RECOMMENDATION
That the Planning Commission adopt Resolution No. 4089 determining that the public
infrastructure at Tustin Legacy to be planned, initiated, or constructed during the
2008/2009 fiscal year is in conformance with the Tustin General Plan.
BACKGROUND
Section 65401 of the California Government Code (Planning and Zoning Law) provides
that a list of the proposed public works recommended for planning, initiation, or
construction during the ensuing fiscal year shall be submitted to the Planning Commission
for a determination of conformity with the adopted General Plan.

Attached to this report is a needs list of all public infrastructure proposed at Tustin Legacy
through buildout. This infrastructure is required for the ongoing development of the former
Marine Corps Air Station — Tustin. All of the proposed improvements listed on the needs
list are identified in the Tustin General Plan or are consistent with the goals and policies of
the Tustin General Plan.
Therefore, the public infrastructure at Tustin Legacy to be planned, initiated, or constructed
during the 2008/2009 fiscal year is in conformance with the Tustin General Plan.

RESOLUTION NO. 4089
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN DETERMINING THAT THE PUBLIC INFRASTRUCTURE AT
TUSTIN LEGACY TO BE PLANNED, INITIATED, AND CONSTRUCTED
DURING THE 2008/2009 FISCAL YEAR CONFORMS WITH THE
TUSTIN GENERAL PLAN.
The Planning Commission does hereby resolve as follows:
The Planning Commission finds and determines as follows:
A. That public infrastructure is being planned, initiated, and constructed at
Tustin Legacy to accommodate the ongoing development of the former
Marine Corps Air Station - Tustin.
B. That all of the proposed improvements listed on the Tustin Legacy Public
Infrastructure Needs List are identified in the Tustin General Plan or are
consistent with the goals and policies of the Tustin General Plan.
C. That California Government Code Section 65401 provides that a list of the
proposed public works recommended for planning, initiation, or construction
during the ensuing fiscal year shall be submitted to the Planning Commission
for a determination of conformity with the adopted General Plan.
D. That general plan conformity determinations required by Government Code
Section 65401 are not "projects" requiring environmental review pursuant to
the California Environmental Quality Act.
II. The Planning Commission hereby determines that the public infrastructure at Tustin
Legacy to be planned, initiated, or constructed during the 2008/2009 fiscal year is in
conformance with the Tustin General Plan.
PASSED AND ADOPTED by the Planning Commission of the City of Tustin at a regular
meeting held on the 22nd day of April, 2008.
