RESOLUTION NO. 77-35
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, FINDING AND DETERMINING THAT
PUBLIC INTEREST AND CONVENIENCE REQUIRE TtIE SALE OF
REAL PROPERTY AT AN IRREGULAR SITE HAVING APPROXI-
MATELY 60.750 SQUARE FEET WITH FRONTAGE PARTIALLY
'ON "C" STREET, SECOND STREET, EL CAMINO REAL, AND
THIRD STREET.
The City Council of the City of Tustin, California, does
hereby resolve as follows'
1. The City Council, upon the recommendation 'of the
Planning Commission, hereby finds and determines as follows'
a. That the property is not needed for any present
or prospective public use, and is therefore excess
and surplus land.
b. That the public interest and convenience, require
the sale of said site..
c. That the site proposed 'for sale is as described
in Exhibit "A" attached hereto with the bidder
having the option of submitting two proposals
as follows'

(1) The. City will sell the entire site but must
retain the use of Parcel "B" and the real
property contained thereon for a period of.
ten years; during that period of time the City
will pay the owner a.total rent for the prop-
erty not to exceed $4,800.00 per year. Said
· payments will be made. on a (1/12) monthly
basis unless elected to be paid annuall, y on
the part of the City. City shall be respon-
sikle for all maintenance during its occu-
pancy. The City reserves the right to termi-
nate the lease on Parcel "-B" by submitting a
six-month not ice.
Upon expiration of the ten-year lease o-f Par-
cel "B" or upon termination of the lease by
the City, whichever occurs sooner, the owner
will obtain complete possession of the prop-
erty and structures thereon. Said structures
must then be made to conform to the develop-
ment plan approved as a condition of this for
the entire site, as well as all Codes. The
City will have no financial obligati.on in re-
gard to this property.
(2) That the site be sold as described in Exhibit

and so designated on Exhibit "A" shall remain
the property of the City and be subject to ....

f. That the building present!y located on the corner
of Second and "C". Streets shall be removed by the
purchaser within one year of purchase or less.
2. That any person who wishes to make an offer to pur-
chase the said property may do so by submitting to City an offer
in writing on the form attached as Exhibit "B", accompanied by
·
a cashier's check in the sum of $5,000.00 payable to the City of
Tustin, at or before the time of the said hearing, and any and ali
persons are hereby solicited for offers.
3. That the minimum base bid shall be $150,000, and the
minimum alternate bid $180,000. Final sale shall be subject to
the normal real estate sales provisions as prepared by 'the City
A.ttorney.
4. That the City shall reserve the right to refuse all
bids.
5. That the City shall prepare the final parcel map
required for the sale of the property. Sale will be consummated
upon final acceptance of the parcel map.
6. That the bidders shall submit a development proposal
outlining the intended use or uses of the property in conjunction
with the bid submitted. Final sale of the property will be
dependent on how well the proposed use meets the objectives of
the City in the Tustin Redevelopment Project Area. Preliminary
review of projects by the City staff is encouraged for all
bidders prior to their submission of development plans.
7. That the purchaser shall be.subject.to a contractual

proposals. Such a document, shall specify the penalties and. pro-

specified in his proposals within a period of three years.
8. That proposals shall be s~bmitted'no later than 3-00
p.m. on May 30, 1977, to the City Clerk's Off ice, at which time
the staff shall open and review the bids and proposals prior' to
the June 6th public hearing.
9. That a h'earing is set for June 6, 1977, at 7'30 p.m.
in the Council Chambers of the City of Tustin at Tustin City
Center, Centennial at Main, Tustin, CalifOrnia, at which time
and place any and all persons interested in said proposed sale may
appear, make or revise offers, protest the proposed sale, and/or .
otherwise be heard. The City Council Shall pass upon any and
all offers and protests at said time and place.

10. The conditions stated herein are a condition, of sale
and will be recorded against the property as part of that sale.

il. That a copy of this Resolution shall be published
once in the Tustin News, a weekly newspaper published and circu-
lated in the City of Tustin, California, and once in the Santa Ana
Register, a daily newspaper published in the County of Orange,
California. The aforesaid publications shall be .made not less
than ten (10) days prior to the date of said public hearing.
Prior to said public hearing, copies of this Resolution shall be
posted for not less than ten (10) days ~n at least three (3) con-
spicuous places upon the aforesaid real 'property.
PASSED AND ADOPTED at a regular meeting of the Tustin City
Council, held on the 4th day of April, 1977.

be submitted no later than May 30, 1977, at 3'00 p.m., to the
Tustin City Clerk, as required in Resolution No. 7.?-..~~.
The City will review the proposals and hold a public hearing on
same on June 6, 1977, at 7:30 p.m. in the City Council Chambers,
at which time proposals will be considered and all persons may
appear to revise offers, protest the proposed sale, and/or other-
wise be heard. Revised offers must be in written form outlining
what elements o£ the original written proposal have changed.
The City of Tustin reserves the right to reject all proposals.

Purchasers will be subject to a contractual obligation with the
City to insure the expeditious development of the property'-in a
manner represented in the bidder's proposal.
