HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/FIELD SERVICES SUBJECT' CONTRACT RENEWAL FOR MAINTENANCE AND REPAIR SERVICES OF THE CITY'S HVAC SYSTEMS WITH BARR ENGINEERING, INC. SUMMARY Approval of the first contract amendment with Barr Engineering, Inc., extending the agreement to June 30, 2002 for the Maintenance and Repair of Heating, Ventilating and Air Conditioning (HVAC) Systems at various City facilities and providing a price increase of 3% effective July 1, 2001. RECOMMENDATION It is recommended that the City Council approve the first amendment to the contract agreement between Barr Engineering, Inc. and the City of Tustin for HVAC maintenance and repair services, subject to City Attorney apProval. FISCAL IMPACT The proposed 3% adjustment will increase the monthly maintenance contract price by $27.69 to $950.69 per month and increase the annual maintenance contract total amount to $11,408.28, effective July 1, 2001. This increase will be incorporated into the 2001/2002 Fiscal Year Budget. DISCUSSION The City has contracted with Barr Engineering, Inc., since January 19, 1998 for maintenance and repair of the HVAC of the Civic Center, Senior Center, Youth Center, C. T. Gymnasium, Sports Park and Water Operations facilities. The original agreement was for a 33-month period with two 2-year extensions available to the City. This first contract amendment will extend the agreement for two years through June 30, 2002 and will grant the contractor a 3% increase in the monthly base price of the contract, effective July 1, 2001. Barr Engineering, Inc. requested a 5% increase in the contract amount. However, staff is recommending a 3% increase in accordance with the existing contract language that limits any contract increase to a maximum of 3%. The Consumer Price Index (CPi) for all urban consumers in the Los Angeles, Anaheim and Riverside areas has risen approximately 3.7% in the last year. The overall increase in the contract price for the routine maintenance is $27.69 per month or $332.28 over a 12-month period, plus the cost of any needed repairs. .---.% Contract Renewal for Maintenance and Repair Services of the City's HVAC Systems with Barr Engineering, Inc. March 5, 2001 Page 2 Barr Engineering, Inc. has provided consistent service of a reasonable quality for the past few years and has been very responsive to the needs of the City. This Amendment is made with reference to the following' RECITALS Ao WHEREAS, City and Contractor entered into an Agreement dated January 5, 1998, the "Agreement", wherein Contractor agreed to perform heating, ventilation, and air conditioning (HVAC) services in accordance with the Agreement and specifications entitled" Heating, Ventilating, Refrigeration, and Air Conditioning SYstems Maintenance and Repair Program- January 19, 1998 through June 30, 2000"; Bo WHEREAS, the initial term of the Agreement was for 33 months with the option to be extended for up to two 2-year extensions; Co WHEREAS, City and Contractor desire to exercise the extension clause pursuant to Section B, Page B-3, Item 13 "Length of Contract" to extend the Agreement until June 30, 2002; Do WHEREAS, City and Contractor also desire to adjust Contractor's compensation under the Agreement to reflect a 3% maximum allowable increase effective July 1, 2001, pursuant to Section B, Page B-3, Item 14 "Contract Increase". AGREEMENT The Agreement is hereby amended as follows' Ao The term of the Agreement is extended through June 30, 2002, unless sooner terminated pursuant to Section B, Page B-l, Item 3 "Termination Prior to Expiration of Term", of the Agreement. Bo City shall pay Contractor the following sums for the periods indicated' o From July 1, 2000 to June 30, 2001, the City shall pay the Contractor, on a monthly basis, an amount equal to $923.00. , From July 1,2001 to June 30, 2002, the City shall pay the Contractor, on a monthly basis, an amount equal to $950.69. Co For the purpose of Section B, Page B-3, Item 13 o'f the Agreement, the term "City" shall mean the City Manager or the City Manager's designee. D. Except as expressly amended by the First Amendment, all other terms and conditions of the Agreement and all attachments and exhibits thereto, shall remain in full force and effect.
