RESOLUTION NO. 76-96
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING PLANS AND
SPECIFICATONS FOR THE INSTALLATION OF
STADIUM LIGHTING IMPROVEMENTS AT TUSTIN
HIGH SCHOOL AND DIRECTING THE CITY CLERK
TO ADVERTISE FOR BIDS

WHEREAS, it is the. intention of the City Council of the
City of Tust. in, California, to' inst'all stadium lighting
improvements at Tustin High School; and

~he City Engineer has presented plans and
for the construction of said work at.this
location.
NOW, THEREFORE, BE IT RESOLVED that the plans ~and
specif:cations' presented by the City E'ngineer be and are hereby
approved as the plans and specifications for the installation
of stadium lighting improvements at Tustin High School.
BE IT FURTHER RESOLVED that the City Clerk. is hereby
authorized and di.rected to advertise as required by law for the'
receipt of sealed bids or proposals for the doinq o-- the work
specified in the aforesaid plans and specifications which said
advertisement shall be substantially in the 'followin~ words, and
figures, to-wit:
"NOTICE TO CONTRACTORS"
SEALED 'PROPOSALS will be received at the ozfice of the
City Clerk, Tustin City Hall, Centennial Way at }~ain Street,
Tustin, California, until 11 o'clock A.M. on the 29th day of
Septeri~er, 1976, at which time they will be publicly opened and
read, for performing work as follows:
Installation of Additional Stadium Lights

The foregoing quantities are approximate only, being given as
a basis ·for the comparison of bids,, and the City of Tustin ·does
not, expressly or by implication, agree that the actual amount of
.
work will correspond therewith, but reserves the right to increase
or decrease the amount of any class or portion of the· work, or to
omit portions o.f the work as may be. deemed necessary-or advisable
by the Engineer.
Plans, specifications, and pr·op0sa! forms to be used for
bidding on this project can only be obtained by prospective
bidders upon payment of $5.00, which amount Shall not be refundable,
at the City Clerk's office, Tustin City Hall, Tustin, California.
In conformance with Section 37931 of the Government Code,
.
all bids shall be presented'under-sealed cover' on the proposal
~orm D vided and accompanied by one·. of the following forms of
bidd. er's security·:
Cash.
Cashier's check made payable to the City of Tustin.
.
Certified check made payable ~to the City of Tustin.
Bidder's bond· executed by.an accredited surety insurer,
made payable to the City of Tustin.
The security shall be in an amount equal to at least ten
percent (10%) of the a.mount of the contractor's bid. A bid shall
not. be considered unless one of the forms of bidder's security'
is enclosed 'therewith.

A Surety Bond for payment of labor and materia'ls will' be
required in the amount' of fifty percent (50%) of the es·timated
total contrac.t .price and a Faithful Performance Bond in the amount
of one hundred percent (100%) of the estimated total contract
price in the .form attached to the contract documents. Said bonds
shall be issued by ai company having K raging of A+AA. or better.
City of Tustin reserves the right to reject any or all bids,
and/or waive any informality on a bid. No bidder may withdraw
his bid· for a period of thirty (30) days after the date set for
the·opening thereof.. .

The contract will be awarded to the lowest qualified bid·der.

Provisions of'the State Contract Act are not applicable,
and prospective bidders will not be required to be prequalified.

Tustin has ascertained and does hereby determine that the
general prevailin'g rate of wages and employer payments in the
locality of the City of Tustin, California, for each craft or type
of workman needed to execute the work herein above specified is
as .set forth in Resolution 76-11.

PASSED AND 'ADOPTED by the City Co'uncil of the City of
Tustin, California, this 7th day of September, 1976.
