HUSTON, CITY MANAGER FROM: SCOTT JORDAN, CHIEF OF POLICE SUBJECT: SURPLUS FIREARMS INVENTORY REDUCTION SUMMARY The Police Department has phased out the .40 caliber Glock and Beretta semi-auto duty handguns and the retention of these weapons is not warranted based upon needs of the agency and facility storage capabilities. The current inventory includes sixteen (16) Glock Model 22s and four (4) Beretta Model 96 handguns. Qualified sworn personnel have expressed a desire to purchase the weapons at the current market price established from our firearms supplier. All sales and transfers would be completed in the same manner as previously approved past surplus weapons sales. RECOMMENDATION Authorize the sale and transfer of ownership of twenty (20) surplus handguns previously issued as duty weapons to qualified sworn personnel per Department of Justice guidelines. FISCAL IMPACT Estimated revenue from sale of firearms - $5,300.00. BACKGROUND The Police Department has replaced the duty-issued .40 caliber Glock and Beretta semi-auto handguns this year following several malfunction issues related to the Glock handguns. Although the malfunction issues were apparently resolved by the manufacturer, the confidence level of the officers in utilizing them as their primary duty weapon is still a concern. Based upon rangemaster and armorer recommendations; and in an effort to minimize multiple caliber weapons in the field and training environments; the elimination of the .40 caliber weapons was approved. Surplus Firearms Inventory Reduction April 15, 2008 Page 2 of 2 The Glock Model 21 .45 caliber semi-auto handguns, (the standard duty-issued weapon of the Police Department), replaced the .40 caliber handguns, utilizing funds from the firearms training account. This was with the understanding that the replaced .40 caliber handguns would be sold, and the proceeds would be deposited back into the firearms training account to offset the costs. A quote for the sale of the handguns to our weapons supplier was obtained and a price of $265.00 was established for the used handguns. On several prior occasions involving firearms replacement, sworn personnel have expressed an interest in the purchase of used firearms and Council has approved the sale and transfer of the involved firearms under the guidelines of the Department of Justice. To date, 16 sworn personnel have expressed an interest in purchasing one of the current surplus guns for their own retention and use; and it is believed at least four additional personnel will be interested, resulting in the disposition of all twenty (20) handguns. The transfer of ownership and registration is conducted through a licensed firearms dealer per Department of Justice guidelines with transfer fees paid by the buyers. In addition to the DOJ transfer paperwork, a bill of sale between the City of Tustin and the buyer includes a stipulation that the sale or transfer of ownership to a third party cannot occur. Should the buyer no longer desire ownership of the weapon, it shall be turned in to a local law enforcement agency for destruction. The weapons have been checked by a departmental armorer, but are sold as is. (A sample bill of sale is attached.) SCOTT M. JORDAN Chief of Police BILL OF SALE 1. Buyer further agrees to turn the above goods over to a law enforcement agency for destruction if buyer no longer desires to retain the goods.
