CONDITIONAL USE PERMIT 07-019 a request to continue operation of a temporary trailer for full banking activities while the permanent building undergoes structural rehabilitation. APPLICANT: PROPERTY OWNER: RECOMMENDATION BARBARA TORLEY BANK OF THE WEST DONAHUE SCHRIBER RETAIL GROUP That the Zoning Administrator adopt Zoning Administrator Action No. 07-009 approving Conditional Use Permit 07-019. Presentation: Reina Kapadia Assistant Planner The Public Hearing opened at 10:41 a.m. The Zoning Administrator indicated that no presentation was necessary and asked the applicant's representative if he had read the report and the Zoning Administrator Action. Bill Mason, the applicant's architect, indicated he had read the report and only had questions regarding the deposit referred to in Condition 2.4, the $50 recording fee to the County Recorder, and the indemnification in Condition 3.5. Mr. Mason indicated he would need to check with Bank of the West regarding those issues. The Zoning Administrator responded that the indemnification is a standard condition. Zoning Administrator Agenda December 3, 2007 Page 2 Mr. Mason indicated the six-month timeframe should allow enough time for the rehabilitation of the structure but that it was good to know an extension would be allowed if necessary. The Public Hearing closed at 10:45 a.m. The Zoning Administrator approved Zoning Administrator Action No. 07-009 approving Conditional Use Permit 07-019. The Zoning Administrator indicated that this action is final unless an appeal is received by close of business Monday, December 10, 2007. The Zoning Administrator also stated that if there are issues regarding the surety bond, it may be possible for staff to work with the applicant on a suitable alternative.
