HomeMy WebLinkAboutCC RES 83-22lO 11 13 14 15 18 17 18 19 20 2'4 27 28 RESOLUTION NO. 83-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DETERMINING THE VALUE OF WRITTEN PROTESTS AND ORDERING REORGANIZATION NO. 53 AND TRANSFER OF TERRITORY BETWEEN THE CITIES OF IRVINE AND TUSTIN, SUBJECT TO THE CONFIRMATION BY THE VOTERS. The City Council of the City of Tustin does hereby resolve as follows' I. Pursuant to Par% 2 of Ti%le 4, Division 2, commencing with Section 35200 et. seq. of the Government Code, preliminary proceedings were completed by the Local Agency Formation Commission on January 26, 1983, and by LAFCO Resolution No. 83-4 the City of Tustin was designated the conduct- ing authority and authorized to proceed with the transfer of territory between the cities of Irvine and Tustin designated "Orange County (Muni- cipal) Reorganization No. 53." II. The Tustin City Counci.1, pursuant to Section 35300 of the Government Code adopted Resolution No. 83-10 i nitiati ng reorgani za~ion proceedings and scheduling a public hearing for March 21, 1983, at 7.30 p.m. III. Due notice was given and a protest hearing was conducted at the adver- tised time and place. Protests filed by 0 property owner(s) repre- senting 0% of the total assessed value of aT~-~-d and 49 protests filed by register~ voters representing 37.4% of the registered vo~ers within ~he ..... area proposed for reorganization were received prior to the close of the hearing. IV. The. City Council hereby orders Reorganization No. 53 and transfer of territory between the Citi es of I rvi ne and Tustin subject to the confi r- marion by the voters residing within the affected territory. V. The City Clerk shall schedule said marl:er at the next regular election to be held on November 8, 1983, and shall cause notice of the election to be given as prescribed in Section 35055 of the Government Code, and an election to be conducted as prescribed by Chapter 1, Article 4, Sec- tion 35060 et. seq. of the Municipal Organization Act of 1977.
