CALL TO ORDER ROLL CALL PUBLIC INPUT- Members of the public may address the City Council on items on the Closed Session Agenda. CLOSED SESSION -The City Council shall convene in Closed session to confer with the City Attorney about pending litigation to which the City is a party: (1) Morales v. City of Tustin, OCSC Case No. OOCCO3882 and (2) Tocher v. City of Tustin, et. al. USDC Case No. SACV96-366, to confer with the City Attorney pursuant to Government Code Section 54956.9(b)(3)(D) regarding significant exposure to litigation (threats of litigation made at City Council meeting of January 16, 2001, during public testimony on the GPA), and Section 54956.9(c) initiation of litigation (1 case). ADJOURNMENT- The next regular meeting of the City Council is scheduled for Tuesday, February 20, 2001, at 7:00 p.m., in the Council Chamber, 300 Centennial Way. CLOSED SESSION REPORT PUBLIC HEARING (ITEMS 1 THROUGH 2 ) . SUPPLEMENTAL LAW ENFORCEMENT SERVICES FUND (SLESF) In 1996, AB 3229 eStablished the Citizen's Option for Public Safety (COPS) and required a special fund be established for these funds. The initial allocation of funds was approved to fund the Gan§ Unit. Since that time, subsequent SLESF funds have continued the funding of the Gan§ Unit. In addition to the special fund, the Bill requires a public hearing. It further requires the funds be used for front-line law enforcement services including equipment, anti-gang and community crime prevention programs. Recommendation by the Police Department: . Open and close the Public Hearing. . Authorize usage of the funds. . OCK GRANT (CDBG) FUNDS The Community Development Department is proposing to amend the 1997-98 and 1999- 00 Action Plans by reallocating funds from slower moving activities to more active activities. The amendment is necessary to comply with the U.S. Department of Housing and Urban Development. Recommendation by the Community Development Department: 1. Open and close the Public Hearing. , Adopt the following Resolution No. 01-15 amending the Action Plans for Fiscal Year 1997-98 and 1999-00: RESOLUTION NO. 01-15- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AMENDMENTS TO THE CITY'S 1997-98 AND 1999-00 ACTION PLANS FOR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS AND AUTHORIZING SUBMISSION OF THE AMENDMENTS TO THE FEDERAL DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT CONSENT CALENDAR (ITEMS 3 THROUGH 15 ) All matters listed under Consent Calendar are considered routine and will be enacted by one motion. RESOLUTION NO. 01-16-.A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING REVISED PLANS AND SPECIFICATIONS AND AUTHORIZATION TO RE-ADVERTISE FOR BIDS FOR TUSTIN SPORTS PARK BALLFIELD RENOVATION Recommendation: Adopt Resolution No. 01-16 approving revised plans and specifications for renovation 'of baseball fields at Tustin Sports Park, and authorizing the City Clerk to re-advertise for bids as recommended by the Parks and Recreation Services Department. QUITCLAIM OF SANTA ANA VALLEY IRRIGATION COMPANY (SAVI) EASEMENT AT 17241 IRVINE BOULEVARD Recommendation' Authorize the Mayor to execute the Quitclaim Deed to Zorro Investment Company for the Santa Ana Valley Irrigation Company Easement located on their property at 17241 and 17291 Irvine Boulevard as recommended by the Public Works Department/Engineering Division. AUTHORIZATION TO EXPEND FUNDS- POLICE MOTORCYCLE REPLACEMENT Recommendation: Award the bid for two BMW Rl100 RT-P motorcycles to A & S Motorcycles, Roseville, California, in the amount of $19,275.00 per unit under a guaranteed, buyback program, which was originally negotiated by the California Highway Patrol (CHP) as recommended by the Police Department. APPROVAL OF PROFESSIONAL SERVICES AGREEMENT- MOVING SERVICES FOR WATER DIVISION RELOCATION Recommendation: Approve the Professional