HomeMy WebLinkAbout17 ORD 1347-ZONE CH 07-003 01-15-08AGENDA REPORT MEETING DATE: JANUARY 15, 2008 TO: WILLIAM HUSTON, CITY MANAGER FROM: OFFICE OF THE CITY CLERK SUBJECT: ADOPT ORDINANCE 1347 - ZONE CHANGE 07-003 FOR PROPERTY LOCATED AT 15771 RED HILL AVENUE SUMMARY: Panattoni Development Company, LLC is proposing to change the zoning on property located at 15771 Red Hill Avenue from Planned Community Industrial (PC-IND) to Planned Community Industrial Business (PC-IND/BUS) District. This change in zoning would allow office uses on the property. RECOMMENDATION: Have second reading by title only and adoption of Ordinance No. 1347 (roll call vote) or action as necessary. FISCAL IMPACT: None. BACKGROUND: On January 2, 2008, the City Council had first reading by title only and introduction of the following Ordinance: ORDINANCE NO. 1347 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, ADOPTING ZONE CHANGE 07-003 TO REZONE THE PROPERTY LOCATED AT 15771 RED HILL AVENUE FROM PLANNED COMMUNITY INDUSTRIAL (PC-IND) DISTRICT TO PLANNED COMMUNITY INDUSTRIAL BUSINESS (PC-IND/BUS) DISTRICT Maria R. Huizar, Chief Deputy City Clerk ORDINANCE NO. 1347 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, ADOPTING ZONE CHANGE 07-003 TO REZONE THE PROPERTY LOCATED AT 15771 RED HILL AVENUE FROM PLANNED COMMUNITY INDUSTRIAL (PC-IND} DISTRICT TO PLANNED COMMUNITY INDUSTRIAL BUSINESS {PC-IND/BUS) DISTRICT. The City Council of the City of Tustin does hereby ordain as follows: Section 1. FINDINGS The City Council finds and determines as follows: A. That an application for Zone Change 07-003 was submitted to the City by Jon Marchiorlatti and Dorit Ganish, representatives for Panattoni Development Company, LLC. to amend the zoning designation from Planned Community Indus#rial (PC-IND) District to Planned Community Industrial/Business (PC-IND/BUS) District, to allow primary office uses in the district. The project site is located at 15771 Red Hill Avenue; B. That a public hearing was duly called, noticed, and held for Zone Change 07-003 on December 11, 2007, by the Planning Commission. The Planning Commission recommended that the City Council approve Zone Change 07-003; C. That a public hearing was duly called, noticed, and held on said application on January 2, 2008, by the City Council; D. That the proposed Zone Change to PC-IND/BUS District is consistent with the Tustin Area General Plan and, in particular, the Land Use Element which designates this property as industrial and accommodates a broad range of industrial/commercial uses and development; E. That the Tustin City Council approved similar zone changes from PC-IND to PC-INDIBUS in 1979, 1985, and 1995 for nearby properties located to the north, and south of the subject site. F. That the proposed Zone Change will not adversely impact the public health, safety, and welfare of the community; but benefit the community by increasing the marketability of the current project site and therefore, increase the future economic viability through employment opportunities and additional tax revenues. Moreover, Ordinance 1347 Page 2 the proposed project has been reviewed for compliance with all applicable provisions of the City of Tustin Zoning code. Section 2. The City Council hereby approves Zone Change 07-003 to amend Tustin Zoning Map to rezone the property located at 15771 Red Hill Avenue to Planned Community Industrial/Business (PC-IND/BUS) Zoning District, as identified in Exhibit A, attached hereto. Section 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held out to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Tustin hereby declares that it would have adopted this ordinance and each section, subsection, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional.
