SUBJECT: ASSEMBLY BILL 1756 (CABALLERO)
SUMMARY
Assembly Bill 1756 would encourage and support the use of public-private-partnerships to
finance and construct infrastructure projects. Staff is recommending that we monitor this
legislation and report any significant changes to the City Council.
RECOMMENDATION
Staff recommends the City Council take no action at this time. Staff will monitor the bill and
report any significant changes to the City Council.
FISCAL IMPACT
There is no fiscal impact associated with this item.
BACKGROUND
AB 1756 is a companion Bill to AB 1261 and would require the Secretary of Business,
Transportation and Housing to establish the Office of Local Public-Private Partnerships (P3)
in the agency to do the following:
• Promote P3's through educational seminars, fact sheets, and other materials
explaining the function of P3's and the types of infrastructure projects that may be
candidates for apublic-private partnership approach.
• Serve as a clearinghouse of information regarding local agency use of P3's to
build infrastructure in this state and elsewhere.
• Establish a service to link local agencies with technical and legal resources to
assist in developing and evaluating Requests for Proposals for P3 projects and to
assist in structuring agreements to protect a local agency's interests in a public-
private partnership.

An act to add Section 13986 to the Government Code, relating to
local government.
LEGISLATIVE COUNSEL'S DIGEST
AB 1756, as introduced, Caballero. Local infrastructure development:
public-private partnerships.
Existing law sets forth the duties and authority of the Business,
Transportation and Housing Agency in implementing various regional
and local development programs in the state.
This bill would require the Secretary of Business, Transportation and
Housing to establish the Office of Local Public-Private Partnerships in
the agency to inform local agencies and other interested stakeholders
of the role that public-private partnerships can play in financing,
constructing, or operating, or any combination thereof, fee-producing
local infrastructure projects.
Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.
The people of the State of California do enact as follows:
1 SECTION 1. Section 13986 is added to the Government Code,
2 to read:
3 13986. (a) The secretary shall establish the Office of Local
4 Public-Private Partnerships in the agency to inform local agencies
5 and other interested stakeholders regarding of the role that

public-private partnerships can play in financing, constructing, or
operating, or any combination thereof, fee-producing local
infrastructure projects.
(b) The duties of the office shall include, but are not limited to,
both of the following:
(1) Providing information to local agencies and other interested
stakeholders regarding public-private partnerships through
educational seminars, fact sheets, and other materials explaining
the function of public-private partnerships and the types of
infrastructure projects that may be candidates for apublic-private
partnership approach.
(2) Serving as a clearinghouse of information regarding local
agency use of public-private partnerships to build infrastructure
in this state and elsewhere. Specific clearinghouse functions may
include, but are not limited to, the following:
(A) Establishing an Internet Web site to post information
regarding local agency public-private partnership projects.
(B) Establishing a service to link local agencies with technical
and legal resources to assist in developing and evaluating requests
for proposals for public-private partnership projects and to assist
in structuring agreements to protect a local agency's interests in a
public-private partnership.
