HUSTON, CITY MANAGER FROM: REDEVELOPMENT AGENCY STAFF SUBJECT: DESTRUCTION OF OBSOLETE PLANS FROM FORMER MARINE CORP AIR STATION (MCAS) TUSTIN SUMMARY Resolution No. 01-91, the Recorci Retention/Disposition Schedule, permits destruction of records and documents which meet certain criteria with the approval of the City Attorney and the City Council. RECOMMENDATION Adopt Resolution No. 08-14, authorizing the transfer of obsolete plans from the former MCAS Tustin to the Tustin Area H istorical Society, and further authorizing the destruction of any of the remaining obsolete plans not accepted by the Tustin Area Historical Society. FISCAL IMPACT None. BACKGROUND/DISCUSSION The Defense Base Closure and R~lignment Commission recommended closure of Marine Corps Air Station Tustin ("MCAS Tustin") located within the cities of Tustin and Irvine and consisting of approximately one-thousand six hundred and two (1,602) acres of real property together with the buildings, improvements and related and other personal property located thereon and all rights, easements and appurtenances thereto. The President and Congress concurred with that recommendation and MCAS Tustin was closed on July 1, 1999. Pursuant to the power and authority provided to the Navy under the Defense Base Closure and Realignment Act of 1990, as amended, and the implementing regulations of the Department of Defense (32 CFR Part 175), the Navy initially conveyed or leased portions of the former MCAS Tustin to the City of Tustin approximately 1153 acres of real property, easements, certain personal property (including building and improvement plans) and all utility systems serving the federal surplused portions of the former MCAS Tustin, portions of MCAS Tustin being conveyed to other agencies as public benefit conveyances, to the Army Reserve site, and to portions of MCAS Tustin intended for sale by the Navy. To support redevelopment of the former MCAS Tustin, in conjunction with the Specific Plans, buildings and certain improvements, including most of the nanways, have been demolished. The list of obsolete plans corresponds to buildings and improvements that no longer exist. As an alternative to destruction, the Tustin Area Historical Society has offered to accept the obsolete plans for historical purposes. Tustin Resolution No. 01-91 authorizes the destruction of City recorcis, documents, and papers upon the approval of the City Council and the written consent of the City attorney, provided that those records are not included within certain specified categories. Shingleton Assistant City Manager Matt West Redevelopment Project Manager Attachments: Resolution No. 08-14 RESOLUTION NO. 08-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE DESTRUCTION OR TRANSFER TO THE TUSTIN AREA HISTORICAL SOCIETY OF CERTAIN FORMER MARINE CORP AIR STATION (MCAS) TUSTIN IMPROVEMENT PLANS IN THE POSSESSION OF THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY NO LONGER REQUIRED FOR THE CONDUCT OF CITY BUSINESS, PURSUANT TO THE AUTHORITY GRANTED BY THE CITY OF TUSTIN'S RECORDS RETENTION SCHEDULE WHEREAS, the City of Tustin Records Retention Schedule adopted by the City Council by Resolution No. 01-91 on September 17, 2001, authorizes the transfer to the Tustin Area Historical Society or destruction of former MCAS Tustin improvement plans upon the approval of the legislative body of the City, and with the written consent of the City Attorney, provided that said records are not included within certain specified categories; and WHEREAS, the Tustin Community Redevelopment Agency has requested authority to destroy certain documents or in the alternative transfer said documents to the Tustin Area Historical Society related to the former Marine Corp Air Station (MCAS) Tustin which are not included within said categories of documents of the City of Tustin Records Retention Schedule; and WHEREAS, all of the documents listed in the attached Exhibit A were prepared on a date at least two years prior to the date of this resolution; and WHEREAS, the described documents listed in Exhibit A is occupying space needed by the Community Redevelopment Agency of the City of Tustin; and have determined that none of the described documents have sufficient value to justify retention; and WHEREAS, the City Attorney hereby gives written consent to the transfer Tustin Area Historical Society or destruction of the described documents listed in Exhibit A. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, does hereby resolve as follows: SECTION 1: That the following documents and papers described in Exhibit A are no longer required by the Tustin Community Redevelopment Agency because all buildings depicted or identified in the documents have been destroyed and no longer exist in the City of Tustin. Resolution No. 08-14 Page 1 of 10 SECTION 2: That the proper official of the City of Tustin having custody of the above described documents is hereby authorized to destroy or transfer to the Tustin Area Historical Society said documents in a lawful manner, as scheduled. SECTION 3: That upon transfer or destruction of the aforementioned and described documents, a certificate of destruction shall be executed as to the documents destroyed and the original certificate of destruction filed in the Office of the City Clerk.
