HomeMy WebLinkAboutCC RES 84-07010 11 12 12 14 15 16 17 18 19 20 21 22 25 27 28 RESOLUTION NO. 84-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING RELINQUISHMENT OF THE EXTENSION OF THE NORTHBOUND 07~0RA-55 MCFADDEN AVENUE ON-OFF RAMPS BETWEEN PASADENA AVENUE AND NEWPORT AVENUE AND WAIVER OF NINETY (90) DAY NOTICE OF INTENTION WHEREAS, by Freeway Agreement dated September 22, 1958, between the County of Orange and the State of California, the State of California has constructed certain local roads lying, at that date, within an unincorporated area in said County and the County has agreed to accept title to same upon relinquishment by the State of California; and WHEREAS, the above mentioned facilities now lie within the City of Tustin; and WHEREAs, the State of California has acquired right of way for and has constructed the extension of the northbound 07-0RA-55 McFadden Avenue on-off ramps between Pasadena Avenue and Newport Avenue in accordance with said Agreement; and WHEREAS, the Tustin City Council has found and determined, and does hereby find and determine that it is desirable and in the public interest that said extension of the access ramps between Pasadena Avenue and Newport Avenue be relinquished to the City of T'ustin for use as a City street subject~ to the reservation to the State of California any and all rights of ingress to and egress from the highway hereby relinquished in and to the adjoining ......... freeway, except at such points as may be established by Resolution of California Transportation Commission; and WHEREAS, the City of Tustin is aware of the ninety (90) day notice in writing of intention to relinquish any portion of a State highway as required by Section 73 of the Street and Highway Code and requests waiver of said notice for above mentioned relinquishment; NOW, THEREFORE, IT IS RESOLVED, by the City Council of the City of Tustin requests that the State of California proceed with the above mentioned relinquishment to the City of Tustin and that the ninety (90) day notice in writing per Section 73 of the Street and Highways Code by waived in order that this relinquishment proceedings may be accelerated. BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and directed to transmit to the State of California Department of Transportation a certified copy of this Resolution.
