RESOLUTION NO. 77-79
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN RELATING TO THE CLASSIFICATION,
COMPENSATON AND TERMS OF EMPLOYMENT OF
ADMINISTRATIVE AND MANAGEMENT OFFICERS OF CITY.

heads and the manag~went officers under their supervision and subsequent
r~dations to the City Administrator.
NOW, THEREFORE, the City Council of the City of Tustin does hereby
RESOLVE as follows:
Section 1. The classificatiOn, compensation and te/m~ of emplo~t
for non-adminis~a~ve and non-manag~t employees of City are set forth'
by separate resolution of the City Council and the provisions herein set
forth shall not apply to those employees.
Section 2. Adn~is~ative Officers. Those employees holdin~ the

the City Attorney, are deemed to be administrative officers of the City.

members of the City Council and City Attorney, except that the provisions
of Sections 7, 11 (B), (C), (D) ,. (E) and (F) of this Resolution shall apply

The Salary ranges and rates established herein for administrative and
management officers shall be effective for the pay period beginning July 4,
1977, and shall be automatically increased by 0.8% effective August 29,
1977, the effective date of impl~tation of the revised long-term disability
plan, but not to exceed $15.00 per month. Each Administrative Officer and
each Management Officer assigned to such classifications shall receive the
increased flat monthly salary or the salary for the range and step in which
~-8 he/she is serving.
~9 Section 5. Exempt Positions. All administrative and management
50 officers included in the provisions of this Resolution, except police
sergeants and fire captains, are exempt positions and a~e not entitled to

authorized by the City Council for a specific project. The monthly

salary shall be considered full compensation for all hours ~rked and no
overtin~ shall bo considered for pas.~t for said en~loyees; hc~vor,
administrative leave n~y be granta~ when approved by the City Administrator
for good and sufficient cause. The City Administrator shall have the
authority to delegate this authority to the Department Heads.
Section 6. Life Insurance.
Life Insura~..ce o~ Employee.. The City shall provide life insurance on
the life of each Administrative and Manag~nent Officer designated in this
Resolution and pay the full annual premium therefor. The face an~un't of
said policies shall be to the nearest $1,000.00 of annual salary.
Section 7. Medical and Dental Benefits. The City shall provide a
medical/ health' benefit program and dental care insurance program for the
benefit of all Administrative and Manag~_nt Officers designated in this
Resolution and their dependents. The City Shall pay the full amount of the
premium of said insurance programs for Administrative Officers and their
dependents, 'if applicable. The City shall pay up to $90.00 per n~n~ for
the premium of said insurance programs for Manag~t Officers and their
dependents, if applicable.
section _8.~ .Di~sabi!itY Compensation. The City shall provide, a long-
tern disability compensation plan for the follc~ing personnel:
1. All Administrative Officers designated in this Resolution; and

All Manag~t Officers designated in this Resolution'.
The e3~ployees shall pay the premium required for coverage.
Section 9. General Leave.
(a) Administrative and Manag~n~nt Officers shall be converted
from the sick leave program to the general leave program of the City
as it applies to general employees.
(b) Administrative Officers enumerated in Section 4 shall receive
tw~ (2) additional days of general leave a year subject to the approval
of the City Administrator based on the officer's p~rfonnance. The
City Administrator's Performance will be revi~ by the City Council.

(c) Administrative Officers and Management Officers may receive
up to forty (40) ho2t-s of a~ministrative leave per year at 'tJ~e discretion..

discretion of and by the City Council) when such an employee's "overtime"
worked is in ~xcess of normal overtin~ requirements of that position.
(d) The Fire Chief, Operations Officer and Fire Marshal shall
receive forty (40) hours of compensatory time per year as ~ation

Section 10. Uniforms. Uniforms for specified classifications of
Manager officers shall be determined by the City Administrator and
designated allowances are as follows-
(1) FIRE OPERATiCINS OFFICER, FIRE ~R~SHAL AND FIRE CAPTAIN

