HomeMy WebLinkAboutCC RES 83-33 RESOLUTION NO. 83-33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR MOULTON PARKWAY/IRVINE CENTER DRIVE AND MYFORD ROAD FAU PROJECT M-M032(O04) WHEREAS, it is the intention of the City Council of the City of Tustin, California to construct certain street improvements and appurtenant work on Moulton Parkway/Irvine Center Drive and Myford Road, designated as FAU Project M-M032(004), and; WHEREAS, the City Engineer has presented plans and specifications for the construction of said work; NOW THEREFORE, BE IT RESOLVED that the plans and specifications presented by the City Engineer be and are hereby approved as the plans and specifications for: MOULTON PARKWAY/IRVINE CENTER DRIVE AND MYFORD ROAD FAU PROJECT M-~032(004) BE IT FURTHER RESOLVED that the City' Clerk is hereby authorized and directed to advertise as required by law for the r. eceipt of sealed bids or specifications which said advertisement shall be substantially in the following words and figures to-wit: "NOTICE TO CONTRACTORS" SEALED PROPOSALS wi 11 be received at the office of the City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California, until 10 a.m. on · ,, the 15th day of June, 1983, at which time they will be publicly opened and read, for performing work as follows: CONSTRUCTION OF 4 LANE ROADWAY FACILITY, MYFORD ROAD OVERHEAD, PETERS CANYON WASH OVERCROSSING, SANTA ANA/SANTA FE REINFORCED CONCRETE BOX EXTENSION, REINFORCED CONCRETE PIPE STORM DRAIN, TRAFFIC SIGNAL AND PAVEMENT STRIPING BE.TWEEN RED HILL AVENUE AND CULVER DRIVE. Plans, specifications and proposal forms to be used for bidding on this project can only be obtained by prospective bidders at the office of the City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California, 92680, Upon payment of $15.00 per set, which amount shall be non-refundable. Plans and specifications 'will.'be mailed out upon payment of $6.00 per set, which amount shall be non-refundable. In conformance with Section 37931' of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and accompanied by one of the following forms of bidder's security: a · Cash b. Cashier's check made payable to the City of Tustin. c. Certified check made payable to the City of Tustin. d. Bidder's bond executeld by an accredited surety insurer, made payable to the City of Tustin. The security shall be in an amount e~al to at. least ten percent (104) of the amount of the bid. A bid shall not be. considered unless one of the forms of bidder's security is enclosed therewith. A Security Bond for payment of labor and materials will be required in the amount of .fifty percent (504) of the estimated total contract price and a Faithful Performance Bond in the amount of one hundred percent (1004) of the estimated total contract price in the form attached to the contract documents. Said bonds shall be issued by a Surety Company rated Grade A or better and Class IX or better by the latest edition of Best's Key Rating Guide. ' City of Tustin reserves the right to reject any or all bids, and/or waive any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. The Contract will be awarded to the lowest qualified bidder. Provisions of the State Contract Act are not applicable, and prospective bidders will not be required to be prequalified. .. A-5 4 ]0 Pursuant to California Government Code Section 4590, the contractor will be entitled to post approved securities with the City or an approved financial institution in order to have the City release funds retained by the City to insure performance of the contract. Federal Requirements and Federal minimum wages shall apply to this project. Attention is directed to decision No. CA81-5154 of the Secretary of Labor. Not less than said minimum wages shall be paid to workers employed on this project. Federal requirements for this project require that the Contractor shall perform work with his own organization which equals not less than 50 percent (504) of the total contract price. Ten percent Minority Business Enterprise (MBE) participation is required. Minimum wage rates for this project as predetermined by the Secretary of Labor are set forth in the special provisions. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates determined by the State for similar classifications of labor, the Contractor and his subcontractors shall pay not less than the higher wage rate. Pursuant to Section 1773 of the Labor Code, the general prevailing rate of wages in the county in which the work is to be done has been determined and the department has listed these wage, rates in the Department of Transportation publication entitled Equipment Rental Rates and General · Prevailing Wage Rates, dated February, 1977.
