SUBJECT: RESOLUTION NO. 08-01 CERTIFYING THAT THE CITY OF TUSTIN HAS THE
RESOURCES TO FUND THE PROJECTS SUBMITTED FOR INCLUSION IN
THE FY 2008/09 - 2013/14 REGIONAL TRANSPORTATION IMPROVEMENT
PROGRAM AND AFFIRMING ITS COMMITMENT TO IMPLEMENT ALL OF
THE PROJECTS SUBMITTED IN THE PROGRAM
SUMMARY
The Orange County Transportation Authority (OCTA) requires that all local agencies submit an
approved resolution certifying that the agency has fully funded project phases listed in the 2008
Regional Transportation Improvement Program (RTIP). The 2008 RTIP will cover federal fiscal year
2008/09 through 2013/14.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 08-01 certifying that the City of Tustin
has the resources to fund the projects submitted for inclusion in the FY 2008/09 - 2013/14 Regional
Transportation Improvement Program and affirming its commitment to implement all of the projects
submitted in the program.
FISCAL IMPACT
Adoption of Resolution No. 08-01 will require the City of Tustin to fully fund certain phases of the
projects listed in the 2008 RTIP.
BACKGROUND
The Orange County Transportation Authority (OCTA) is in the process of developing the Regional
Transportation Improvement Program (RTIP). The RTIP is a comprehensive programming
document that contains detailed project listings for all state and federally funded local roads, transit,
and regionally significant projects within the Southern California Association of Governments
(SCAG) region. Development and adoption of the RTIP is required in order to receive state and
federal funding and must be updated every two years. The current RTIP was updated in 2006.
In the 2006 RTIP, the City of Tustin had two projects listed:
• Tustin Ranch Road (Walnut Avenue to Edinger Avenue) -New 6 lane major arterial with
new grade separation at Edinger Avenue.
• Red Hill Avenue at Edinger Avenue/Railroad Tracks, Grade Separation.

For the 2008 RTIP, both of these projects will be included along with a third proposed project. This
project is:
• Newport Avenue Extension -Phase II (from n/o Edinger Avenue to Myrtle Avenue) Grade
Separation at OCTA/SCRRA Railway.
As required by the Federal Highway Administration (FHWA), the RTIP must be a financially
constrained document, which means that programming cannot exceed actual funds available or
reasonably anticipated to be available. To help ensure compliance with this regulation, all local
agencies must submit an approved resolution certifying that the agency has fully funded the project
or project phases and is committed to delivering the projects.
The three City of Tustin projects are or will be fully funded for the phases as follows:
1. Tustin Ranch Road -Engineering, right-of-way, and construction by the Tustin Legacy Master
Developer, and The Irvine Company.
2. Red Hill Avenue Grade Separation -Preliminary Engineering phase by Measure "M" Turnback,
Measure "M" Growth Management Area, Measure "M" Intersection Improvement Program, and
Federal Regional Surface Transportation funds.
3. Newport Avenue Extension -Phase II -Engineering phase by Measure "M" Turnback,
Redevelopment Agency -South Central funds, and Community Development Block Grant funds.
It is recommended that the City Council adopt Resolution No. 08-01 to conform to the RTIP
requirements.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN CALIFORNIA
CERTIFYING THAT THE CITY OF TUSTIN HAS THE RESOURCES TO FUND THE
PROJECTS SUBMITTED FOR INCLUSION IN THE FY 2008/09 - 2013/14 REGIONAL
TRANSPORTATION IMPROVEMENT PROGRAM AND AFFIRMING ITS
COMMITMENT TO IMPLEMENT ALL OF THE PROJECTS SUBMITTED IN THE
PROGRAM
WHEREAS, the City of Tustin desires to include the submitted projects in the Orange County
Transportation Authority's (OCTA) Regional Transportation Improvement Program (RTIP); and
WHEREAS, the City of Tustin warrants that full funding is committed and available for projects
submitted for programming in the first four years (FY 2008/09 through FY 2011/12) of the RTIP (as
shown on Exhibit A) and that the City of Tustin accepts responsibility for full funding of said projects
and warrants that no additional funding allocations are required of OCTA for the City of Tustin to fully
implement said projects therefore committing that the first three years of the RTIP are financially
constrained; and
WHEREAS, projects programmed in years 2012/13 - 2013/14 are projects expected to receive
future funding through anticipated revenues, therefore all projects submitted for inclusion in the 2008
RTIP are financially constrained; and
WHEREAS, OCTA as the agency responsible for short-range capital and service planning and
programming for the Orange County area, requires an approved resolution from the governing body
of the lead agency for all projects included in the RTIP; and
WHEREAS, OCTA also requires that the lead agency include a financial plan that
demonstrates how the projects submitted for inclusion in the RTIP can be implemented; and
WHEREAS, the City of Tustin, as the lead agency, possesses the legal authority to submit the
project for inclusion in the RTIP and to finance, acquire, and construct the project.
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin, California,
resolves as follows:
Section 1: Affirms its continuing commitment to the projects submitted for inclusion in the
2008 Regional Transportation Improvement Program.
Section 2: Commits that the City of Tustin, as lead agency for the projects, will carry out the
projects consistent with the project implementation schedule.
Section 3: Certifies that the City of Tustin will allocate the necessary local match funds
(shown on Exhibit A) contained within the project to carry out any federally approved project; and
Section 4: Certifies that the City of Tustin, as the lead agency, will comply with applicable
provisions of the California Environmental Quality Act and/or the National Environmental Policy Act,
the Americans with Disabilities Act, the Secretary of the Interior's Standards and Guidelines for
Archaeology and Historic Preservation, and any other applicable federal, state, and/or local laws,
rules and regulations.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on
the 2nd day of January 2008.
