HomeMy WebLinkAboutCC RES 76-051 RESOLUTION NO . 76- 51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA OPPOSING THE SALE OF EXCESS STATE PROPERTY CURRENTLY DESIGNATED AT UTT PARK The City Council of the City of Tustin does resolve as follows: WHEREAS, certain State land described on the attached parcel map has been declared excess by Caltrans, and Caltrans has determined that the land is to be sold .at the appraised value of $115,000 either to the City of Tustin or a private developer; and WHEREAS, said property has been leased to the City of Tustin for. a period of five years and is currently being used by area residents as a neighborhood park; and WHEREAS, said property has been improved by the City of Tustin and a developer with improvements valued at over $15,000 and maintained by the. City of Tustin for the same period of time at an annual cost of over $1,200; and WHEREAS, the City has determined that because of its unique configuration and proximity to the freeway, its current zoning and land use represents the highest and best use of this parcel; and · WHEREAS; the City feels that the appraised value and sales price of' $115,000 is far too excessive for such a parcel; and · WHEREAS, the City has determined that this parcel meets the general criteria of the Porter Bill as set forth in Section 104.15 of the Streets and Highway Code; and ' WHEREAS, any other use of this property other than as a park would be a.hardship to the residents and youth of this area as well as an adverse environmental impact on the area. ' NOW, THEREFORE, The City Council of the City of Tustin does hereby resolve and declare as follows: That, at such times when open space and recreation are at a premium that any other use of this property would adversely impact the community, and further that since this property has been developed and maintained as a park for the City, the State's appraisal and offer to sell at $115,000 for a site of 1.92 acres is far too excessive. The City has also determined that a park is the highest and best use for this parcel and that since the City cannot pay $115,000 for the site, the City urges Caltrans to reappraise the site to reflect the proper value in essentially in its best use, and continue the current use as a park for a period of not less than 10 years. The City of Tustin will continue to main- tain the park during that 10-year period for the enjoyment and welfare of the community residents. · PASSED AND ADOPTED at a regular meeting of the city Council, Tustin, California on this 7th day of June, 1976. · 32 87 STATE OF CALIFORNIA) COUNTY OF ORANGE ) SS CITY OF TUSTIN RUTH C.