Services Agreement with Precision Relocation of Buena Park in the amount of $5,786 for moving services to relocate Water Division and authorize the Mayor and City Clerk to execute the agreement upon approval by the City Attorney as recommended by the Public Works Department/Water Division. RESOLUTION NO. 01-09 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 00-3 Recommendation' Adopt Resolution No. 01-09 approving Lot Line Adjustment 00-3 as recommended by the Public Works Department/Engineering Division. AWARD BID FOR FIVE PATROL UNITS Recommendation by the Police Department: 1) Award the bid for five 2001 Ford Crown Victoria vehicles for marked police patrol to Wondries Chevrolet of Alhambra, in the amount of $115,410 plus tax; 2) Award the bid' for conversion of four of the five police patrol units to Pursuit Technology, Inc. of Buena Park, California in the amount of $19,785 plus tax. The fifth unit will be converted using existing equ!pment;'and 3) Authorize the Police Department to acquire five Mobile Audio Video Systems from Kustom Signals, Inc., Lenexa, Kansas in the amount of $26,425 plus tax. APPROVAL OF CONSULTANT SERVICES AGREEMENT FOR ARCHITECTURAL AND DESIGN SERVICES FOR THE COLUMBUS TUSTIN BALLFIELD RENOVATION (PROJECT NO. 2048) Recommendation' Authorize the Mayor and the City Clerk to execute a Consultant Services Agreement with the firm of David Volz Design Landscape Architects, Inc., for Agenda - City Council February 20, 2001 - Page 3 the Columbus Tu~dn Ballfieid Renovation project in an amount not to exceed $33,500 as recommended by the Director of Parks and Recreation Services. 14. GOVERNOR'S EXECUTIVE ORDER REQUIRING BUSINESSES TO SUBSTANTIALLY REDUCE OUTDOOR LIGHTING DURING NON-BUSINESS HOURS Recommendation: Receive and file as recommended by the City Attorney. 15. RESOLUTION NO. 01-17- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, OPPOSING ANY EFFORTS TO ENACT LEGISLATION THAT WOULD INVOLUNTARILY RESTRUCTURE THE COMPOSITION OF THE ORANGE COUNTY FIRE AUTHORITY (OCFA) REPRESENTATIVE GOVERNING BOARD Recommendation' Adopt Resolution No. 01-17. opposing AB911 (Maddox) as recommended by the City Manager. Adopt the following Ordinance No. 1233 (roll call vote): ORDINANCE NO. 1233 -AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE PERTAINING TO THE APPOINTMENTS AND. TERMS OF COMMISSIONERS APPOINTED TO THE PLANNING COMMISSION AND THE PARKS AND RECREATION COMMISSION 17. INTRODUCTION OF AN ORDINANCE AMENDI.NG THE TERMS OF OFFICE OF THE MEMBERS OF THE AUDIT COMMITTEE At the February 5, 2001 City Council meeting, the City Council requested the City Attorney prepare an ordinance that would amend the terms of office of the members of the Audit Committee and of the Cultural Resources Advisory Committee in a manner similar to the ordinance amending terms of Planning Commissioners and Parks and Recreation Commissioners. Recommendation by the City Attorney: Introduce and have first reading by title only of the following Ordinance No. 1234 amending terms of office of the members of the Audit Committee: ORDINANCE NO. 1234- AN ORDINANCE OF THE CITY COUNCIL OF THE Agenda - City Council February 20, 2001 - Page 4 CITY OF TUSTIN, CALIFORNIA, AMENDING TERMS OF OFFICE OF MEMBERS OF THE AUDIT COMMITTEE 18. STATUS REPORT: RAILWAY CROSSING TRAIN HORN REQUIREMENTS AT RED HILL AVENUE Current Califomia State Law requires all trains to sound hems as they approach highway-rail grade crossings and does not currently provide for the establishment of "quiet zones" within the state. However, the Federal Railway Administration (FRA) is currently awaiting a final decision to implement a rule that would require the sounding of train horns at all' highway-rail grade crossings nationwide, and also would include provisions that would allow communities to establish "quiet zones."
