RESOLUTION NO. 74-54
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
APPROVING SPECIFICATIONS FOR INSTALLATION OF CARPET IN CITY CENTER
COMPLEX AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS.

WHEREAS, it is the intention of the City Council of 'the City of Tustin,
California, to install carpeting in the City Center Complex, and
WHEREAS, the City Engineer has presented specJ.fications for the instal-
lation of said work at this location,
~NOW, THEREFORE, BE IT RESOLVED that the specifications presented by 'the
City Engineer be and are hereby approved as the specifications for the instal-
lation of carpet in the City Center Complex.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and

directed to advertise as required by law for the receipt of sealed bids or
proposals for the doing of the work specified in the aforesaid specifications
which said advertisement shall be substantially in the following words and
figures, to-wit-
"NOTICE TO CONTRACTORS
SEALED PROPOSALS will be received at the office of the City Clerk,
Tustin City Hall, 140 West Second Street, Tustin, California, until 11 o'clock
A.M. on the 12th day of July, 1974, at which time they will be publicly opened
and read, for perfo_rming work as follows:
Insta].lation of carpet in City Center Complex.
Bids are required for the entire work described herein:
installation of approximately 2,500 sq. yards of carpet in the Civic
Center Complex. Carpet shall conform to the following:
68% Acrylic, 29% Modacrylic, and 3% Zefstat- 54 ounce per yard face weight.
Stevens' Gulistan Hollyridge Smoke Brown No. 1315-301 pile, or Firth,
Alexander-Smith,. Mowhawk or equivalent.
The foregoing quantity is approximate only, being given as a basis for
the comparison of bids, and the City of Tustin does not, expressly or by im-
plication, agree that the actual amount of work will correspond therewith, but
reserves the right to increase or decrease the amount as may be deemed necessary
or advisable and in the best interest of the City by the Engineer.
Specifications, and proposal forms to be used for b. idding on this project
can only be obtained by prospective bidders upon payment of $5.00, which amount
shall not be refundable, at the Tustin City Hall, Tustin, California.

In confo~l~ance with Section 37931 of the Government Code, ali. bids shall be
presented under sealed cover on the proposal form provided ~,~.nd accompanied by
one of the following forms of bidder's security:
a. Cash.
b. Cashier's check made payable to the City of TustirL..,
c. Certified check made payable to the City of Tustin.
d. Bidder's bond executed by an accredited surety insurer, made
payable to the City of Tustin.
The security shall be in an amount equal to at least ten percent (10%) of
t~e amount of the bid. A bid shall not be considered unless one of the forms of
bidder's security is enclosed therewith.
A Surety Bond for payment of labor and materials will be required in
the amount of fifty percent (50%) of the estimated total co~'tract price and a
Faithful Performance Bond in the amount of one hundred percent (100%) of the
estimated total contract price in the form attached to the contract documents.
Said bonds shall be issued by a company having a rating of A+AA or better.
City of Tustin reserves the right to reject any or ali. bids, and/or waive
any informality on a bid. No bidder may withdraw his bid for a period of thirty
(30) days after the date set for the opening thereof.
The contract will be awarded to the lowest qualified bidder.
Provisions of the State Contract Act are not applicab].e, and prospective
bi¢tders will not be required to be prequalified.
Ail work to be paid for at the unit prices bid from appropriate monies.
Said City of Tustin, pursuant to the Labor Code of the State of California,
has ascertained and determined that the general prevailing rate of hourly and
perdiem wages in the locality in which the said work herein described is to be
performed, for each craft or tpye of workman or mechanic ne~.ded to execute the
contract and also the general prevailing rate for legal holidays and overtime
work for each craft or type of workman or mechanic, to be as indicated in
Resolution No. 70-42 as previously published in a newspaper of general circulation,
and on file. in the office of the City Clerk.
Employer payments other than those itemized therein, as defined in
Section 1773.1 of the Labor Code, are to be paid in accorda~ce with the terms of
the collective bargaining agreement applicable to the type or classification of
the workmen or mechanics employed on the project.
Copies of all collective bargaining agreements re!ati~g to the work as
forth in the aforementioned I~bor Code are on file and available for in-
spection in the office of the Department of Industrial Rela~'ions, Division of
¥~bor Statistics and Research.

BE IT ALSO RESOLVED that the City Council of the City of Tustin has
ascertained and does hereby determine that the general prevailing rate of
wages and employer payments in the locality of the City of Tustin, Califor:'~ia,
for each craft or type of workman needed to execute the work herein above
specified is as set forth in Resolution 70-42.
