A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFI-
CATIONS FOR MCFADDEN AVENUE FAU PROJECT M-M033(1)
AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS.
WHEREAS, it is the intention of the City Council of the City of
Tustin, California, to construct traffic signal improvements and
interconnect on McFadden Avenue. at various intersections designated
as McFadden Avenue FAU Project M-M033(1),
WHEREAS, the City Engineer has presented plans and specifications
for the construction of said work,
NOW, THEREFORE, BE IT RESOLVED Chat the plans and specifications
presented by the City Engineer be and are hereby approved as the plans
and specifications for the construction of McFadden Avenue FAU Project
M-M033 (1).
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized
and directed to advertise as required by law for the receipt of sealed
bids or proposals for.the doing of the work-specified in the aforesaid
plans and specifications which said advertisement shall be substantially
in the following words and figures, to-wit'
"NOTICE TO CONTRACTORS"
SEALED PROPOSALS will be received at the office of the City Clerk,
Tustin City Hall, 300 Centennial Way, Tustin, California, until
11 A.M. on the 1st day of June , 1976, at which
time they will be publicly opened and read, for performing work as
follows:
Traffic Signal Improvements and Interconnect on McFadden
Avenue at Various intersections Designated as McFadden
Avenue FAU Project M-M033(1)... -
Compensation Insurance. Pursuant to the requirements of Section
1860 of. the Labor Code (Chapter 1000, Statutes of 1965), Contractor
shall take out and maintain, during the life of this contract, workmen's
compensation insurance for all his employees employed at the site of
improvement, and if any work is sublet, Contractor shall require sub-
contractor similarly to provide workmen's compensation insurance for'
all of the latter's employees.. Contrabtor indemnifies City for any
damage resulting to it from failure of either Contractor or any sub-
contractor to take out or maintain such insurance.
pub!icl Liability and Property D~mgge~s. Contractor shall take out
and maintain, during the life of this contract, such public liability

and property damage insurance as shall protect the City of TUStin, its
elective and appointive boards, officers, agents and employees, Con-
tractor and any subcontractor performin~ work covered by this contract
from claims for damages for personal injury, including death,, as well
as subcontractor's operations under this .contract, whether 'such opera-
tions be by Contractor or by any subcontractor, or by anyone directly
or indirectly employed by either Contractor or any subcontractor. The
amounts of said insurance shall be as follows'

Public Liability Insurance- In an amount' not' less than
$250,000 for injuries, .including, subject to the same
limit for each person, in an amount not less than
$500,000.00 on account of any one occurrence.
Property Damage Insurance- In an amount of not less than
$100,000..00 for damage to the property of each person on
account of any one occurrence.
Contractor shall furnish the City, satisfactory proof of carriage of
the insurance required, and adequate legal assurance that each carrier'.
will give the City at least ten days prior notice of the cancellation
of any policy during the effective period of this contract.

Plans., specifications, and proposal forms to be used for bidding
on this project" can only be obtained by prospective bidders at the
office of the City Clerk, Tus[in City Hall, Centennial at: blain Street,
.Tus:in, California 92680, upon payment of the following amounts at the
City Clerk's office,which amounts shall not be refundable.
Comp.!.et.e Se_t_- Includes specifications and' plans. Total cost
$10. O0 non-refundable. '
Plans and specifications will only be mailed out upon payment of
a mailing and handling fee in addition to that stated above of $5 00
for a complete set. '
In conformance with Section 37931 of the Government Code, all bids
shall be presented under sealed cover on the proposal form provided and
. accompanied by one of the following forms of bidder's security:

Cashier's check made payable to the City of Tustin.
Certified check made payable to the City of Tustin.
Bidder's bond executed by an accredited surety insurer,
made payable to the City of Tustin.
The security sha~l be in an amount equal to at least ten percent
(10%) of the amount of the bid. A bid shall not be considered unless
· one of the forms of bidder's security is enclosed therewith.

A Surety Bond for payment of' labor and materials will be required
· ~11 the amount of one hundred percent (100%) of the estimated total con-
,
.£ract price and a Faithful Performance Bond in the amount of one hundred
percent (100%) of the estimated total contract price in the form' attached
to the .contract documents. Said bonds shall- be issued.by a company
having a rating of A+AA or better.
. City of Tustin reserves the right to reject any or all bids and/or
waive any informality on a bid. No' bidder may withdraw his bid for a
period of thirty (30) days after the. date se= for the opening thereof.

The contract Will be awarded to the lowest qualified bidder.

ProviSions of the State Contract A~t are not 'applicable, and
bidders will not be required to be prequalified.-
All work to be done under the direct supervision of the City
Engineer, City of. Tustin.
The City of Tustin hereby notifies all bidders that it will
affirmatively insure tha~ in any contract entered into pursuant to

.this advertisement, minority business' enterprisus will be afforded full
opportunity to submit bid.~ in response to this invitation and will not
be discriminated against on tile grounds of race, color, or national
origin in consideration for an award.

Minimum wage rates for this project as predetermined b the
Secretary .of Labor are set forth in the Special .Provisions. If there
~s a difference between the minimum wage rates predetermined by the
Secretary of Labor and tt~e prevailing wage rates determined by the
Department of Public Works for similar classifications of labor, the
Contractor and his subcontractors shall pay not less than the higher
wage rat e.
Pursuant to Section 1770 of the Labor Code, the Department has
ascertained the general prevailing rate of wages in the County in which
the work is to be done, to be as liste~ in the Department of Transpor-
tation publication entitled "Equipment Rental Rates and General Pre-
wailing Wage Rates.," dated January 1975.

Employer payments other than those itemized therein, as defined
in Section 1773.1 of the Labor Code, are to be paid in accordance with
the terms of the collective bargaining agreement applicable to the
type or classification of the workmen or .mechanics employed on the
project. -
Copies of all collective bargaining agreements r~lating to the
work as set forth in the aforementioned Labor Code are on file and
'available for inspection in tl~e office of the Department of Industrial
'Relations, Division of Labor Statistics and Research.
