HomeMy WebLinkAboutCC RES 83-099 RESOLUTION NO. 83-99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 83-20 AMENDING THE DECISION OF THE PLANNING COMMISSION AND AUTHORIZING CONSTRUCTION OF EIGHTEEN RESIDENTIAL TOWNHOME CONDOMINIUMS LOCATED AT AT 14452, 14472, 14492 HOLT AVENUE The City Council of the City of Tustin .does hereby resolve as follows' I. The City Council finds and determines as follows' A. That a proper application, (Use Permit 83-20), has been filed by Richard Pierce requesting authorization to construct eighteen townhome units in one phase located at 14452, 14472, 14492 Holt Avenue. B. That the Use Permit was appealed by City Council and that a public hearing was duly called, noticed and held on said application. 10 C. That eighteen townhome units are the maximum allowable density according to the R-3 (2800) zone and Specific Plan No. 6, as amended. 15 18 19 D. The City Council hereby makes the following findings of fa ct' 1. That establishment, maintenance, and/or operation of the use applied for will not be detrimental to the health, safety, or morals of the persons residing or working in the neighborhood of such proposed use, in that' a. the proposed project is in conformance with b. oth the Tustin Zoning Ordinance No. 157, as amended, and the Tustin Area General Plan. b. the proposed project is in conformance with the requirements of Specific Plan No. 6, as amended. 20 c. the proposed project will provide 2,820 square feet per unit. d. development standards have been applied which conform to the Specific Plan and provide for a uniform development consistent with adjoining deve 1 opmen ts. 2. The establishment, maintenance and/or operation of the use applied for will not be detrimental to the comfort and general welfare of persons residing or working in the neighborhood of the proposed use in that the use applied for is in conformance wi th the Zone Classificatio~ of R-3 (2800) and shall be developed in accordance with the City of Tustin's development and zoning provi si ons. 10 11 12 17 18 2O 21 22 22 25 26 27 28 Resolution No. Page 2 ~-99 II. ® The. establishment, maintenance and/or operation of the use applied for will not be injurious or detrimental to property, improvements in the neighborhood, or general welfare of the City in that the project will be constructed in conformance with 1979 Uniform Building Code, as adopted by Ordinance No. 835. ® That a Negative Declaration has been prepared in conformance wi th the Cali forni a Environmental Qual i ty Act and is hereby adopted. · The proposed development shall be in accordanceI with the development policies adopted by the City Council, Uni form Bui 1 ding Code as admi ni stered by the Bui 1 ding Official, Fire Code as administered by the Orange County Fire Marshal, and street improvement requirements as administered by the City Engineer. ® Final development plans shall be reviewed and approved by the Planning Commission and Community Development Department. The 'City Council hereby amends the decision of the P1 anning Commi ssi on and approves Conditional Use Permit No. 83-20, authorizing the construction of eighteen townhome units in one phase, subject to the fol lowing condi ti OhS'I ® The final site plan shall be standardized and reflect all appropri.ate City standard drawing numbers. The developer shall construct all missing or damaged street improvements to said development per the City of Tustin "Minimum Design Standards of Public Works" and "Street Improvement Standards". This work shall consist of, but not be limited to; curbs and gutters, sidewalks, drive aprons and street pavement. The Covenants, Conditions and Restrictions for this townhome project shall be reviewed and approved by City staff and the City Attorney prior to the recordation of these C.C. & R.'s. The C.C. & R.'s shall specifically prohibit the storage of recreational vehi cl es wi thin the compl ex. The C.C.& R.'s shall state that garages shall be used primarily for the storage of vehicles and outline enforcement procedures. The C.C. & R.'s shall include vehicular and pedestrian access for adjoining developments in the Specific Plan area. · II 10 11 12 15 16 17 19 2O 21 22 22 2~ 25 26 27 28 Resolution No. ~-99 Page 3 3. All future site plans and elevations submitted for Community Development Department review shall be consistent with the site plan submitted for review andlapproval by the City Council. All amenities shall be substantially constructed. 4. A landscape plan shall be required for review and approval from the Community Development Department and Planning Commission. The applicant shall make every effort to preserve mature trees as an amenity of the project. 5. The subject parcel shall require annexation to the Orange County Street Lighting Maintenance District No. 6. 6. Each residential lot shall have an individual sanitary sewer and domestic water service. 7. Sanitation District, Water District, New Development taxes and parkland dedication fees are to be paid pti or to bui 1 ding permit issuance. 8. A final grading plan shall be required for review and approval by the Community Development Department. 9. A permit shall be required from the Orange County Environmental Management Agency if any drainage is planned to flow into the adjacent Flood Control Channel. 10. Improvements on the private street shall be detailed to ensure that they conform to those improvements with Tract 11586 to the south. 11. The adoption of Use Permit 83-20 shall be final when Pre-Zone 83-1 is completed adopted. 12. A sewer and water plan shall be required for review and approval. 13. The property line radius at the corner of Holt Avenue and Warner Avenue shall be of such a radius to accommodate a 35' radius curb return. 14. Payment of Orange County Sanitation District No. 7 connection fees at the time a building permit is issued, based upon $250.00 per dwelling unit and a front footage charge. 10 17 18 19 20 29. Resolution No. Page 4 ~-99 15. All exterior materials and colors shall be submitted for review and approval by the Community Development Department. 16. All utilities serving the proposed development shall be underground within the exterior boundary lines of the property. 17. A Tentative and Final Map must be submitted and approved in compl lance wth the Subdi vi si on Ordinance. 18. Individual t~ash receptacle pick-up shall be restricted to along the private driveway, subject to written approval from the disposal service. 19. The adoption of Use Permit 83-20 shall be final when an amendment to Specific Plan No. 6 has been approved by the Planning Commission and City Counci 1.
