FINAL TRACT MAP 15993 (TUSTIN RANCH ESTATES)
SUMMARY
On August 18, 1997, the City Council approved Tentative Tract Map 14396 (a portion of
Master Tract Map 13627) for the development of 113 custom home sites, an equestrian
center, and a 20-acre intermediate school site at the southerly terminus of Pioneer Road.
Subsequently, the project was divided into three phases and the last phase was re-subdivided
as Tentative Tract Map 15993 for the development of twenty-two (22) units, which was
approved with conditions by the City Council on May 21, 2001. The Final Tract Map may be
recorded with the Orange County Recorder's Office upon approval by the City Council and
satisfaction of all conditions of approval, subject to final approval of the Community
Development and Public Works Departments.
Applicant/Owner: The Irvine Company/Standard Pacific Homes
RECOMMENDATION
That the City Council adopt:
1)
Resolution 01-104 accepting an easement from the County of Orange for street and
highway purposes; and,
2)
Resolution 01-105 approving Final Tract Map 15993.
FISCAL IMPACT
The Final Tract Map is an applicant-initiated project. The applicant has paid applicable fees for
the processing of this map.
DISCUSSION
On August 11, 1997, the Planning Commission adopted Resolution No. 3539 recommending
that the City Council approve Tentative Tract Map 14396 for the development of 113 estates
residential units at the northwest intersection of Tustin Ranch Road and Pioneer Road
(Attachment A- Location Map). The City Council approved Tentative Tract Map 14396 on
August 18, 1997, by adopting Resolution No. 97-86.
The project was subsequently divided into three phases. Phase I, or Final Map 15563,
contained forty-six (46) units. Phase II, or Final Map 16184, included fifty-one (51) numbered

parcels. Phase III, Tentative Tract Map 15993 includes twenty-two (22) numbered lots and
fourteen (14) lettered lots for development of twenty-two (22) estate density residential units.
Approval of Tentative Tract Map 15993 included numerous conditions to be met prior to
approval of the Final Tract Map. Several conditions have not been satisfied; however, the
applicant has requested an expedited review of the final map. Outstanding items include'
Execution of subdivision and monumentation bonds and agreements between the City and
the developer (Condition No.1.3); and,
Acceptance of an easement for street and highway purposes to provide access from
Peters Canyon Road to the tract (Condition No. 2.1). The project entrance is located on
Peters Canyon Road and traverses the existing County regional multi-purpose trail along
the western side of Peters Canyon Road that extends from Peters Canyon Regional Park
to the eastern City limits near Jamboree Road and Trevino Drive within the City
boundaries. The easement would be approximately sixty (60) feet in width and twenty-
eight (28) feet in length and allow a paved road in place of the regional multi-purpose trail.
The Easement Deed from the County is attached to Resolution No. 01-104 as Exhibit A.
The Final Map will be in substantial conformance with the Tentative Tract Map approvals, the
City's Zoning Code and Subdivision Code, and the State Subdivision Map Act, upon fulfillment
of the above items. Staff recommends that the City Council accept the Easement Deed and
approve Final Tract Map 15993, subject to completion of Conditions 1.3 and 2.1 of Resolution
No. 01-53 to the satisfaction of the Community Development Department, Public Works
Department, and the City Attorney prior to recordation.
In addition, approval of Tentative Tract Map 15993 required compliance with all conditions of
approval of Planning Commission Resolution No. 3787 related to development of the site for
residential units. Condition 3.3 of Resolution 3787 required that open pedestrian access at the
entrance from Peters Canyon Road to the site be provided at all times. The City Council
adopted a new policy on July 2, 2001, that allowed locked pedestrian access for gated
residential developments within east Tustin. Therefore, Condition 3.3 of Resolution No. 3787
is no longer applicable and a finding has been included in Resolution No. 01-105 to reflect the
new policy.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
ACCEPTING AN EASEMENT DEED GRANTED TO THE CITY OF
TUSTIN BY THE COUNTY OF ORANGE FOR PERPETUAL EASEMENT
AND RIGHT OF WAY FOR STREET AND HIGHWAY PURPOSES
The City Council of the City of Tustin does hereby resolve as follows:
The City Council finds and determines as follows:
A. That access to Tract Map 15993 was intended to be provided from Peters
Canyon Road through an easement approximately sixty (60) feet in width and
twenty-eight (28) feet in length that traverses the' County of Ora'nge regional
multi-use trail that extends along the west side of Peters Canyon Road;
B. That the location of the entrance to Tentative Tract Map 15993 was approved
by the Planning Commission and the City Council in accordance with the
Tustin General Plan and the East Tustin Specific Plan;
C. That on August 27, 2001, the Planning Commission adopted Resolution No.
3800 determining that the location, purpose, and extent of the easement
conforms to the City's General Plan;
D. That on October 23, 2001, the County Supervisors granted a perpetual
easement and right of way for street and highway purposes to the City of
Tustin; and,
E. That the intersection of the trail and roadway entrance at Silverado Terrace will
be designed jointly by the County of Orange Public Facilities and Resources
Department and the City of Tustin Public Works Department to ensure the
safety of pedestrians, bicyclists, equestrians, and vehicles and facilitate all
modes of circulation at this location.
II.
The City Council hereby accepts the perpetual easement and right of way for
street and highway purposes for the entrance to Tract 15593, as described in the
Easement Deed in Exhibit A attached hereto.

