RESOLUTION NO. 77- 68
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, CERTIFYING ENVIRONMENTAL IMPACT
REPORT 77-2 (SKATE PALACE)

The City Council of the City of Tustin does hereby resolve as
1. The City Couhcil finds and determines as follows:

A.. That a draft Environmental Impact Report was prepared
on the basis of information submitted by Envicom
° Corporation, 4521 Sherman Oaks Avenue, Sherman Oaks, CA
94103, for the purpose of evaluating the impact related'
to the proposed construction of a skate palace of
26,162 square feet, and two restaurants (2,250 square
feet and 2,082 square feet) on the property bounded by
the Newport Freeway on the east, freeway ramps on the
north, Tustin Village Way on the west, and McFadden
Avenue on the south.
B. That independent analysis is included in the staff
report distributed to all agencies having jurisdiction
over subject area.
C. That a public hearing was held by the. Planning Commis-
sion on June 13, 1977, to receive public testimony
related to the impact upon the local environment of the
proposed development of the vacant parcel.
D. That EIR 77-2 adequately addresses those items of
environmental significance as related to proposed
land uses.
E.. That the Planning Commission by Resolution No. 1630
recommended that the City Council certify the Environ-
mental Impact Report.
F... That the City Council has reviewed the Environmental
Impact Report 77-2 and identifies the adverse factors
and mitigating measures as follows:
1) Aesthetics related to freeway exposure..
Mitigation: the removal of the chain link fence
and the construction of a 6' 3" landscaped block
wall to the standards of the Highway Division of
the State of California Department of Transportation.
2) Traffic circulation on McFadden Avenue and Tustin
Village Way.
Mitigation: the signal modification project for
McFadden Avenue, modification of the traffic
signal at the intersection of McFadden and Tustin
Village Way, the dedication of additional right-of-
way on Tustin Village Way and McFadden Avenue, and
the limitation of driveway openings on Tustin Village
' Way and McFadden to existing driveways.
G. That the benefit to the total community in terms of rec-
reational facilities and convenience of services justi-
fies the approval of the project with mitigating measures
as described within the draft EnvironmenLal · .... ~ Report

2. The City Council hereby certifies Environmental Impact
Report 77-2, an EIR relating to the proposed development
of a skate palace and drive-thru restaurants, to consist
of the initial draft, independent analysis, public testi-
mony, minutes of the Planning Commission meeting of June 13,.
1977, and related correspondence.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tustin, held on the 20th day of June, 1977.
