HomeMy WebLinkAboutCC RES 77-121RESOLUTION NO. 77-121 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE CONSTRUCTION OF SIDE- WALK, CURB, AN.D DRIVE APRON REPAIR AT MISCEL- LANEOUS LOCATIONS. AND DIRECTING lHE CITY CLERK TO ADVERTISE FOR BIDS. WHEREAS, it is the intention of the City Council of the City of Tustin, California, to construct sidewalk and curb repairs at miscellaneous locations, and WHEREAS, t~he City Engineer has presented plans and specifications for the construction of said work at these locations, NOW, THEREFORE, BE IT RESOLVED that the plans and specifications presented by the City Engineer be and are hereby approved as the plans and specifications for the construction of sidewalk, curb and drive apron repair at miscellaneous locations. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law for the receipt of sealed bids or proposals for the doing of the work specified in the aforesaid plans and specifications which said advertisement shall be substantially in the following words and figures, to-wit' "NOTICE TO CONTRACTORS" SEALED PROPOSALS will be received at the office of the City Clerk, Tustin City Hall, Centennial Way at Main Street, Tustin, California, until ll o'clock A.M. on the 13th day of December, 1977, at which time they will be publicly opened and read, for performing work as follows' Construction of sidewalk, locations. curb, and drive apron repair at miscellaneous Bids are required for the entire work described herein' SCHEDULE. Description of Work Sawcut asphalt or Remove existing a concrete sidewalk Remove exi s ti ng a type "D" curb and concrete nd construct nd construct gutter Remove existing and patch asphaltic concrete pavement Remove existing and construct concrete drive apron A-1 The foregoing q~antities are approximate only, being given as a basis for the co~nparison of bids, and the City of Tustin does not, expressly or by implication, agree tidal tl~e actual an~ount of' work will correspo~d tl~erewith, but reserves the ri g},t to increase or decrease tl~e amount of any class or portion of the work, or to omit portions of tt~e work as may be deemed neces- sary or advisable by the Engineer. The City of Tustin has budgeted a fixed an~ount for the work encompassed by these plans and specifications. In the event that the low bid exceeds the budgeted amount, the City reserves the right todeleteone or more of the proposed projects from the contract as necessary to stay within the budgeted amount. The provisions of Section 4-103B of the Standard Specifications (increased or decreased quantities) shall not apply to this contract. Plans, specifications and proposal forms to be used for bidding on this project can only be obtained by prospective bidders at the office of the City Clerk, Tustin City Hall, Centennial at Main Street, Tustin, California, 92680, upon payment of $2.50 per set which amount shall be non-refundable.. Plans and specifications will only be mailed out upon payment of $5.00 per set which amount shall be non-refundable. In conformance with Section 37931 of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and accompanied by one of the following forms of bidder's security' a. Cash. b. Cashier's check made payable to the City of Tustin. ¢. Certified check made payable to the City of Tustin. d. Bidder's bond executed by an accredited surety insurer, made payable to the City of Tustin. The security shall be in an amount equal to at least ten percent (10%) of the amount of the bid. A bid shall not be considered unless one of the forms of bidder's security is enclosed therewith. A Surety Bond for payment of labor and materials will be required in the amount of fifty percent (50%) of the estimated total contract price and a Faithful Performance Bond in the amount of one hundred percent (100°' ~o) of the estimated total contract price in the form attached to the contract documents. Said bonds shall be issued by a coml~any having a rating of A+AA or better. City of Tustin reserves the right to reject any or all bids, and/or waive any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. The contract will be awarded to the lowest qualified bidder. Provisions of the State 'Contract Act are not applicable, and prospective bidders will not be required to be prequalified. All work to be done under the direct supervision of the City Engi'neer, City of Tustin. All work to be paid for at the unit prices bid from appropriated monies. A-2 Said City of Tustin, pursuant to t}%e I0abor Code of the State of California, has ascertained and determined that t~e general pre- vailing rate of hourly and per diem wages in the locality in which' the said work herein described is to be performed, for each craft · c..~n c or type of wor]:man or xr.e-~ i needed to cvccute tl~e contract and also the general prevailing rate for legal holidays, and overtime work for each craft or type of workman or mechanic, to be as indicated in Re so lu ti ol% 77-52 as previously ~ublist%ed in a newspaper · of general circulation, and on file in tile office of the City Clerk. Employer payments other than those itemized therein, as de- fined in Section 1773.1 of the Labor Code, are to be paid in accor- dance with the terms of the collective bargaining agreement appli- cable 'to the type or classification of tile workmen or mechanics employed on the project. · Copies of all collective bargaining agreements relating to the work as set forth in the aforementioned Labor Code are on file and available for inspection in the office of the Department of Indus- trial Relations, Division of Labor Statistics and Research.
