RESOLUTION NO. 76-114
A RESOLUTION OF THE CITY COUNCIL, CITY OF TUSTIN,
CALIFORNIA, FINDING AND DETERMINING DISABILITY OF
LESLIE C. JOHNSON
·
WHEREAS, the City of Tustin (hereinafter referred to as
"Agency") is a contracting agency of. the Public EmploYees
·
Retirement System; and
WHEREAS, the Public Employees Retirement Law. requires
that a contracting agency determine whether an employee of
such agency in.e~ployment in which he is classified as a
local safety member is disabled for the purposes 0f the'
·
Public Employees Retirement Law, and 'whether such disability
is "industrial" within the meaning of such Law; and
WHEREAS, an application for disability retirement of
LESLIE C' JOHNSON employed by the Agency in the position of

WHEREAS, the City Council of'. the City of Tustin has
reviewed the medical and other evidence relative to such.

alleged disability; ..
NOW, BE IT RESOLVED:

1. That the City Council of the City of Tustin finds
and determines, and it does hereby find and determine, that
LESLIE C. JOHNSON is incapacitated within the meaning of
Public Employees Retirement Law for performance of his
duties in the position of Fire Captain; and
2. BE IT FURTHER RESOLVED that the City Council of
the City of Tustin finds and determines, and it does hereby
find and determine, that such disability is a result of
injury or disease arising out of and in. the course of his
employment, and neither said LESLIE C. JOtINSON nor the City
of Tustin has applied to the Workmens Compensation Appeals
Board for a determination pursuant to Section 21023.6 of the
·
Government Code as to whether such disability., is industrial;
and

3. BE IT FURTHER RESOLVED that LESLIE C. JOHNSON be
separated from his employment effective October 24, 1976,
·
and that no d'isput:e as to the expiration o'f such leavo rights
is pending. ''
