ARCHITECTURAL AND DESIGN SERVICES FOR THE COLUMBUS TUSTIN
BALLFIELD RENOVATION (PROJECT NO. 2048)
SUMMARY'
Approval of a Consultant Services Agreement between the City of Tustin and David
Voiz Design Landscape Architects, Inc., to provide the City with architectural services
for the preparation of plans and specifications for improvements to the Columbus Tustin
Ball Field sports facility.
RECOMMENDATION'
Authorize the Mayor and the City Clerk to execute a Consultant Services Agreement
with the firm of David Volz Design Landscape Architects, Inc., for the Columbus Tustin
Ball Field Renovation project in an amount not to exceed $33,500.
FISCAL IMPACT:
The 2000-01FY Capital Improvement Program includes the development of plans and
specifications and implementation of renovating the Columbus Tustin sports fields. The
total appropriation for the project is $400,000. The Consultant' Services Agreement of
$33,500 is less than the $45,000 that has been allocated from the Park Development
Fund for the master plan and preparation of plans and specifications in preparation for
bidding. The budget includes architectural services, development of construction
drawings and an appropriation to improve grading, drainage, lighting, fencing and the
possibility of restroom renovation.
BACKGROUND:
The Tustin City Council adopted the Parks Seven-Year Capital Improvement Plan for
2000-01, which included the Columbus Tustin Ball Field Renovation project. Four firms
responded to the City's Request for Proposal for Architectural Landscape Plans and
Specifications Services. Staff and a community design committee, made up of
members of the Parks and Recreation Commission, evaluated proposals and selected
David Volz Design Landscape Architects, Inc., of Fountain Valley, California, based
upon their strong background in recreation and park planning and extensive local
experience in working with municipal agencies. The proposal also listed the lowest fees
among the firms submitted. The negotiated fee for the agreement is fair and reasonable
for the scope of the project.
Once the approval of the agreement is executed, the recommended scope of work and

conceptual plan are scheduled to return to the Council, in consultation with the School
District, within 120 days.

CONSULTANT SERVICES AGREEMENT
THIS AGREEMENT FOR CONSULTANT SERVICES, is made and entered into

RECITALS
WHEREAS, City requires the services of a consultant to furnish the necessary

referred to as "Project"; and
WHEREAS, Consultant has submitted to City a proposal dated December' 20, 2000
a copy of which is attached hereto, marked.as Exhibit "A" and is by this reference
incorporated into this Agreement; and
WHEREAS, Consultant is qualified to provide the necessary services for the
Project and desires to provide said services; and
WHEREAS, City desires to retain the services of Consultant for said Project.
NOW, THEREFORE, for the consideration and upon the terms and conditions
hereinafter set forth, the parties agree as follows:

AGREEMENT
Section 1' Scope of Consultant's Services.
Consultant shall perform all work necessary.to complete in a manner satisfactory
to City, the services set forth in Exhibit "A".
Section 2. Order of Precedence.
in the event of a conflict between or among any of the documents comprising this
Agreement, the following order to precedence shall govern the provision in question'.

Section 3' Time for Completion.
The time for completion of the work to be performed by Consultant is an essential
condition of this Agreement. Consultant shall prosecute regularly and diligently the
work of this Agreement according to reasonable schedules established by the City for
various items described and as outlined within Consultant's proposal. Consultant shall
not be accountable for delays in the progress of its work caused by any condition

beyond its control and without the fault or negligence of Consultant. Delays shall not
entitle Consultant to any additional compensation regardless of the party responsible for
the delay.
Section 4' Compensation.
A.
The compensation to be paid under this Agreement shall be as set forth in
Exhibit "A", not to exceed a total cost of $ 33,500.00 .
B.
Consultant shall submit detailed invoices, based upon the actual work performed
accompanied by backup documentation as requested by the City.
C.
Progress payments for work completed shall be paid by City as the work
progresses, within thirty (30) days of the date of Consultant's invoice.
D.
Consultant shall provide City with a monthly itemization of all work performed,
and the fees accrued thereon, in complete and sufficient detail to fully apprise
City thereof.
Section 5' Independent Contractor.
Consultant's relationship to City in the performance of this Agreement is that of
an independent contractor. Consultant's personnel performing services under this
Agreement shall at all times be under Consultant's exclusive direction and control and
shall be employees of Consultant 'and not employees of City. Consultant shall pay all
wages, salaries and other amounts due its employees in connection with this
Agreement and shall be responsible for all reports and obligations respecting them,
such as social security, income tax withholding, unemployment compensation, workers'

