RESOLUTION NO. 83-60
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, ACTING ON AN APPEAL
OF THE CITY COUNCIL DENYING USE PERMIT 83-12
The City Council of the City of Tustin, California does hereby
resolve as follows-
I. The City Council finds and determines as follows'
a. That a proper application (Use Permit No. 83-~) was
filed by Larwin Square Limited on behalf of Home Federal
Saving and Loan requesting authorization to develop a
savings and loan office and automated teller kiosk
within Larwin Square Shopping Center at Newport Ave. and
Fi rst St.
b. That a public hearing was duly called, noticed and
held on said appl icati on.
c. That the Planning Commission of the City of Tustin,
by Resolution No. 2102,-did approve said use permit
application on the basis that the proposed project was
in conformance with the intent of the City's development
standards and that any potential traffic hazards on-site
could be mitigated by conformance with development
standards.
d. That the City Council, at their meeting of July 18,
1983 by a vote of five ayes to zero noes, appealed the
decision of the Planning Commisssion pursuant to City
Code Secton 9294b.
e. That a public hearing was duly called, noticed and
held on said appeal.
f. That the City Council determines that serious
parking and traffic problems are evident in the area
adjacent to the proposed construction site to provide
sufficient cause to deny the application as submitted
based upon the fol 1 owing findings:
1. The parking areas adjacent to the building site
are already congested due to excessive customer
traffic and lack of conveniently located parking for
customer use.
2. That the addition of building area will increase
the degree of tralffic congestion at the on-site
intersection and increase the demand for parking
near the retail shops. .

3. That an excessive use of compact spaces adjacent to the
stores would not sufficiently accommodate the potential
mix of standard and compact cars.
4. That there is no monitoring program of the compact spaCe
usage to ensure that the smaller spaces will be used by
compact' car drivers.
5. That existing tenant space within the center was
available to the savings and loan association for
expansion and the adding of new building areas is not
needed for this purpose.
6. That the parking facilities at the rear of the stores
are not adequately used by employees of the center,
resul ting in a parking probl em in the center of the
parking area.
II. The City Council hereby overrules the findings of the
Planning Commission as contained in Resolution No. 2102
and hereby denies Use Permit No. 83-~, subject to the
fol 1 owing- Y ~K-~~}
a. That the existing tot l~t may be eliminated if the
applicant so chooses.
b. That should a new iproposal for the subject use be
submitted within one (1) year, the application fee
is waived.
PASSED AND ADOPTED at a regular meeting of the City Council,
held onthe 6th day of September , 1983.