(a) Initial Issue - a' full new issue, of work and dress
uniforms as prescribed by Departmental Order which shall be
in lieu of any cash maintenance pa~t for the first year
as a uniformed officer.
(b) After First Year- a cash maintenance allowance of
$90.00 per year payable semi-annually, in advance, provided
the entoloyee is employed on July 1st or January 1st as
applicable and provided the employee has been employed as a
uniformed officer over one year. An employee shall receive
a proration of the semi-annual pa~t if said first year
period will expire during the six-month period covered by
the allowance.
Employees shall be responsible for insuring that proper, cles=n,
well-maintained, presentable uniforms are aVailable for his work
shifts. Uniforms damaged in line of duty will be repaired or
replaced at City expense based on survey and recordation of
the Chief. Uniforms shall only be worn on occasions and for
purposes approved by the Chief.
(2) MAINTENANCE FORS~gkN- Maintenance Foreman shall participate
in a uniform rental and cleaning, service program and shall pay, by

payroll deduction, $2.00 per pay pericx] t~.;ards ~]e cost of such
se. rvice. The Maintenanc~ Forenunn shall pay the entire cost of additional
services he selects above the stand service provided by the City.

A. Auton~bile Allowance.
1. Administrative Officers. The following Administrative
Officers shall receive an amount per month as an expense reimburs~t
allc~ance for their personally-owned and maintained automobile used in the
regular course of performance of the duties of the officer's job within a
radius of sixty (60) miles of the City Hall and in the amount hereinafter
specified:
a) City Administrator $150.00 per month
b)
Assistant City Administrator
$125.00 per month
c)
Assistant City Administrator -
Community Developn~nt
$125.00 per month
d) City Engineer
$. 50.00 per month
e)
Director of Parks and Recreation
$ 50 o00 per month
For required travel beyond sixty (60) miles, the officer shall be entitled
to a commercial transportation allowance as set forth in subsection (2)
below. Other Administrative Officers may claim a mileage reimbursement as
set forth in subsection (2) below.
A City-owned and maintained aut(m~bile shall be provided to

2. Management Officers. Manag~t Officers and appointed
officials may claim autcmobile reimburs~t on approved expense claim
forms furnished by the Finance Departmant for the use of his/her own
private auton~bile, in the course of his/her City emplo~t or on City
business. Such use of a private vehicle shall only be when a City vehicle
is not available for transportation. A flat ra~e of ~ifteen oents ($.15)

per mile may be approvc~ for use of private vehicles on City business,
within the City or within a radius of sixty (60) miles theref~. An
·
exception to this provision shall be the Assistant Direc.tor of Recreation
who shall receive $50.00 per month as an e?.~.~-_.nse reirr,l.~urs~nt allc~.;ance
for his personally-c~ned and maintain.ed autcx~Dbile u~.ed in the regular
course of performance of his City duties.
B. Comn~rcial Transportation Allc~ance_. All Administrative and
ag~t Officers shall be ent~itled to the following allowances-
1. g_ll~ances for use of co~rcial ~'ansporta~.on shall
based upon scheduled airline coach rates, or other appropriate public
transpor~tion where more practical, in regard tt:> all out-of-~ travel on
City business.

The use of private vehicles by Administrative and Ma~ag~t
Officers, or appointed officials on City business on out-of-City trips,
within the State, may be approved by the City Administrator when use of
co~cial ~ranspor~tion is not available, economical or prac~i.cal. If
such persons' prefer to use their private vehicle, they my be reimbursed ........

rate per mile set forth in Subsection A above is less.
3. When air, rail or public transportation is used, expenses necessary
for local transportation, such as taxicab and bus fare, will be allo~d
whenever such transportation is necessary for the conduct of City business
after approval by the City Administrator.
C. Out-of-City .Tr..avel, Meetings and Conference E ~xpen._.~.Ses. if, in the
judgn~nt of the City Administrator, the estimated expenses of the approved
contemplated travel, lodging and other related ~ses po~~t ~ said
trip is too high and would create a hardship for the officers to finance
initially, the City Administrator may authorize an advance pa~t of the
estimated arrr)unt to the officers. Upon return of the officer fro~ said
trip, he/she shall submit an .itemized. statement as to his/her actual expen~
Final adjus~ts shall I~ made to the favor of the officer or the City,
whichever the case my be. The cos~ of lodging and reals shall be at a

reasonable rate and' appropri, ate to the purt~$e of the trip.
D. Conference Attenclance.
(1) Administrative Officers shall be authorized' to attend one
(1) national and one (1) state conference of their choice provided the
funds are budgeted and attendance 'is approved by'the City Administrator.

