RESOLUTION NO. 74-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE PLANTING, IRRIGATION AND RELATED LANDSCAPING WORK FOR TUSTIN CITY HALL AND COUNCIL CHAMBERS AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS. . ' '1 WHEREAS, it is the intention of the City Councl of the City of · Tustin, California, to install landscaping at the tustin city hall and Council Chambers; and , .~ltEREAS, the Building Official has presented plans and. specifications for the installation of said work at this location - ' 190W, THEREFORE, be it resolved that the plans and spcifications presented by the Building Official be and are hereby approved as the plans and specifications for the planting, irrigation and related landscaping work for ~astin City Hall and Council Chambers. BE iT .FURTHE.R RESOLVED that the City Clerk is hereby authorized and directed to advertise as req~ired by law for the receipt of sealed bids or proposals for the doing of t~he work specified in the aforesaid plans and specifications which said advertisement shall be substantial in the following .. words and figures, to-wit: : · "NOTICE TO CONTRACTORS" ' .. . SEALED PROPOSALS will be received at the office of ~he City' Clerk., ~ustin City tIall, 140 West Second Street,' Tustin California, until 11 o'clock A.M. on the 3rd day of September, 1974, at which time they will be publicly open~=d and read, for performing work as follows: In the City of Tustin, landscaping at the Tustin City Center. The foregoing quantities are approximate only, being given as a basis for the comparison of bids, and the City of Tustin does not, expressly or by implication, agree that the actual ~nount of work will correspond there- with, but reserves the right to increase or decrease the amount of any class or portion o'~ the work, or to omit portions of the work as may be deemed nece.ssary or advisable an~ in the best inte'rest of the City by the Engineer. Two sets of plans and specifications will be issued to t'he Contractor for bidding purposes, upon receipt of Fifty dollars ($50.00). Make deposit checks payable to City of Tustin. Additional sets will be available at a cost of Twenty-five dollars ($25o00). Deposit %~ill be returned upon return of documents in good condition within one week after bid opening. Doc~aents available at the Tustin city Hall, Tustin California, Thursday, August 22, 1974. 516 In conformance with Section .37931 of the Government ~ode~ all bids shall be presented under sealed cover on the proposal form provided and accompanied by one of the following forms of bidder's security: · a. Cash. · ' · . ' b. Cashier's check made pa ble to the City ~)f Tustin c. Certified check made payable to the City of Tustin · d. Bidder's bond executed b~ an accredited surety insurer, made . payable to the City of Tustin. .- The security shall be in an amount, equal to.at least ten percent {10%) of the amount of the bid. A bid shall not be considered unl. ess one of the forms of bidder's security is enclosed therewith. A surety Bond for payment of labor and materials will be r~quired in the amount of fifty percent (50%) of the estimated total contract price and a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total contract price in the form attached to the contract doc'~ents. Said bonds shall be issued by a company having a rating of A+AA or better. · · o City of Tustin reserves the right to reject any or all bids, and/or waive any informality on a bid. No bidder may withdraw his bids for a period of thirty (30) days after t~e date set for the opening thereof. Provisions of the State Contract Act are not appiicable, and prospective bidders will not be required to be prequalified. Ail work to be done under the direct supervision of the City of Tustin. . Ail work to be paid for at the unit prices bid from appropriate monies. · Said City of Tustin, pursuant to the Labor Code of .~he Sta~e of California, has ascertained and determined that the general prevailing rate of hourly and per (tliem wages in the locality in which the said work herein described is to be per- fom~med, for each craft or type of workman or mechanic needed to execute the contract and also the general prevailing rate for legal holidays and overtime. · work for each craft or type of workman or' mechanic, to be as indicated in Resolution 70-42 as previously published in a newspaper of general circulation, and on file in the office of .the City Clerk. Employer payments other than those itemized therein, as defined in -. Section ].773.1 of the Lab6r Code, are to be paid in accordance with the terms · of the collective bargaining agreement applicable to the type or classification of the workmen or mechanics employed on the project. . Copies of all collective bargaining agreements relating to the work as set forth in the aforementioned Labor Code are on file and available for ins'.p, ection in the office of the Department of Industrial Relations, Division . o of Labor Statistics and Research. .