compensation and similar matters.
Section 6' Indemnification.
A.
Consultant agrees to indemnify, defend and hold City, its officers, agents,
employees, successors and assigns harmless from any loss, damage, injury, sickness,
death, or other claim made by any person and from ali costs, expenses and charges
including attorney's fees caused by or arising out of Consultant's, its officers', agents',
subcontractors', or employees' negligent acts, negligent errors, or negligent omissions
or willful misconduct, or conduct for which the law imposes strict liability on Consultant
in the performance or failure to perform this Agreement. .
Section 7' Insurance.
Consultant shall maintain i~ full force and effect during the term of this
Agreement policies of-com~rchcn~¢c general liability, personal injury and
automobile liability insurance with limits of at least $1,000,000 combined single
limit coverage per occurrence.

Consultant shall maintain in full force and effect during the term of this
Agreement a policy of professional liability insurance coverage with limits of at
least $1,000,000 combined single limit coverage per claim or per occurrence. If
Consultant provides claims made professional liability insurance, Consultant shall
also agree in writing either (1) to purchase tail insurance in the amount required
by this Agreement or to cover claims made within five (5) years of the completion
of Consultant's service under this Agreement, or (2) to maintain professional
liability insurance coverage with the same carrier in the amount required by this
Agreement for at least five (5) years after completion of Consultant's services
under this Agreement. Consultant shall also provide evidence to the City of the
purchase of the required tail insurance or continuation of the professional liability
policy by executing the attached Letter Agreement on Consultant's letterhead.

Consultant shall carry and pay for such compensation insurance as is necessary
to fully protect Consultant and its employees under California Worker's
Compensation Insurance and Safety Laws, and shall relieve the City from all
responsibility under said laws in connection with the performance of this
Agreement.

Ali insurance required pursuant to this Section shall be issued by a company
admitted in the State of California and rated A, VII or better by the latest edition
of Best's Key Rating Guide.

Upon execution of this Agreement, Consultant shall provide to City certificates of
insurance on the City's form evidencing the required insurance, if self-insured for
worker's compensation, Consultant shall submit to City a copy of its certification
of self-insurance issued by the Department of Industrial Relations.
Section 8' Termination of Aqreement.

City shall have the right to terminate any or all of the services covered by this
Agreement at any time for any reason by giving written notice to Consultant.

Upon termination of this Agreement, ConSultant shall be paid for services
rendered by the effective date of the termination.
C,
Upon termination of this Agreement or completion of the Project, all documents
relating to the Project shall become the sole property of City. Should City
terminate this Agreement pursuant to subparagraph A. of this Section,
Consultant shall, within ten (10) business days of receipt of notice of termination,
provide City with all documents within Consultant's possession relating to this
Agreement and the Project, including but not limited to ali completed documents
and ali drafts of uncompleted documents.
Section 9' Notices
Any notice allowed or required to be given shall be effective upon personal
delivery thereof, or upon depositing thereof in the United States Postal Service, certified
mail, return receipt requested, postage prepaid, addressed as follows'

training, including apprenticeship.

