RESOLUTION NO. 74-67
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN CERTIFYING ENVIRONMENTAL IMPACT
REPORT NO. 74-2
The City Council of the City of TusSin does hereb~v
resolve as follows-
1. The C±tv Council ~:i. nds and dot. ermines-
A. That a draft Environmental Impact Report was
submitted to the City of Tustin by the K & W Kor-
potation of San Dimas, as prepared by Environmental
Anal?fsis Foundation of 'Newport Beach, California.
Bo That publ. ic notice and distribution of the Draft
F~nvironmental Impact Report %o all governmental
jurisdictions were made in compliance with Res-
olution No. 74-8 prior to a scheduled h~aring.

C. That public hearings were held by the Planning
Commission to receive public testimony related to
the impact u.oon the local environment of the orooosei
project.
D. That cOmments related to %he .oroposed develop-
ment of a residential subdivision and the environ-.
mental impact of proposed Tract No. 8490 to
accommodate a 43 lot subdivision, as amended to
create 32 single-family building lots, were receivec
by the public, staff, Commission, and other govern-
mental agencies.
2. The City Council determines:

A. That the adverse impact of the proposed devetoo
ment will be greater uoon "~he inhabitants of the
proposed subdivisi'on by reason of noise, air
and traffic constraints than upon the adjoinin~
pro.oerties.
B. That 'the proposed subdivision is not a desirabl
design as related %o traffic circulation and public'
safety.

C. Th'~t the project can be exDecf, ed to have an
adverse economic 'impact upon %he City of Tustin
and an adverse soci~o!oqical im.~act upon the future
inhabitants by reason of the division of school
boundaries and. geographic location.
3. The City Council hereby .certifies'EIR 74-2, an'
Environmental Impact Report relating to Tentativ~e Trac'
No. 8490, to consist of the initial draft, addendum,
public testimony, and communications received, with
the further stiuplation that certification of-the
Environmental Impact Report would not imml-? approval
of the proposed Tract 8490 in the absence of mitigating
meagures related to'the a~verse factors of traffic
circulation.
