RESOLUTION NO. 83-75
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
CALIFORNIA, ACTING ON AN APPEAL OF THE CITY COUNCIL
AFFIRMING. THE FINDINGS OF THE PLANNING COMMISSION
CONCERNING USE PERMIT NO. 83-16
The City Council of the City. of Tustin, Cal i fornia does hereby
resolve as fol 1 ows:
I. The City Council finds and determines as follows'
A. That a proper application (Use Permit No. 83-16) was
filed by Pacific Coast Builders, Inc. requesting
authorizatioln to develop 161 residential condomini urns at
the southerly extent of Newport Avenue.
B. That a Public Hearing was duly called, noticed and
held on the said application.
C. That the Planning Commission of the City of Tustin,
by Resolution No. 2113, did approve said use permit
appl icati on wi th authori zati on to vary with certain
open space development standards to improve parking lot
design.
D. That the City Council, at their meeting of September
6, 1983 by a vote of five ayes to zero noes, appealed
the deci si on of the P1 anning Commission pursuant to City
Code Section 9294b.

F. That the City. Council determined that the findings
and conclusions of the P1 arming Commission were correct
and the conditions of approval were appropriate to
mitigate negative environmental impacts.
II. The City Council of the City of Tustin does hereby
affirm the findings of the Planning Commission as contained
i n Resolution No. 2113, subject to the fol 1 owing conditions'
A. That the developer work with the neighboring property
owner to alleviate concerns regarding the location of
the perimeter carports.
B. That construction will commence within six months of
the date of this resolution.
C. That the C.C.&R.'$ shall contain a reference that
Newport Avenue may, at sometime in the future, cross
the railway with an above grade crossing.
PASSED AND ADOPTED at a regular meeting of the City Council, held on
the 5th day of October , 1983.
