SUBJECT: AWARD OF CONTRACT FOR CONSTRUCTION OF THE SYCAMORE
AVENUE STORM DRAIN FROM SCHOOL LANE TO DEL AMO AVENUE
(CIP NO. 5033)
SUMMARY
Bids for the Sycamore Avenue Storm Drain from School Lane to Del Amo Avenue (CIP No.
5033) have been received and a construction contract is ready to be awarded.
RECOMMENDATION
It is recommended that the City Council award the construction contract for the Sycamore
Avenue Storm Drain from School Lane to Del Amo Avenue (CIP No. 5033) to Garcia Juarez
Construction, Inc., the lowest responsible and responsive bidder, in the amount of
$375,720.00, and authorize the Mayor and the City Clerk to execute the contract documents
on behalf of the City.
FISCAL IMPACT
The Fiscal Year 2007-2008 Capital Improvement Program (CIP) Budget provides a total of
$681,996 for design and construction of the project of .which $431,996 are Federal
Community Development Block Grant (CDBG) funds.

Bids were opened on April 8, 2008. There were thirteen (13) bids received and the results
are summarized as follows:

The references and the State Contractor's License for Garcia Juarez Construction, Inc.
(GJC) have been checked and are appropriate for the subject project. Their bid is
approximately 5% below the engineer's estimate of $395,705. This is primarily due to lower
than expected costs for the storm drain pipe and appurtenances, ductile iron water pipe and
concrete access ramps.
The City received a bid protest on April 14, 2008, from Cox, Castle & Nicholson LLP, legal
counsel for the Center for Contract Compliance (the "CCC"), alleging that GJC is not a
responsible contractor and, therefore, the City should not award GJC the contract. Staff
forwarded the CCC protest documents to GJC and the City Attorney for review and comment.
After reviewing GJC's response and after input from the City Attorney's office, Staff has
determined that the CCC's protest is without merit and does not controvert Staffs prior finding
that GJC is a responsible contractor capable of performing the contract as promised.
Accordingly, it is recommended that the City Council proceed with the award of the contract for
the Sycamore Avenue Storm Drain from School Lane to Del Amo Avenue (CIP No. 5033) to
GJC.
The proposed project consists of replacement of the existing on-street drainage conveyance
system with the installation of underground storm drain pipes, junction structures, and catch
basins. Upon completion of the underground improvements, the street will be resurfaced.
It should also be noted that Sycamore Avenue carries large volumes of school related traffic
associated with the three schools with direct access to the street. For this reason, the storm
drain project has been scheduled for construction during the summer months, when school
related traffic is lightest. Knowing that A.G. Currie Middle School, Jeane Thorman Elementary
School, and St. Cecilia School would all have some activities during the summer,
communication has been on going with representatives of these schools with regards to the
work schedule, the nature of the work, and detouring that will be required during construction.
