HomeMy WebLinkAboutCC RES 95-22 1 RESOLUTION NO. 95-22 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST 4 TUSTIN SPECIFIC PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND 5 ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR ZONE CHANGE 94-006 AND ALL FEASIBLE 6 MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY 7 ACT. 8 The City Council of the City of Tustin does hereby resolve as follows: 9 I. The City Council finds and determines as follows: !0 A. That Zone Change 94-006 is considered a tl "project" pursuant to the terms of the California Environmental Quality Act;'and 12 B. That the project is covered by a previously- 13 certified Final Environmental Impact Report for the East Tustin Specific Plan which serves as a 14 Program EIR for the proposed project. 15 II. The East Tustin Specific Plan Final Environmental Impact Report (85-2) previously certified on March 17, 16 1986, and modified by subsequently adopted supplements and addenda, was considered prior to approval of this 17 project. The City Council, having final authority over the subject project hereby finds that this 18 project is within the scope of the East Tustin Specific Plan previously approved. All feasible 19 mitigation measures and alternatives developed in the Program EIR are incorporated into this project. The 20 Final EIR is, therefore, determined to be adequate to serve as a Program EIR for this project and satisfies 21 all requirements of the California Environmental Quality Act. 22 Based on EIR 85-2, the City Council has found that the 23 project involves no potential for any adverse effect, either individually or cumulatively, on wildlife 24 resources and therefore makes a De Minimis Impact Finding related to Assembly Bill 3158, Chapter 1706, 25 Statutes of 1990. In addition, there will not be a significant effect on the environmenE as applicable 26 mitigation measures identified in the Final EIR.have been incorporated into the project's approval which 27 mitigate any potential significant environmental effects. 28 Resolution No. 95-22 Page 2 1 2 3 PASSED AND ADOPTED at a regular meeting of the Tustin City 4 Council, held on the 21st day of February, 1995. 5 THOMAS R.
