HomeMy WebLinkAboutCC RES 95-01 1 RESOLUTION NO. 95-01 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CERTIFYING THE FINAL NEGATIVE DECLARATION 3 AS ADEQUATE FOR TENTATIVE PARCEL MAP 94-149 AND VARIANCE 94-011 INCLUDING REQUIRED FINDINGS 4 PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. 5 The City Council of the City of Tustin does hereby resolve as 6 follows: 7 The City Council finds and determines as follows: 8 A. The request to approve Tentative Parcel Map 94-149 and Variance 94-011 are considered projects 9 pursuant to the terms of the California Environmental Quality Act. 10 B. A Negative Declaration has been prepared for this 11 project and has been distributed for public review. 12 C. Whereby, the City Council of the City of Tustin has considered evidence presented by the Community 13 Development Director and other interested parties with respect to the subject Negative Declaration. 14 D. The City Council has evaluated the proposed final 15 Negative Declaration and determined it to be adequate and complete. 16 II. A Final Negative Declaration has been completed in 17 compliance with CEQA and State guidelines. The City Council, having final approval authority over Tentative 18 Parcel Map 94-149 and Variance 94-011, has received and considered the information contained in the Negative 19 Declaration, prior to approving the proposed project, and found that it adequately discussed the environmental 20 effects of the proposed project. The City Council has found that the project involves no potential for an 21 adverse effect, either individually or cumulatively, on wildlife resources and makes a De Minimis Impact Finding 22 related to AB3158, Chapter 1206, Statutes of 1990. On the basis of the initial study and comments received 23 during the public review process, the City Council has found that although the proposed project could have a 24 significant effect on the environment, there will not be a significant effect on it in this case because 25 mitigation measures identified in the Negative Declaration have been incorporated into the project which 26 mitigate any potential significant environmental effects to a point where clearly no significant effect would 27 occur and are identified in Exhibit A to the Negative Declaration and Initial Study and are adopted as findings 28 Resolution No. 95-01 Page 2 1 and conditions of Resolution Nos. 95-02 and 95-10, 2 incorporated herein by reference. 3 PASSED AND ADOPTED at a regular meeting of the Tustin City 4 Council, held on the 6th day of February, 1995. 5 8 MAYOR 9 ~E.
