HomeMy WebLinkAboutCC RES 84-42RESOLUTION NO. 84-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN ORDERING THE ANNEXATION OF UNINHABITED TERRITORY KNOWN AS "TUSTIN WATER UTILITY ANNEXATION NO. 131" TO THE CITY OF TUSTIN 7 The City Council of the City of Tustin does hereby resolve as 8 follows: 9 I. 10 11 12 Pursuant to Chapter 2, Part 2, Division 2 of Title 4 of the Government code, preliminary prceedings were initiated by Resolution No. 82-55, passed by the City Council on July 19, 1982 and approved by the Local Agency Formation Commission on April 4, 1984, for the annexation to the City of Tustin of ten well and reservoir sites of the Tustin Water Utility involving + 3.65 acres located throughout the unincorporated area of north an~ east Tustin. 13 II. The Tustin Water Utility Annexation No. 131 to the City of Tustin, as more fully described by the maps and legal descriptions shown as 14 Appendix A through K, exclusive of Parcel "D", attached hereto and part hereof, is uninhabited territory authorized to be annexed to 15 the City of Tustin pursuant to Section 35012 of the Government Code as noncontiguous territory being used for municipal purposes. 16 17 18 19 2O 21 22 I I I. The purpose of said annexation is to relieve the City water uti 1 i ty of tax liabi 1 i ty for City owned property used for municipal purposes. IV. At such time as any part of said property ceases to be a part of the City, the City Council shall adopt a resolution of detachment pursuant to Sections 35012 and 35350 of the Government Code. Vo Pursuant to Section 35150 (g) of the Government Code, the Local Agency Formation Commission by Resolution No. 84-23, authorized the City of Tustin as the conducting authority to annex said territory without notice or hearing.
