CURRIE SCHOOL AND DIRECTING THE CITY CLERK TO ADERTISE FOR BIDS. f the City of Tustin, California to construct tennis courts at A. G Currie · School, and WHEREAS, the City Engineer has .presented plans and specifi- cations for the construction of said work at this location, NOW,. THEREFORE, BE IT RESOLVED that the plans and specifi- catio~s presented by. the City Engineer be and are hereby approved as the plans and specifications for the construction of. tennis courts at A. G. Currie School. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and direc~zed to advertise as required by law for the receipt of sealed bids or proposals for the doing of the work specified in the aforesaid plans and specifications which said advertisement shall be substantially in the following words and figures, to-wit- . "NOTICE TO CONTRACTORS" SEALED PROPOSALS will be received at the office of the City CleZ:k, Tustin City Hall, Centennial Way at blain St., Tustin, California, u~'~.til 10 o'clock A.M..on the 9th' day of March 1976, at which time they will be publicly Opened and read~,-~f°r performing work. as follows- Construction of tennis courts at. Lump Sum Lump Sum Bid Alternate "A" Bid Alternate "B" construct 4 construct 2 courts courhs A-2 The foregoing quantities are appro'ximate only, being given as a basis for the comparison of bids, and the 'City of Tustin does ~ot, ~xpressly or.by implication, agree that the actual amount of work will correspond therewith, but reserves the ri¢;ht to increas~ or decrease the amount of any class or portion 'of the work, or to omit portions of the work as may be deemed necessary or advisable by the Engineer. The City reserves the right to select either Bid Alternate "A" or Bid Alternate "B". 'Plans, specifications, and proposal forms to be used for bidding on this project can only be obtained by prospective bidders upon pa~nent of $5.00, which amount shall not be refundable., at the City Clerk's office, Tustin City Hall, Tustin, California. In conformance wi th Section 37931 of the Government Code., all. bids shall be presented under sealed cover on the proposal form provided· and accomp.~..nied by one of the following forms of bidder's security- a. Cash. ' b. Cashier's check made payable to the City of ·Tustin. c. Certified cheCk made payable to the City of Tustin. d. Bidder's bond' executed by an accredited surety, insurer, -. made payable to the City of Tustin. · . . · The security shal'l be in an amount equal to at least ten percent (16%) of the amount of the contractor's bid for alternate' "A". A bid shall' not be considered unless one of-the forms of bidder's security is enclosed therewith. . . · A' Surety Bond for payment of labor and materials will be requi~ed in the amoun~'of fifty percent (50%) of 'the estimated total contract price and a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total contract price in the form attached to the contract documents. Said bonds shall be issued .by a company having a rating of A+k~ or better.. City of Tustin reserves the right to reject any or all bids, and/or waive any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. .- · The contract will. be awarded to the lowest qualified bidder. Qualifications-. The tennis court contraCtor shall provide · evidehC~, tO th'~ "ci~-y that he has adequate experience-in... construction of conCrete tennis courts. The successful low-' bidding tennis court contractor shall 'submit a' list of 'five or ' more, 'if required, tennis court locations, which have been.constructed by him, and which he can make available for visual inspection before acceptance of bid. Cement finishers, employed by the tennis court contractor shall have a minimum of.. five (5) years experience. A-3 in finishing of concrete tennis courts; Tennis court contractor shall provide substantiating evidence of cement finishers experience and qu'alification~ to the owner. Finishing of concrete surfaces shall be .performed only by qualified tennis court cement finishers. Minimum of five (5) finishers per half 'court. The contractor shall keep the Owner · advised as to when finishing of concrete will be performed. Finishing shall be performed only in the presence of the 'Owner. :.' Provisions of .the State Contract Act are not applicable, and' · prospective bidders will not be required to be prequalified. · All work to be done under the direct supervision of the . City Engineer. Ail work to be paid for at the unit prices bid from appropriate' monies. .. Said City' of ITustin, pursuant to the Labor Code of the State of California, has ascertained and dete~mined that. the general prevailing rate of hourly and per diem wages in the locality-in which the said work herein described is to be' performed, for each craft or type of workman or mechanic needed to execute the 'cont~act and also the general prevailing rate for legal holidays and over- time work for each craft or type of workman or mechanic, to be' as indicated in Resolution 76-11as previously published in a 'ne~s- p·aper of general circulation, and on file in 'the office of the City 'Clerk. . · Employer payments other than those itemized therein, as' defined in Section 1773.1 of.' the Labor Code, are to be paid in accordance with the terms of the collective bargaining agreement applicable to the type .or classification of the workmen or mechanic employed on the project.