REQUEST FOR QUALIFICATIONS
COLUMBUS TUSTIN SPORTS FIELD RENOVATION
DUE DECEMBER 20, 2000, 4:00 PM
The City of Tustin Department of Parks and Recreation is requesting statements of
qualification and a cost estimate from design firms for preparation of Plans and
Specifications for the Renovation of the Columbus Tustin Ball Fields Phase I.
A selection committee will evaluate finns responding to this request for qualifications on
the basis of the qualification statement submitted. Experience of key personnel,
relevance of the team's projects and products, favorable responses from references
regarding the firm's performance will be taken under consideration as well as creativity
in problem solving and soundness in planning processes and methods. Previous
experience in park and sports fields renovations for a park facility of similar size and
scope is mandatory. Respondents are encouraged to suggest approaches to minimize the
cost of the construction and renovation of the facilities.
The consultant team shall consist of a registered landscape architect, licensed architect
and registered civil engineer. Those teams ranked highest will be invited to take part in
an interview process. Please note that this proposal request is not a cost c°mpetitive bid
request, but a cost estimate, inCluding task and man-hours of services. The cost
effectiveness will be considered in future contract negotiations with the consultant
selected as most qualified. The city reserves the right to contract with any qualified firm
if a fair and reasonable price cannot be negotiated with the selected consultant.
BACKGROUND
Columbus Tustin park is located at the northeast comer of Irvine Boulevard and Prospect
Avenue, adjacent to Columbus Tustin Middle School. The site extends north along
Prospect Avenue to the Orange County Flood Control Channel and is intersected by
Beneta Way, which serves as the access to the middle school and a residential
subdivision north of the channel. It is estimated that the total site involves approximately
14 acres of recreation space.
The park and sports field area involves properties owned by the Tustin Un/fled School
District, the Orange County Flood Control Channel and the City of Tustin. The ball
fields and a portion of the tennis courts are located on Tustin Unified School District
property and are operated under a 1976 Joint Use Agreement between the City and the
Tustin Unified School District.

SCOPE OF WORK
The consultant will prepare design plans and biddable specifications for the project that
will include making improvements to the existing amenities and structures on the sports
fields. A Design Development Report should be included to identify a sample
construction schedules, factors identifying user needs, key elements of the process
concerning development standards and guidelines, projected maintenance and operational
cost, and construction cost estimates.
Primary amenities to be considered are the upgrading of the lighting, additional new
lighting, renovation of existing backstops and fence fabrics, review of infield drainage,
renovation of dugouts and hardscape areas, and improvements to storage facilities. The
consultant is also to meet with City staff on an as-needed, on-going basis.
ADD..ITION .AL INFORMAT.ION
A sample "Certificate of Insurance" required by the City is attached. Should your firm be
awarded a contract, use of this form will be necessary for $1,000,000 coverage for
general liability. The Consultant is also advised that if selected, a policy for "errors and
omissions" coverage in the mount of $500,000 will be required. All insurance must be
provided by admitted insurers in the State of California rated A VII or better.

The City reserves the fight to accept or reject any or all statements received as the result

negotiate with any qualified source. Preparation of the Master Plan documents does
not automatically commit the consultant or the City to each other for additional
phases of the work.

including examples of completed projects. Qualifications and expertise of any
sub-consultants must also be included. Firm's record meeting deadlines,
creativity in problem solving, and soundness in planning processes and methods
should be addressed.

In addition, in the event the City wishes to proceed with services of consultant,
consultant shall also provide a schedule of an estimated time frame for completion
of construction drawings.

A:PPROACH
The key elements in the successful refurbishment of this park are the
identification of the existing facilities which are in need of repair or
redesign, and determination of the most cost effective means in which
to accomplish the repairs and redesign. The design report, our first
phase of work, will focus on developing a comprehensive program for
the needed and desired improvements. Our experienced park design
team will critically examine the previously identified items of work
and the existing site conditions. We will then meet with the city's
staff to discuss our findings and preliminary recommendations.
Finalizing the refurbishment program will be accomplished through a
formal review process. DVD will issue a preliminary draft of the de-
sign report and refurbishment program. We will then work with City
staff and stakeholders identified by the City to refine the report's ele-
ments and recommendations. The outcome of this process will be a
thorough design report that pinpoints the desired improvements.
A design report will then be delivered to the City. This report will
include listings of the improvements, a synopsis of the design process
to date, and budget estimates for the various improvement items.
There will also' be a recommended priority list to aid in finalizing the
improvements which will be designed for this Phase I renovation.
Upon meeting with the City staff and any other input body DVD will
finalize the design report and prepare construction documents for the
Phase I work. The second element of our work will involve the de-
sign of these elements which are to be part of the improvement pro-
ject. This work will start upon the City's acceptance of' the report.
Construction drawings will be prepared for the selected program. De-
sign development, demolition, grading, and layout plans will be pre-
pared by our in-house staff. Civil and electrical engineering plans
will be prepared by our very qualified subconsultants. Any building
design package will be prepared by our structural engineer. He will
prepare and sign the structural calculations and the structural plans.
Should survey work or geotechnical soils testing be required these
items will be accomplished before the start of the construction docu-
ments. All plans will be prepared in AutoCADD format. Technical
specfications will be based upon the CSI standard format and will be
specifically modified for the construction items included in this pro-
ject. A progress set of plans and specifications will be submitted for
the City's review. Upon obtaining the City's feedback final plans
will be prepared and ready for bid. A final budget estimate will be
prepared based upon these final drawings.

