RESOLUTION NO. 83-76 10 1! 12 15 17 18 19 20 27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, APPROVING AN AMENDMENT TO LAND USE ELEMENT OF THE GENERAL PLAN TO RESIDENTIAL MULTIPLE-FAMILY RELATIVE TO THE EASTERLY SIDE OF HOLT AVENUE, SOUTHERLY OF WARREN AVENUE, AND WESTERLY OF THE FLOOD CONTROL CHANNEL The City Council of the City of Tustin does hereby resolve as follows' I. The City Council finds and determines as fol 1 ows' A. Section 65356.1 of the Government Code of the State of California provides that when it is deemed to be in the public interest, the legislative body may amend a part of the General Plan. B. That in accordance with Section 65356 of the Government Code of the State of California, a public hearing was duly advertised and held on September 26, 1983 on the application of the property owners within the area, as initiated by Richard Pierce, to consider General Plan Amendment 83-2 to reclassify the properties to Residential Multiple-Family use. C. That a Negative Declaration has been prepared for the requested change and is hereby approved. D. That the change in classification would be in the public interest and not detrimental to the welfare of the public or the surrounding property owners. · E. The City Council approves the findings and recommendations contained in the City of Tustin Planning Commission Resolution No. 2116, recommending to the City Council approval of General Plan Amendment No. 83-2 amending the Land Use Element. II. The City Council hereby approves General Plan Amendment 83-2, amending the Land Use Element to reclassify the properties easterly of Holt Avenue, southerly of Warren Avenue and westerly of the flood control channel to 'Residential Multiple-Family use with the following condi ti OhS. A. That any proposal for residential development shall be in conformance with Specific Plan No. 6. Resolution No. ~-76 Page 2 B. That existing structures on the properties not be converted to nml tiple-family use and that they be removed prior to I the issuance of a building permit for the construction of any multiple-family dwelling unit. 10 PASSED AND ADOPTED at a- regul ar meeting of the City Council, City of Tustin held on the 5th day of October, 1983.
