RESOLUTION NO. 77- 81
A RESOLUTION OF THE CITY COUNCIL, CITY OF
TUSTIN, CALIFORNIA, RELATING TO THE TERMS
AND CONDITIONS OF CITY PERSONNEL EMPLOYED
PURSUANT TO THE PROVISIONS OF THE FEDERAL
COMPREHENSIVE EMPLOYMENT AND TRAINING ACT
(PL 93-203 - C.E.T.A.)
WHEREAS, the United States Congress enacted the ~rehensive Emplo~nt
and Training Act of 1973 as Public Law 93-203 for the PurPose of providing.
job training and emplo~t opportunities for econ~cally disadvantaged
unemployed and underemployed persons and to assure that training and other
services lead to maximum future e3Nployment opportunities; and
WHEREAS,. under the provisions of' the Ccmprehensive Emplo~t and
Training Act. of 1973, hereinafter referred to as'"C.E.T.A." , the Federal
Government is providing partial or complete financial funding to employ
persons in local governmental programs designed to train and educate said
individuals in order that they my later secure and retain emplo~t at
their maximum capacity; and
WHEREAS, pursuant to the authority contained in the C.E.T.A. the
·
Secretary of Labor has issued rules and regulations to implant said Act
when local governments have joined in the participahion; and
WHEREAS, said Act is designed to provide this training ~rience but
with expiration dates which, to date,-have been repeatedly extended; and
WHEREAS, the provisions regarding compensation and working conditions
for the employee participants are contained in the Secretary's rules and
regulations and provide that the employing agency is not required to provide
all of the existing benefits and related programs to the C.E.T.A. employees
that are otherwise provided to regular Permanent employees of the agency;
and
WHEREAS, the City does have the option to provide additional benefits
over and above the minimum requir~ts of %he Secreta~qf of Latx)r; and
WHEREAS, the City has entered into a grant assistance program with the
Coun~ of Orar~e pursuant to the provisions of C.E.T.A. in order to obta~
necessary funds, to en~loy personnel; and

NCg~, RT{EREFORE, .THE CI%~f COUNCIL OF ~·[E CITY OF TUSTIN DOES
FINqD, DETEP~LTNE AND RESOLVE AS FOLLOWS-

1. In aCcordance with t~he provisions of the Tustin City Code, the
Tustin Personnel Rules and Regulations, and Resolutions and Minute Orders
of the City of Tustin, the· City Council reaffirms that the C.E.T.A. ~.nployees
are limited service personnel employed for the puq~ose of providing' training
and educational experience to said emPloyees in order to obtain future
maximum emtoloyment.
Said C.E.T.A. employees are to serve with the City until the Act
1~ is no longer continued by the United States Government, and concurred in by
14 the County of Orange or by express oonsent of the City of Tustin..

C.E.T.A. employees are to be governed by the Tustin City Code,
16 and the Tustin Personnel Rules and Regulations except insofar as more
specifically defined in this Resolution.

In accordance with the authority set forth in the C.E.T.A. the
19 City reserves its right to terminate its participation in said program at·
any time which could result in the immediat~ termination of any or all
Zl .employees funded under this program.
22 5. C.E.T.A. employees shall be oont~~a~ at a salary range set
~,~ forth in Pa_ra~aph 8 herein., and shall bo enti~~ to receive n~rit raises,
24 in accordance with the procedures and requirers set forth in the Tustin
Personnel Rules and Regulations.
6. C.E.T.A. ent~loyees shall receive the benefits that are granted to
regular pe~ent servico err~loyees, of t2'teir san~ class, for n~dical,
dental, life insurance, and disability insurance.

That the C.E.T.A. employees, while employed in a variety of job
classifications, have one ~n characteristic, namely, that they are
employed on a full time basis, but for a fixed period of. time in order to

gain work experience and training in order to find future permanent ea~loyment
in either t2]e public or private sector.

These enmployees are partially or ~letely funded through United
States Gover~~t financing.
11. Effective Date - Unless otherwise specified to the contrary in
this Resolution, all provisions shall be effective as of the' dates the
benefits of other en~loyees in their same or similar classification became
effective.
PASSED AND ADOPTED at a regular meeting of the City Council, City of
Tustin, California, held on the 15th day of August, 1977.
