PUBLIC HEARING (ITEMS 1 THROUGH 2)

APPEAL OF PLANNING COMMISSION DENIAL OF USE DETERMINATION NOS. 00-
001 AND 01-002 (14511 AND 14512 CARFAX DRIVE)
On March 12, 2001, the Planning Commission denied Use Determination Nos. 00-001
and 01-002 finding that the uses that' have been established at 14511 and 14512 Carfax
Drive are not apartments and are boarding houses which require approval of conditional
use permits. The applicant appealed the Planning Commission's decision. On April 16,

2001, the City Council continued the appeal hearing until July 16, 2001, at the request of
the applicant.
Recommendation by the Community Development Department:
Continue the public hearing on the appeal until October 15, 2001.
CODE AMENDMENT 00-001 RELATED TO DEVELOPMENT STANDARDS FOR
DRIV~AYS FOR RESIDENTIAL, COMMERCIAL, ~ID INDUSTRIN_ PROPERTIES
Code Amendment 00-001 would provide development standards for driveways for
residential, commercial, and industrial prol~rties. On June 11, 2001, the Planning
Commission recommended that the City Council approve Code Amendment 00-001.
Recommendation by the Community Development Department:
Adopt the following Resolution No. 01-67 adopting the Final Negative Declaration as
adequate for Code Amendment 00-001'

Recommendation: Approve the City Council Minutes of July 2, 2001 and July 9, 2001.
APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $3,627,856.30 and ratify Payroll
in the amount of $423,464.50.
RESOLUTION NO. 01-74- A RESOLUTION OF THE 'CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE RED HILL
AVENUE MEDIAN LANDSCAPING FROM EDINGER AVENUE TO WALNUT AVENUE
(CIP NO. 7124)
Recommendation: Adopt Resolution No. 01-74 accepting the construction of the Red Hill
Avenue Median Landscaping Project from Edinger Avenue to Walnut Avenue and
authorizing the recordation of the Notice of Completion, and direct the City Clerk to 1)
Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date
of recordation of the Notice of Completion; 2) Release the Faithful Performance Bond not
sooner than one year after the date of recordation of the Notice of Completion; and
assuming no claims or stop notices are filed, 35 days after the date of recordation of the
Notice of Completion, the City Council authorize payment of the final 10% retention in the
amount of $19,363.70 to S & M Landscape, Inc.
RESOLUTION NO. 01-71 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AMENDING THE CITY'S CLASSIFICATION AND
COMPENSATION PLANS
Recommendation: Adopt Resolution No. 01-71 amending the City's Classification and
Compensation Plans for Assistant Public Works Director, Water Services Manager,
Principal Engineer, Senior Accounting Specialist, Senior Accounting Specialist/Water
Billing, and Recreation Leader El as recommended by the Human Resources
Department.
APPROVAL OF CONSULTANT SERVICES AGREEMENT FOR ARCHITECTURAL
DESIGN SERVICES AND CONSTRUCTION DOCUMENTS FOR PIONEER ROAD
PARK
Recommendation: Authorize the Mayor and the City Clerk to exeCUte a Consultant
Services Agreement with the firm of David Volz Design Landscape Architects, Inc., for.
the Pioneer Road Park Project in an amount not to exceed $108,000 as recommended
by the Director of Parks and Recreation Services.
FEE WAIVER PERMIT FOR THE TUSTIN PUBLIC SCHOOLS FOUNDATION 2001
DINOSAUR DASH
Recommendation: Grant a fee waiver of staff costs and equipment of $5,500, and issue
a permit for the 2001 Dinosaur Dash as recommended by the Director of 'Parks and
Recreation Services,
RESOLUTION NO. 01-73- A RESOLUTION'OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 01-01
Recommendation: Adopt Resolution No. 01-73 approving Lot Line Adjustment No. 01-01
as recommended by the Public Works Department/Engineering Division.

RESOLUTION NO. 01-69- A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AUTHORIZING THE DESTRUCTION OF CERTAIN CITY
RECORDS AND PAPERS IN THE POSSESSION OF THE FINANCE DEPARTMENT
OF THE CITY OF TUSTIN NO LONGER REQUIRED FOR THE CONDUCT OF CITY
BUSINESS, PURSUANT TO THE AUTHORITY GRANTED BY SECTIONS 34090,
34090.5 AND 34090.7 OF THE GOVERNMENT CODE OF THE STATE OF
CALIFORNIA
Recommendation: Adopt Resolution No. '01-69 authorizing the destruction of certain City
records and 'papers no longer required as recommended by the Director of Finance.

JOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORTS
Recommendation: Receive and file as recommended by the Community Development
Department.

PLANNING COMMISSION ACTION AGENDA- JULY 9, 2001
All actions of the Planning Commission become final unless appealed by the City Council
or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of July 9, 2001.
13.
AWARD OF BID FOR NEW RIDING LAWNMOWER
Recommendation: Award the bid for the purchase of one riding lawnmower to Bob Hicks
Turf Equipment as recommended by Public Works Department/Field Services Division.
14.
APPROPRIATION LIMIT FOR FISCAL YEAR 2001/2002.
Recommendation by the Finance Director: 1) Select the change in the California per
Capita Personal Income as the price factor for adjusting the 2001/2002 appropriation
limit; and 2) adopt the following Resolution No. 01-76 setting the appropriation limit for
Fiscal Year 2001/2002 at $45,650,362:

800 MHZ COMMUNICATIONS SYSTEM
Recommendation: Authorize the Mayor to send a letter to the Orange County Grand
Jury which responds to recommendations set forth in a Grand Jury Report regarding
the 800 MHz law enforcement communications System as recommended by the City
Manager.

RESOLUTION NO. 01-75 ADOPTING THE CITY BUDGET AND WATER ENTERPRISE
BUDGET FOR THE FISCAL YEAR 2001/2002
The City Council is requested to approve Resolution No. 01-75 adopting the budgets for
the City and the Water Enterprise for Fiscal Year 200112002.

Recommendation: Adopt the following Resolution No. 01-75 appropriating the City's
Governmental Funds o[ $44,857,356; Special Revenue Funds, $17,263,200; and the
City's Water Enterprise Budget of $22,473,831'

Committee.
Recommendation by the Office of the City Clerk:
Cast ballots to determine appointments for the Cultural Resources Advisory Committee.
