hourly and per diem wages in the ~0 locality.in which the said work herein described is to be per formed, for each craft or type of workman or mechanic needed ~1 to execute the contract and also the general prevailing rate for le~'al holiday, and overtime work for each craft or type of ~2 workman or mechanic, to be as indicated in Resolution 77-52 as 1 6 8 10 ll 12 13 14 15 16 17 18 19 20 21 22 24 26 27 28 29 ~0 52 previously published in a newspaper of general circulation, and on file in the office of the City Clerk. Employer payments other than those itemized therein, as defined in Section 1773.1 of the Labor Code, are to be paid in accordance with the terms of the collective bargaining agreement applicable to the type or classification of the workmen or mechanics employed on the project. Copies of all collective bargaining agreements relating to the work as set forth in the aforementioned Labor Code are on file and available for inspection in the office of the Department of Industrial Relations, Division of Labor Statistics and Research.