Our design approach, from design development through construction

document development, includes strong quality control techniques as
well as several quality control measures. To name one quality control
technique, our firm employs is to appoint a senior staff landscape ar-
chitect assigned to specifically provide quality control oversight.
This experienced landscape architect will be involved in regular in-
house design reviews of project drawings, specifications, and budget
estimate. He will provide input and advice to the project administra-
tor. This effort and all of our quality control measures will focus on
providing the City with a design which is accurate and constmctible.

The key members of our design team include:
David I/olz, LA, project manager, has over 19 years of experi-
ence in the landscape architecture design of successful public works
and private sector projects. He is the principal-in-charge of all land-
scape projects at DVD. He has managed the master planning of
hundreds of parks and recreational facilities. He has experience in
the development process from inception through master plan devel-
opment, construction document preparation, contract administration,
and on-site inspection. A strong asset to Mr. Volz' management
style is his approach to community outreach. He has a proven
method of bringing the community into the design process where a
sense of ownership and importance is felt by all. His past experi-
ence includes, numerous school/park developments in more than 20
cities. This work inclUdes award-winning projects in Long Beach,
Monrovia, Irvine, Yorba Linda, Rancho Mirage, and other cities
statewide.
Elaine Dove, project coordinator, provides project coordina-
tion, client relations, and community facilitation for various DVD
projects. Currently, she is providing design input on several major

Gary I?asquez, LA, project landscape architect, has more
than 15 years of experience in landscape architecture. For the pro-
posed park project he will work under the direction of David Volz,
providing creative design solutions to the challenges that arise.
His innovative and thoughtful designs will prove to be a great as-

Gene Yamasaki, LA, quality control review leader, brings
to our team more than 30 years of on-staff public works design ex-
perience. Until recently, Mr. Yamasaki was the staff landscape
architect for the City of Long Beach Public Works Department.
His broad range of project experience and city staff background
enables him to contribute to imPortant and sensitive projects with
creativity and foresight. He oversees the technical aspects of each
project, and ensures that project deliverables meet DVD's high
quality standards as well as the city's expectations.
David Stuetzel, PE, civil engineer will be responsible for all
civil engineering, utilities, and grading. Mr. Smetzel has worked
with the DVD team on many park projects providing similar ser-
vices. He has 15 years of experience working on public agency
projects.
Subconsultants
Joe Nolan of Dream Engineering will be responsible for all
electrical design. Mr. Nolan has partcipated on a majority of DVD
projects. He has provided electrical design for many park and

Mr. Volz is a registered landscape architect and has nearly 20 years
of' extensive experience in public works and private sector projects.
He has managed over $200 million of public works design projects
with much of this experience involving the coordination of multi-
disciplined consulting teams.
Park Design Experience
His major commissions have included program management for
more than 20 community parks, landscape design services for a
5,000-seat semi-pro baseball stadium in Long Beach, and master
planning services for regional parks in Los Angeles and Ventura
counties. Additionally, he has managed the design and development
of more than 100 athletic field venues, from Little League fields to
college stadiums.
Mr. Volz has served as the landscape architect on a master consult- ·
ant a~eement with the City of Anaheim Park and Recreation De-
partment providing on-call services, as well as full park design de-
velopment for six years. Projects have included park improvements,
park expansion, building renovations, median island design, and ir-
rigation improvements.

