HomeMy WebLinkAboutCC RES 79-09 ! 5 6 ? 8 91 10 11 14 !5 18 19 2, O 2,2 2,3 2,4 ~5 ~6 2,? 2,8 RESOLUTION NO. 79-9 A RESOLUTION OF THE CITY COUNCIL, OF THE CITY OF TUSTIN, ANNEXING TO THE CITY OF TUSTIN CERTAIN UNINHABITED TER- RITORY DESCRIBED HEREIN, AND DESIGNATED "NEWPORT-SYCAM0RE ANNEXATION NO. 118." The City Council of the City of Tustin, California does hereby resolve as follows: 1. Pursuant to the provisions of the Government Code of the State of California, application was made to the Local Agency Formation Com- mission to annex to the City of Tustin all that uninhabited territory situated in the County of Orange, State of California, hereby desig- nated "Newport-Sycamore Annexation No. 118" as described in Exhibits "A" and "B" and attached hereto and incorporated herein by this reference. 2. The Local Agency Formation Commission, in session duly assembled, on December 13, 1978, did approve said proposed annexation, and authorized the City Council to annex said territory without notice, hearing or election. 3. The City Comncil finds and determines that all of said territory is uninhabited., within the meaning of the Government Code, on the date of adoption of this Resolution, and that said territory is contiguous to the City of Tustin. 4. Ail of the owners of land within the territory proposed to be annexed have given their written consent to the annexation of said territory to the City of TustLn. 5. The. City Council desires to annex said uninhabited territory to the City of Tustin for the following reasons- The territory is con- tiguous to the City of Tustin and its proposed annexation will contri- bute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, and sanitary and storm-water sewers and drainage facilities, both in the city and in said uninhabited ~er~'*-~._orv~, in a manner most conducive to the welfare of the city and said ~.ninhabited territory. ~ 6. The City Council of the City of Tustin does hereby approve the annexation of the territory hereinabove described to the City of Tustin, and does hereby further resolve that the said territory be and it is hereby annexed to the City of Tustin, effective upon the date of recording by the County Recorder of the County of Orange, California. 7. The property within the annexed territory shall be taxed to pay the indebtedness and liability of the City contracted to or existing at the time of annexation. 8. The City Clerk of the City of Tustin is hereby directed without delay to transmit to the Local Agency Formation Core,mission of Orange County, a certified copy of this Resolution. · PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin, California, held on the;_ /3-. ?~- ._ day of ~._ ~.~_~,~., 1979. Beginning at the point of intersection of the centerlines of NewpQrt Avenue and Sycamore Avenue, said point of intersection being the l'tortherly corner of Lot 64, Block ll of Irvine's Subdivision as'per map recorded in Book 1, Page 88 of Miscellaneous Maps, records of Orange Coun,t,y Cal, ifornia, said point of intersection being distant North 40o 00' O0 ~ast 1320.61 feet from the Westerly corner of said Block 11, said point of intersection also being a point on the existing City of Tustin boundary as established by the Newport - Sycamore Annexation No. 66 per resolution No. 70-45 passed and adopted September 21, 1970. Thence South 49o 59' 23" East, along said City of Tustin boundary per above mentioned annexation, a distance of 250.00 feet to the point of intersection with the Northeasterly p. rolongation of the Southeasterly line of Parcel 1 as per map filed in Book 70, Page 30 of Record of Surveys, records of said Orange County; Thence, leaving said City of Tustin boundary, South 40o 00' 00" West, alon§ said Northeasterly prolongation and Southeasterly line of said Parcel l, a distance of 217.12 feet to the Southerly corner of said Parcel 1; Thence, North 49o 59' 23" West, along the Southwesterly line of said Parcel 1 and its Northwesterly prolongation thereof, a distance of 280.00 feet to the point of intersection with the existing City of Tustin boundary as es- tablished by the South Tustin Avenue Annexation per Ordinance No. 136, passed and adopted July 5, 1960; Thence, along the existing City of Tustin boundary per above mentioned South Tustin Avenue annexation and the previously mentioned Newport - Sycamore Annexation No. 66 throu§h the following courses; North 40o 00' 00" East, a distance of 217.12 feet; thence, South q9o 59' 23'" East, a distance ef 30.00 feet to the point of beginning.
