HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT SUBJECT: CONTINUE PUBLIC HEARING TO CONSIDER APPROVAL OF THE CITY'S HAZARD MITIGATION PLAN TO SEPTEMBER 2, 2008 SUMMARY Federal law requires the City to prepare a Hazard Mitigation Plan in order to remain eligible for federal pre and post-disaster mitigation funds. Staff has completed the draft Hazard Mitigation Plan which must be approved at a public hearing. Staff is requesting the City Council to continue the public hearing to September 2, 2008 in order for the Federal Emergency Management Agency (FEMA) to review and approve the plan. RECOMMENDATION Staff recommends that the City Council continue the public hearing to September 2, 2008. FISCAL IMPACT There is no fiscal impact associated with this item. BACKGROUND The Federal Disaster Mitigation Act of 2000 (DMA 2000) authorized a program for pre-disaster mitigation, streamlined the administration of disaster relief, and placed limits on federal disaster assistance costs from natural hazards. A key requirement of DMA 2000 is for states and local agencies to develop a Hazard Mitigation Plan to reduce risks to public facilities from natural hazards within their jurisdictions. Staff has been working for the past year with various local agencies and other interested parties to complete the City's Hazard Mitigation Plan. The City is required to conduct a public hearing prior to approval of the Plan. The City Council had originally set a public hearing for April 1, 2008 to consider adoption of the City's Hazard Mitigation Plan. The public hearing was continued to June 17, 2008 to allow review and approval by the California Office of Emergency Services (OES) and FEMA. Staff has received OES approval and is still awaiting FEMA approval. Staff is requesting the City Council to continue the public hearing to September 2, 2008. Tim D.
