HomeMy WebLinkAbout03 GP Conformity (Bridge)ITEM #3 Report to the � Planning Commission DATE: APRIL 22, 2008 SUBJECT: GENERAL PLAN CONFORMITY DETERMINATION APPLICANT: COUNTY OF ORANGE RESOURCES AND DEVELOPMENT MANAGEMENT DEPARTMENT PROPERTY OWNER: COUNTY OF ORANGE LOCATION: SANTA ANA — SANTA FE CHANNEL AT FUTURE TUSTIN RANCH ROAD OVERCROSSING ZONING: UNCLASSIFIED ENVIRONMENTAL DETERMINATION: THAT GENERAL PLAN CONFORMITY DETERMINATIONS REQUIRED BY GOVERNMENT CODE SECTION 65402 ARE NOT "PROJECTS" REQUIRING ENVIRONMENTAL REVIEW PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUEST: GENERAL PLAN CONFORMITY FINDING FOR THE CONVEYANCE OF A BRIDGE EASEMENT OVER THE SANTA ANA — SANTA FE CHANNEL. RECOMMENDATION That the Planning Commission adopt Resolution No. 4088 determining that the location, purpose, and extent of a proposed conveyance of an easement for a bridge over the Santa Ana — Santa Fe Channel are in conformance with the Tustin General Plan. BACKGROUND Section 65402(b) of the California Government Code (Planning and Zoning Law) requires a county to submit a request for, and obtain a general plan conformity determination from, the local planning agency prior to acquisition or disposition of real property within the planning agency's jurisdiction. The County of Orange Resources and Development Management Department is proposing to convey a bridge easement to the City of Tustin from the Orange County Flood Control District over a portion of the Santa Ana — Santa Fe Planning Commission Report General Plan Conformity Determination April 22, 2008 Page 2 Channel. The Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed conveyance are consistent with the General Plan. The proposed overcrossing of Edinger Avenue, existing railroad tracks, and the Santa Ana — Santa Fe Channel is associated with the extension of Tustin Ranch Road from its present terminus at Walnut Avenue to Warner Avenue. The extension of Tustin Ranch Road will improve traffic flow in the area and is a critical link to the Tustin Legacy development at former Marine Corps Air Station — Tustin. The extension of Tustin Ranch Road is identified in the County's Master Plan of Arterial Highways and in the Circulation Element of the Tustin General Plan. The Planning Commission does hereby resolve as follows: The Planning Commission finds and determines as follows: A. That the County of Orange Resources and Development Management Department proposes to convey a bridge easement to the City of Tustin from the Orange County Flood Control District over a portion of the Santa Ana — Santa Fe Channel to accommodate the proposed extension of Tustin Ranch Road. B. That the proposed overcrossing of Edinger Avenue, existing railroad tracks, and the Santa Ana — Santa Fe Channel is associated with the extension of Tustin Ranch Road from its present terminus at Walnut Avenue to Warner Avenue. The extension of Tustin Ranch Road will improve traffic flow in the area and is a critical link to the Tustin Legacy development at former Marine Corps Air Station — Tustin. That California Government Code Section 65402 (b) provides that a county shall not dispose of any real property within the corporate limits of a city until the location, purpose, and extent of the project has been reported by the local planning agency as to the conformity with the applicable, adopted general plan. D. That general plan conformity determinations required by Government Code Section 65402 are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. II. The Planning Commission hereby determines that the location, purpose, and extent of a proposed conveyance of an easement for a bridge over the Santa Ana — Santa Fe Channel conforms with the Tustin General Plan.