a perpetual easement and right of way for street and highway purposes, in, on and over the real property
in the County of Orange, State of California, described as:

GRANTEE shall not cause or permit any "Hazardous Material," as hereinafter defined, to
be brought upon, kept, or used in or about the Easement Area. If GRANTEE breaches the
obligations stated, herein, or if contamination of the Easement Area by Hazardous Material
otherwise occurs for which GRANTEE is legally liable tO GRANTOR for damage resulting
therefrom, then GRANTEE shall indemnify, defend with counsel approved by GRANTOR, and
hold GRANTOR, the County of Orange, and their elected or appointed officials, officers,
employees, and agents harmless from any and all claims, judgements, damages, penalties, fines,
costs, liabilities, or losses (including without limitation, diminution in value of the' Easement
Area, sums paid in settlement of claims, attorney fees, consultant fees, and expert witness fees)
which arise during or after GRANTEE's use of the Easement Area as a result of such
contamination. This indemnification includes, without limitation, costs incurred by GRANTOR
in connection with any investigation of site conditions or any cleanup, remedial, removal, or
restoration work required by any federal, state, or local governmental entity or agency because of
Hazardous Material being present in'the soil or ground water under the Easement Area.

GRANTEE shall promptly take all action, at its sole cost and. expense, as is necessary to clean,
remove, and first have obtained GRANTOR's written approval'and the approval of any restore
the Easement Area to its condition prior to the introduction of such Hazardous Material by
GRANTEE, provided GRANTEE' shall necessary governmental entities.or agencies.
As used herein, the term "Hazardous Material" means any hazardous or toxic substance, material, or
waste which is or shall become regulated by any governmental entity or agency, including, without
limitation, .GRANTOR acting in its governmental capacity, the State of California, or the United States
government

The City Council of the City of Tustin does hereby resolve as follows'
The City Council finds and determines as follows:
A,
That Final Tract Map 15993 to subdivide an 18.95 acre into twenty-two (22)
numbered lots and fourteen (14)lettered lots for the purpose of developing
twenty-two (22) estate density residential units was submitted by Adams
Streeter on behalf of Standard Pacific Homes for consideration;

That the City Council approved Tentative Tract Map 15993 on May 21,
2001;

That, as conditioned, the proposed subdivision is in conformance with the
Tustin General Plan, Tustin Zoning Code, State Subdivision Map Act and
the City's Subdivision Code. In addition, the project has been reviewed for
consistency with the Air Quality Sub-Element of the City of Tustin General
Plan and has been determined to be consistent or has been conditioned to
be consistent with the Air Quality Sub-Element;

Pursuant to Section 15268(b) (Ministerial Projects) of the California
Environmental Quality Act (CEQA), the Final Map is considered Statutorily
Exempt from the requirements of CEQA;

104 for acceptance of a perpetual easement and right of way for street and
highway purposes granted from the County of Orange to provide access
from Peters Canyon Road into the tract; and,

That Condition 6.1 (F) of Resolution No. 01-53 and Condition 3.3 of
Resolution No. 3787 are no longer needed due to the newly adopted City
Council policy, which allows residential communities in East Tustin to
maintain locked pedestrian gates.
II.
The City Council hereby approves Final Tract Map 15993 to subdivide an 18.95
acre site into twenty-two (22) numbered parcels and fourteen (14)lettered lots for
the purpose of developing twenty-two (22) estate density residential units, subject
to completion of Condition Nos. 1.3 and 2.1 of Resolution No. 01-53 to the
satisfaction of the Community Development Department, Public Works
Department and the City Attorney prior to recordation.
