HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION STATUS REPORT: TRAIN HORN REQUIREMENTS AT RED HILL AVENUE RAILWAY CROSSING SUMMARY Current California State Law requires all trains to sound horns as they approach highway-rail grade crossings and does not currently provide for the establishment of "quiet zones" within the state. However, the Federal Railway Administration (FRA) is currently awaiting a final decision to implement a rule that would require the sounding of train horns at all highway-rail grade crossings nationwide, and also would include provisions that would allow communities to establish "quiet zones". RECOMMENDATION it is recommended that the Council direct staff to monitor the process of the proposed rule and report the final adoption to the Council. FISCAL IMPACT There is no fiscal impact to the City at this time. BACKGROUND The City has received a petition from City residents and a letter from the Tustin Meadows Community Association requesting the City to address train horn noise and consider the establishment of a "quiet zone" through the Red Hill Avenue railway crossing. A copy of the letter is attached for your information. A copy of the petition is available in the City Clerk's office. DISCUSSION The sounding of train horns in advance of highway-rail grade crossings has been used as a universal safety precaution by railroads since the late 1800s. Since that time, in some locations across the United States, "whistle bans" have been created to provide quiet zones through communities. These have been established by local ordinance or through agreements with particular railroads pursuant to state laws. According to the FRA numerous studies have been prepared that indicate that the silencing of train horns greatly increases the safety hazards to vehicles at highway-rail grade crossings. In November 1994, the United States Congress passed the Swift Rail Development Act that requires train horns be sounded upon approaching every public grade crossing, except where there is no significant risk to persons, the use of horns as a warning device is not practical, and supplemental safety measures fully compensate for the absence of the audible warning provided by a horn. Current provisions of the California Public Utilities Code require the sounding of train horns at all grade crossings and do not provide for the establishment of quite zones. According to the Public Status Report' Train Horn Requirements at Red Hill Avenue Railway Crossing February 20, 2001 Page 2 Utilities Commission there are no existing quiet zones or whistle bans at public grade crossings in California. In 2000, the FRA issued the Notice of Proposed Rulemaking, that would require the sounding of train horns at virtually all public grade crossings in the United States. The proposed rule also contains provisions that set a maximum sound level for train horns, limit sound directed to the side, prescribe when and how to sound the horn, and provide an opportunity to any community in the nation to.establish a quite zone. These provisions would apply to the use of train horns at all highway-rail grade crossings, including those currently subject to whistle bans established by local or state authorities. When approved, this federal rule would preempt state laws nationwide. A copy of the proposed rule is available for review in the City Clerk's office. Current train horn noise level is required to be 96 decibels (db) minimum at grade crossings and train engineers are allowed to use their discretion on how long a horn is sounded. The federal rule proposes maximum noise levels at either 104db or 111db. The proposed rule also proposes a limit on the length of time a horn is sounded. Under the proposed rule, quiet zones can be established by 'installing or adopting a set of approved supplementary safety measures or a combination of supplementary safety measures and alternative safety measures at every crossing in the quiet zone to fully compensate for the absence of an audible warning provided by the train horn. Some of these measures could include four quadrant gates, medians or channelization devices at gated crossings, temporary road closures (e.g. night-time closures) and the use of photo-enforcement technology. Due to feder'al government administration changes all proposed rules including this one cannot be finalled until July 1, 2001. The rule includes a one-year implementation period after the rule is approved, which means the earliest a quiet zone could be considered would be in July 2002. A · quiet zone through the Red Hill Avenue crossing would require a joint application with the City and the Southern California Regional Rail Authority to the California Public Utilities Commission, and would require the approval of Caltrans and the Orange County Transportation Authority (OCTA). According to OCTA there are 59 trains per day (53-passenger, 6-freight) that travel through the Red Hill Avenue grade crossing at this time. The five-year projection indicates an increase to 79 trains per day (63-passenger, 16-freight). The City's Seven Year Capital Improvement Project Program indicates a future grade separated overcrossing of Red Hill Avenue at the railway crossing to begin construction in FY 2006/2007. The overcrossing is anticipated to cost $25 million and currently has $400,000.00 available for preliminary engineering and environmental work. Future funding for this project is uncertain at this time. The City has taken a very preliminary look into lowering the railroad tracks under Red Hill Avenue and has received information from the City of Placentia. Piacentia is pursuing the lowering of tracks through their city to below roadway grades and indicated that the cost to lower a double set of track is approximately $60 million per mile. Their estimate does not include any cost for additional right-of-way that may be needed. Status Report: Train Horn Requirements at Red Hill Avenue Railway Crossing February 20, 2001 Page 3 The City of Solana Beach has lowered approximately 1.5 miles of railroad track at a cost of $13 million per mile. Staff has also reviewed the existing on-site perimeter walls along the Peppertree and Tustin Meadows Communities adjacent to the railroad tracks for possible modification to provide noise abatement. The City's Building Division indicates that the footings for these walls may need to be modified to support additional wall height. Costs to modify and raise the perimeter walls would be the responsibility of the property owners and would require a building permit. CONCLUSION Engineering staff will continue to monitor the federal process for finalization of the proposed rule for the use of train horns. Once the rule is approved and criteria for the quiet zones has been finalized, staff will initiate correspondence with the California Public Utilities Commission and investigate the possibility of establishing a quiet zone through the Red Hill Avenue crossing. /~&Tim D. Train noise has been a problem withing Tustin Meadows for many years, but in recent years, with the addition of numerous trains to the already busy schedule, it has become a very sedous problem that adversely affects the quality of life for many of our residents. As a result of the more frequent scheduling of trains, and the train horn noise caused by the nearby road crossing at Red Hill Avenue, Tustin Meadows residents are being subjected or orders of magnitude more noise than ever before. Further, considering pending Federal and other legislation/regulation, it seems that the already serious noise problem will only get worse, not better. This office has received numerous complaints regarding train noise over the past several years, and train noise has also been the subject of discussion at several TMCA Board of Directors meetings, as well as at Community Noise Meetings/Seminars held by the Association. We ask that you give the Train Noise Petition favorable consideration, and straight- forwardly address the very serious noise problem it relates to by establishing a 'quiet zone' and installing an upgraded gate system at the Red Hill crossing so that train horn noise can be. eliminated.
