SUBJECT: SECOND READING OF ORDINANCE NO. 1353 PERTAINING TO
AUDIT COMMISSION REQUIREMENTS
SUMMARY:
The proposed ordinance will update section 1538 of the Tustin City Code to modify the
residency requirements for members of the Audit Commission.
RECOMMENDATION:
Have second reading by title only and adoption of Ordinance No. 1353 (roll call vote).
FISCAL IMPACT:
None.
BACKGROUND:
On June 5, 2008, the City Council had first reading by title only and introduction of the
following Ordinance:

THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 1538 OF
THE TUSTIN CITY CODE REGARDING THE AUDIT COMMISSION

ORDINANCE NO. 1353
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, AMENDING SECTION 1538 OF THE TUSTIN CITY CODE
REGARDING THE AUDIT COMMISSION
The City Council of the City of Tustin hereby ordains as ,follows:
SECTION 1. Purpose
The purpose of this ordinance is to modify the City of Tustin Audit Commission
membership requirement which pertains to residency.
SECTION 2. Section 1538 of the Tustin City Code is hereby amended to read as
follows:
1538 MEMBERS AND QUALIFICATIONS
The Audit Commission shall consist of five (5) members, at least three (3) of whom shall be
registered voters of the City during all times they hold office and two (2) of whom may be
registered voters within the area served by the Tustin Water Department, but outside the
City.
SECTION 3. If any section, subsection, sentence, clause, phrase, or portion of this
ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity of the remaining portions of this
ordinance. The City Council of the City of Tustin hereby declares that it would have adopted
this ordinance and each section, subsection, sentence, clause, phrase, or portion thereof
irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases,
or portions be declared invalid or unconstitutional.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin
on this 1st day of July, 2008.