(2) -Manag~t Officers shalI be authorized to attend one (l)
state conference or training session of their choice at a cost not to

exceed $250.00 provided the co. nference or training session is approved
by the City. Administrator as appropriate and job-related.

~Misco!l~.e0us. E..xpenses. Telephone and telegraph charges incurred
while on out-of-City business by an officer, will be allcx~ed only for
official calls as approved by the Department Head, Finance Department, or
City Administrator.
F. Council. Member .Expenpes. In lieu of filing expense claims,
menlbers of the City Council my be paid the sum of Fifty Dollars ($50.00)
per day when on City business requiring overnight accoraodations, plus
actual traveling expenses. The City Council hereby detenmines that such
arm~unt is a reasonable allowance and less' than expenses actuallY and usually
incurred where it is required to remain overnight to perform actual duties
for the City.
Council. Member Mon. thly ExPenses.. The City Council hereby determines
that each member of the Council is required to expend in excess of One
Hundred Seventy-five Dollars ($175.00) per month for transporation, meals,
and other miscellaneous rotters directly related to the performance of his
duties. In lieu of filing individual expense claims for reimbursement fr~n
petty cash, the Mayor is authorized pa~t of a fixed sum of One Hundred
Seventy-five Dollars ($175.00) per month, and each Council msmber is authorized
payment of a fixed sum of One Hundred Twenty-five Dollars ($125.00) per'
month. Each Council member shall file with the Finance Department an
appropriate statement Jffinming said expenses and requesting such reimburs~t.
Section 12. Education Incentive PayjP. rog.ram_... Administrative Of-
ficials are excluded from participation in the education incentive program.

Section 13. Sunr~lern~ntal_ .~ Merit Pay_ Plan. 'I~e concept of a supplemntal
merit pay plan is approved, .wherein an an~unt equal to two percent (2%) of
the total salaries' of all Admini. s~a~~ Offic~s, exclusixt'~ of ~he Ci[y ....
Administrator, and of all Manag~t Officers, will be appropriated and may
be allocated among the Administrative Officers and Management Officers,
other than the City Administrator, based upon their level of performance or
achievement, with the an~unt to be paid to any individual Management or
Administrative Officer to be as determined in accordance with a specific
plan to be prcmulgated, not to exceed ten percent (10%) of his annual
salary, or such amount less than ten percent (10%), to and including zero
percent (0%), in accordance with the plan. Such supplemental n~_rit pay
shall continue for a period of one (1) year at which time the me~t pay
shall discontinue. The officer may be recertified for additional one-year
periods if so approved. The detailed plan shall be' developed by the City
Administrator and staff and sutm~tted to the City Council for its review,
consideration and approval. The supplemen.tal n~rit, pay plan shall becrm~
effective upon the further Resolution of the City Council and in the form
and for the duration so approved by such further Resolution.
Section 14. Spec. ia.1 C.0mPensation Provisions. pOlice supervisors who
are required to appear in court during their off-duty hours in connection
with City business shall receive additional ccmpensation for the number of
hours they spend in court with a minimum of two (2) hours c~nsation at
their regular hourly rate of salary. In addition, Police Supervisors shall
be cc~0ensated at the rate of two (2) hours of overtime ccntoensa~on for
each eight (8) hours of required stand-by for duty or court appearance
whether or not actually called for such duty or court appearance.
Section 15. Miscellaneous Provisions.
A. Avoidance of Inequities. The 'City A~htinis~ator my authorize
special, adjustments to avoid or eliminate inequities resulting from the
strict application of any provision of this ~lution.

B. Administr..a.t.i...Ve ..R~la.ti0~.S. The City Administrator is authorized
to issue written administrative persor~el regulations designed to augn~nt
,or clarify the provisions of this Resolution.
Sect~.'0n' 16_. Effe.c.~ive Date. None of. the provisions' of this Resolution
Shall be in force or effect or applicable to any Police Supervisor unless
and until a further Resolution is adopted which so provides.
Unless otherwise specified to the contrary in this R~solution, all
provisions shall be effective as of July 4, 1977.