Ms. Dove brings to our firm a tmique blend of experience in land-
scape architecture both in the private sectors, law, and public ser-
vice. As project coordinator, she is responsible for project coordina-
tion, city relations, and public facilitation.
Since she joined David Volz Design, Ms. Dove has been directly
involved with project management and city planning services of-
fered by this firm. She has been responsible for analyzing and draft-
ing. design development reports, master plan reports, impact fee re-
ports, and inventory matrixes. One of her recent assignments was
the Vasquez Rocks project for the County of Los Angeles. This
project culminated in the master plan for open space preservation
and an interpretive center on 600 acres of land. The natural area
was rich in cultural, historical, and archeological resources and re-
quired extensive research and communication with various special
interests groups. Other projects include Long Beach Mariner's Bay,
a native plan garden on the coast, various City of Tracy park pro-
jects and impact fee studies, update of the Parks and Recreation Ele-
ment of the City of Moreno Valley's General Plan, as well as con-
struction observation services on the sports park in Laguna Hills and
general planning services.
Before becoming involved in landscape architecture, Ms. Dove's 20-
year career as a paralegal gave her the opportunity to research and
draft legal memoranda on court cases, including those involving
public law issues, brought before the California Court of Appeal.
Ms. Dove is currently serving her fifth year on the Parks and Rec-
reation Commission for the City of Tustin. She has had the oppor-
tunity to work on capital improvement programs, general plans, fa-
cilities programming, park design and master planning, group work-
shops, and many other city processes. Ms. Dove was an integral
part of the team that won CPRS design awards for Cedar Grove
Park and Tustin Family and Youth Center, as well as the recently
opened Heritage Park.
Her private sector work has taken her to many high-end residential
homes where she worked under the direct supervision of a licensed
landscape architect drafting base plans, planting plans, performing
preliminary design work and providing site analysis.

Mr..Vasquez has more than 15 years of experience in landscape ar-
chitecture working on projects for public agencies ranging from rec-
reational design to master plan studies. His design abilities has
proven to be not only innovative and unique, but award-winning.
He recently completed the design for the Laguna Hills Community
Center which included many amenities not found in the surrounding
area such as a verdant grove of ginko trees and a fossil themed play
area. Other active areas include soccer fields, little league and soft-
ball fields, skateboard park, in-line roller hockey rink, band shelter,
and large picnic area.
He assisted on the design of Martin Luther King Jr. Park in Ocean-
side. This park is currently under construction. When constructed it
will include softball fields, soccer fields, tennis courts, basketball
courts, roller hockey, play area, picnic pavilion, parking lot and rest-
room facilities.

Before joining DVD, Mr. Yamasaki spent 31 years working as the
landscape architect for the City of Long Beach where he prepared
plans, specifications, and estimates for capital improvement and
non-capital improvements projects. Projects were diverse and in-
cluded, but not limited to, landscape and urban design; irrigation
systems; street and median island beautification; airport beautifica-
tion; master planning; recreation and sports facilities; hardscapes;
lake stabilization; annual tree trimming; bike paths; slope stabiliza-
tion; erosion control and miscellaneous projects requested by other
city departments.
Also, Mr. Yamasaki was employed as a landscape architect with the
U.S. Army Corps of Engineers where he performed work relative to
the development of recreational areas in connection with civil works
projects including dam and reservoir sites and other flood control
channels in the San Francisco Engineer District. This required in-
vestigation, planning and analytical work for the development of
project plans of recreational facilities. He provided field surveys
and inventories of large land areas to determine extent and type of
land use.. He prepared estimated land use projections.
Mr. Yamasaki was also employed with the U.S. Forest Service for
several years as their landscape architect. He investigated, analyzed
and planned for development of public land use such as camp and
picnic grounds, boating and swimming sites, organization sites and
observation areas.

EXPERIENCE
New Little League Fields, CiO, of Costa Mesa
The DVD team was awarded"
the commission of designing
new little league baseball
fields on the campus of
Costa Mesa High School.
The project was a joint
venture between the City of
Costa Mesa and the Newport
Mesa Unified School
District. The site is part of
the long-term joint use of
city and district facilities,
allowing the City of Costa
Mesa to improve selected
school sites for athletic
purposes.
The challenge was to design new fields including two little league
ballfields and concession stands within the small unused comer of
the school grounds. Adjacent to the site are tennis courts, soccer
fields, ballfields, and the high school agriculture department. The
new fields were built by a combined city contract and volunteer
effort. The project, finished in less than four months, was a great
Success.

