RESOLUTION N0. 75- 50
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, AMENDING THE CITY OF TUSTIN PERSONNEL RULES
AND REGULATIONS AND ADOPTING FURTHER PERSONNEL POLICIES.'
The City Co~nncil of the City of Tustin, California, does hereby
resolve as follows:
1. That the City Personnel Rules and Regulations are hereby
amended effective July 7, 1975, unless o·therxvise indicated
as follows: ~
Section 5G(1)(d) is hereby added to read as follows:

(d) Fair Labor Standards Act. Personnel covered by this
section shall receive overtime pay to the extent which
may be required with the Federal Fair Labor Standards.
Act, all regulanions adopted pursuant thereto, and
all interpretive bulletins issued thereunder.
Section 5H is ·hereby amended to read as follows: ·
H. Educational Incentive Compensation. The following addi-
tional compensation is hereby granted qualified personnel
as an incentive for employees to improve their level of
education in relevant fields beyond the expected level
for their position. Educational incentive compensation
is usually restricted to those positions within which
an improved educational level will produce improved
production or performance. Educational incentive com-
pensation shall cease upon termination of employment,
or promotion or transfer to a position for which such
compensation is not provided or for which the education
incentive qualifications' are beyond that which the emp-
loyee possesses. Provided, however, that any employee
receiving 'an incentive under the provisions of the
previous college unit standard shall remain entitled
thereto until the end of the-fall semester or the winter
quarter of the school year 1975-76, }Jut, in any event,
not later t~]an the start of the first pay period in
February, 1976.

Eligibility so terminated

upon filing a notice of success-
ful completion of the above
annual education or training
requirement wi th the Personnel

e. This program shall be effective
August 4, 19 75.
(4) The standard for "Firemen and Fire Engineers" and
"all other full-ti, me positions except departme~]t
heads" .shall. be subject to the following definitions:
a. Acceptable college semester units as used'in
the Employment Standard and Incentive Pay pro-
visions shall be defin¢?d as units reasonably
related to enabling the person to better per-
form his duties, including required courses

leading to a related degree. A liberal interpre-
tation of the related nature of courses shall be
made by the Personnel Officer. An employee may
request a predetermination by t!~.e Personnel
Officer prior to enrollment as to a specific
course's acceptance as "reasonably related".
b. No credit shall be given for classes completed
with a grade, below "C".
c. No credit shall be given for courses for which
the City paid and were attended entirely, or in
substantial part, on City time.
d. Credit shall be gi. ven for credits approved by the
college for military service in lieu of certain
"required courses".
e. Credit for non-job-related courses which are
.required for a job-related degree shall not
exceed 50% of the credits for job-related courses
until the related 'degree is received,, at which
time all such r~equired courses shall be credited.
Job-related courses shall not be limited to
technical courses unique to the department or
position class, but shall include, 'by a liberal
interpretation, courses which can reasonably
be construed to improve job performance and
related capability.
f. An official transcript may be required for
receiving'eligibility-
Section 8B(i) is hereby amended to read as follows:
(1) Work Week. The work week fo~ all full-time posit~ons
shall be 40 hours except that the work week for Fire
Department positions having 24-hour work shifts shall
be 60 hours (with an average of 21 scheduled productive
hours).
Section 15B is hereby af~ended to read as follows:
. B. .Health Insurance.. The City is enrolled in a group health
insurance plan in order to provide employees with compre-
hensive medical coverage. The City pays a portio-?~- of .the
cost and the employee pay. s the balance of the cost for
his particular coverage, if any. -
2. That the following policies are h~reby adopted effective
July 7, 1975, except as otherwise noted:
A. Salaries and Wages.
Ail regular full-time position classifications of the City
below department head level shall be granted a four (4) per-
cent increase effective the 'pay per~od commencing July 7,
1975, with the following exceptions:
Fireman, Fire Engineer
Fire Captain
Police officer, Police Agent,
Police Supervisor

Sen°~or Investigators hereby reclassified as Police Agents
shall receive an additional 1.95% until Ju].y~ 1976.

B. Medical Insurance
(1) For each employee without dependents, for each
employee who does not elect dependent coverage,
and for each employee with dependents who elects
dependent coverage, that City pay the premium on
the health and dental insurance policies presently
in force and any increases in premiums thereon which
may hereafter occur, up to a total payment obligation
of City as follows:
Effective July 7, 19 75
Effective January 5, 19 76
$52.04 per month
74.10 per month
C. Semi-Annual Fireman Physical Condition Test
The City and the Firemen's Association will jointly develop
a semi-annual physical condition test reasonably 'calculated
to insure that fire suppression personhel are capable of
fulfilling the physical requirements of their jobs. The
test will be tried for one year and then re-evaluated to see
if the concept is valid and useful.
