HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: FINAL PARCEL MAP 2007-131 SUMMARY Final Parcel Map 2007-131 is a request to consolidate twelve (12) existing lots into two parcels to accommodate a 31,281 square foot new library at the Civic Center complex. (Applicant/Owner: City of Tustin). As authorized by the Tustin City Code Section 9314, the Community Development Director, following consultation with the City Engineer, waived the requirement for a tentative parcel map since the proposed subdivision is resulting from the conveyance of land or any interest therein to or from the City for public purposes; thus, only a Final Parcel Map is processed. RECOMMENDATION: That the City Council adopt Resolution No. 08-32 approving Final Parcel Map 2007-131 to consolidate twelve (12) lots into two (2) parcels to accommodate the new library at the Civic Center complex. FISCAL IMPACT: Final Parcel Map 2007-131 is aCity-initiated project. All processing fees have been appropriated in the approved budget for the project. ENVIRONMENTAL: The approval of final subdivision maps is statutorily exempt pursuant to Section 15268 of Title 14, Chapter 3 of the Califomia Code of Regulations (Guidelines for the California Environmental Quality Act). BACKGROUND: The new library project site is located adjacent to the existing library within the Civic Center complex (Attachment A -Location Map). The project involves a number of required actions including site acquisitions, vacation of utility easements in a portion of Preble Drive Final Parcel Map 2007-131 May 6, 2008 Page 2 between East Third Street and East Main Street, utility relocations, General Plan Amendment (GPA 02-001) to change the land use designations of the acquired properties to Public and Institutional, Zone Change (ZC 02-001) to change the zoning of the acquired properties to P&I, Conditional Use Permit (CUP 02-003) to permit a library use within the P&I zoning designation, Design Review (DR 02-007) for design approval for the proposed library project, demolition of 12 acquired units and the existing library, and the construction of an approximately 31,800 square foot one story public library and the required parking. On September 12, 2005, the Planning Commission recommended that the City Council approve General Plan Amendment 02-001 and Zone Change 02-001 and approved a Conditional Use Permit to authorize the demolition of the existing library and the construction of a new library at 345 East Main Street. On September 19, 2005, the City Council approved the General Plan Amendment and Zone Change to accommodate the construction of a new library. On September 20, 2005, the Zoning Administrator approved Design Review 02-007 for the design of the proposed library. On September 5, 2006, the City Council adopted Resolution No. 06-102 ordering the vacation and abandonment of a portion of Preble Drive between East Main Street and East Third Street. Since the project site consists of several lots, Condition 2.1 of Planning Commission Resolution No. 3999 and Condition 1.5 of Zoning Administrator Action 05-019 require that the project complies with the State's and City's Subdivision Code. Consequently, Final Parcel Map 2007-131 has been prepared to consolidate the twelve (12) existing lots into two parcels. Parcel 1 would accommodate City Hall, Police Department, Council Chambers, Community Center and parking areas, and Parcel 2 would accommodate the new library building. Pursuant to Tustin City Code Section 9314, the Community Development Director, following consultation with the City Engineer, is authorized to waive the requirement for a tentative parcel map since the proposed subdivision is resulting from the conveyance of land or any interest therein to or from the City for public purposes. Accordingly, the Director waived the requirement for a tentative parcel map and thus the proposed Final Map has been prepared. DISCUSSION Final Parcel Map 2007-131 (Attachment B -Submitted Map) consists of a total of 7.98 acres. Parcel 1 is a 6.71 acre parcel and comprises City Hall, Police Department, Council Chamber, Community Center and all parking areas. Parcel 2 is a 1.27 acre parcel and comprises the proposed library building. All existing easements will remain in effect and new easements are proposed for utility relocations. Staff has reviewed Final Parcel Map 2007-131 and has determined that the map is in substantial conformance with the City's Zoning Code, Subdivision Code, and the State Subdivision Map Act. Staff recommends that the City Council approve Final Parcel Map 2007-131, subject to final approval of the City Engineer prior to recordation. Final Parcel Map 2007-131 May 6, 2008 Page 3 Tim D. The City Council finds and determines as follows: A. That Final Parcel Map No. 2007-131 is a City initiated project to consolidate twelve (12) existing lots into two (2) parcels to accommodate a new library within the City of Tustin Civic Center complex; B. That pursuant to Tustin City Code Section 9314, the Community Development Director, following consultation with the City Engineer, waived the requirement for a tentative parcel map since the proposed subdivision is resulting from the conveyance of land or any interest therein to or from the City for public purposes; therefore, only a Final Parcel Map is processed; C. That the proposed subdivision is in conformance with the Tustin General Plan land use designation of Public and Institutional and Public and Institutional (P&I) Zoning District in that these designations provide for the development of a public library; D. That the site is physically suitable for the type and intensity of development proposed; E. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems; F. That the parcel map or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat; and, G. That the approval of final subdivision maps is statutorily exempt pursuant to Section 15268 of Title 14, Chapter 3 of the California Code of Regulations (Guidelines for the California Environmental Quality Act). II. The City Council hereby approves Final Parcel Map 2007-131 to consolidate twelve (12) existing lots into two (2) parcels, subject to final approval by the City Engineer prior to recordation.