Blair Field is one of the premiere
college/semi-pro baseball stadiums in
California. In fact, Baseball America
ranked this City of Long Beach facility
number 14 on it's "Best Fields to Play
College Baseball" national listing. The
facility has won several prestigious
design and maintenance management
awards and accolades from local and
national professional organizations.
It's just one outstanding place to play
Field playability, including injury prevention, footing and ball
bounce characteristics, as well as maintenance and repair were all
considered in the field's 1992 reconstruction. Also considered,
was a tough on turf play schedule, which could include three or
more games on the field nearly everyday year round. The David

Volz Design team, which included several knowledgeable
individuals and frans, recommended a sm~d base growing medium
to meet the demands placed on this field.
The new field required a high initial investment in order to receive
the anticipated benefits. Removal of fl~e existing clay based soil,
importing of a mountain of select sand growing medium,
subterranean drainage, reclaimed water irrigation system, and select
turf grass and infield materials were all necessary. In short, we
buried most of our development monies.
The new field has many advantages to a "native" soil field. The
field meets all of the heavy use program criteria. It offers the
grounds keepers a wide range of management options to keep the
field in excellent playing condition, and when repairs are necessary
they require a minimum of recovery and down time.
The Blair Field Redevelopment project has many interesting aspects
and the DVD team would be happy to tell you the full story of
reconstructing this outstanding facility.

Burner School Park, CiO' of Long Beach
This urban park was designed to create a focal point for the
redevelopment of the Atlantic Avenue restoration effort. The plans
included vacating a street right-of-way, incorporating shared uses
with the adjacent school, and overall improvement of the
neighborhood's environment. The city library was visually
connected through careful planning of street and sidewalk
improvements, structures, and plant materials. This design is now
used as a prototype design for Long Beach. It brings schools, parks,
and libraries together as neighborhood focus areas.

A much needed new park for this growing city has been be ready
for play since spring of 1999.. After many public workshops,
meetings with the parks commission, and working sessions with

with numerous activities and amenities. The
new 22-acre park includes four acres of
upgraded and lighted school grounds. These
facilities match the high level of development
and playability designed for the park proper.
The DVD team worked closely with the city
and the school district personnel to provide
tree joint-use of the new and upgraded park
and play areas. In addition to these active
areas there are acres of beautifully
landscaped open rolling terrain and colorful areas to soften the
intensely developed areas and to provide a park-like setting for this
large multi-use facility.

David Volz Design proposes a two phase scope of work for this pro-
ject. The design report development could require input from a num-

duration of about four months. DVD would be happy to discuss a

When a new school/park project
was contemplated for the east end
of town, the project team led by
David Volz was commissioned
by the city and school district to
develop the play fields and design
the landscape improvements for
the school area.
The improvements included full
development of this 18-acre site,
including six acres of slopes, two
regulation little league fields, and one major field. A soccer field
was overlaid in the outfields and a sophisticated lighting system
was developed for night use of the complex. Construction cost
for phase one totaled $680,000, (approximately 10 percent less
than our pre-bid estimate). Phase two, which includes the school
and additional field areas, is currently under construction.

Aggregate Limit applies separately to each of

rented to you.

Coverage:

if the insured has rights to recover all
or part of any payment we have made
under this policy, those' rights are
transferred to us. This insurance shall
not be invalidated should the Named
Insured waive in writing, prior to a loss,
any or all r!ghts of recovery against any
party for a toss occurring. Howev~, the
insured must do nothing after a loss to
impair these rights. At our requ~t, the
insured will bring "suit" or transfer
those rights to us and help us enforce
them. This condition d~s not apply to
Medical Expenses Coverage.
b. After a loss you may waive your rights
against another pa rty in writing,.only if,
at the time of the loss, that party is one
of lhe following:
A business firm:
1) Owned or controlled by you;or
2) That owns or controls you.
