HomeMy WebLinkAboutZA Action 07-006ZONING ADMINISTRATOR ACTION 07-006 TIME EXTENSION FOR CONDITIONAL USE PERMIT 05-028 14092 BROWNING AVENUE The Zoning Administrator of the City of Tustin does hereby resolve as follows: The Zoning Administrator finds and determines as follows: A. That a proper application for a time extension for Conditional Use Permit 05-028 was filed by Lillian Chang, on behalf of Villa Valencia Mobile Home Estates, requesting approval to extend the approval of ten mobile home pads as an extension of the existing mobile home park located at 14092 Browning Avenue. (APN 432-361-03, 08) for an additional twelve (12) months to allow development of the mobile home pads and establishing the use. B. The .:proposed use is consistent with the policies and requirements of the ` Mobile Home Park (MHP) General Plan land use designation and zoning district. In addition, the project has been determined to be consistent with the Air Quality Sub-element. C. That-establishment of the mobile home pads requires obtaining a grading, landscaping, and lighting permit from the City of Tustin, which are currently in plan check and are pending permit issuance with a few minor corrections. The use is anticipated to be established within twelve months by September 25, 2008. D. That Section 9299.b.(4)(b) of the Tustin City Code authorizes the Zoning Administrator to grant time extensions up to twelve (12) months from the original expiration date of the approved conditional use permits. E. That a public hearing was duly called, noticed, and held on said application on October 22, 2007, by the Zoning Administrator. F. That the time extension request to continue the temporary operation of a contractor's storage yard, as conditioned, will not be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighbofiood of such proposed use, nor be injurious or detrimental to the property and improvements in the neighbofiood of the subject property, or to the general welfare of the City of Tustin, as evidenced by the following findings: a) As conditioned, the applicant would be required to comply with all of the conditions approval for Conditional Use Permit 05-028 approved through Resolution No. 4041 which authorized the establishment of ten additional mobile home pads as an extension of Villa Valencia Mobile Home Estates. This project is Categorically Exempt pursuant to Section 15301, (Class1) of Title 14, Chapter 3 of the California Code of Regulations (Guidelines for the California Environmental Quality Act). II. The Zoning Administrator hereby approves atwelve-month time extension for approval of Conditional Use Permit No. 05-028 authorizing development of ten new mobile home pads at 14091 Browning Avenue (Assessor's Parcel Nos. 430- 361-03, 08), subject to conditions contained in the Planning Commission Resolution No. 4041 attached hereto.
