HomeMy WebLinkAboutCC RES 95-401 RESOLUTION NO. 95-40 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING 3 DESTRUCTION OF CERTAIN RECORDS 4 The City Council of the City of Tustin hereby ordains as follows: 5 WHEREAS, Government Code §12946 provides that an employer shall maintain and 6 preserve any and all applications, personnel, membership and employment referral records for a minimum of two (2) years after the records are initially created or received and shall 7 retain personnel files of applicants or terminated employees for a minimum of two (2) years after the date of the employment action taken, and that upon notice that a verified complaint 8 against it has been filed under Part 2.8 of the Govemment Code of the State of California, the employer shall maintain and preserve any and all records and files until the complaint is 9 fully and finally disposed of and all appeals or related proceedings terminated, and except for the records described hereinabove and records affecting title to real property or liens thereon, 10 court records, records required to be kept by statute, records less than two (2) years old and the minutes, ordinances, or resolutions of the City Council and other City boards-or 11 commissions, Government Code §34090 authorizes the head of a city department to destroy any city record, document, instrument, book or paper, under his or her charge, without 12 making a copy thereof, after the same is no longer required, with the approval of the City Council by resolution and the written consent of the City Attorney; 13 WHEREAS, the City Council, upon the request of the acting head of the Personnel 14 Department, desires to approve immediate destruction of certain records, to wit, test materials and applications for recruitments of the Personnel Services Department, each of 15 which is not less than two (2) years old and is not a record described hereinabove which is required to be retained any longer;, and ' 16 WHEREAS, the City Attorney of the City of Tustin has filed her written consent with 17 the Clerk of the Coundl of the City of Tustin and a copy of such consent is attached hereto; 18 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Tustin: 19 Pursuant to Section 34090 et seq. of the Government Code of the State of California, approval is hereby granted for the immediate destruction of the records described below 20 which, as of April 1, 1995, have been retained for a minimum of two (2) years: 21 1990, 1991 and 1992 test materials and applications for recruitments of the Personnel SerVices Department. 22 PASSED AND ADOPTED at a regular meeting of the City Council. for the City of 23 Tustin on this 17th day of April, 1995. 24 25 ~/~.~ Mayor 26 tI~RY E.
